Actually if you read the story he did not kill anyone. He was stalled on the Highway and then rear ended by 2 others. The Taxi driver stopped (didn't hit anyone), but then he was rear ended and knocked into the other lane where his cab was hit by a truck.

The illegal should never have been on the road, but he doesn't seem responsible for the death.

He is in this country illegally and driving illegally and running out of fuel on the freeway (also illegal), so yes, this illegal alien did cause the accident that took the life of a cab driver.

I don't disagree that he should not have been driving or even in the country, but legally the person who rear ended the taxi is at fault. It's a matter of personal responsibility and when you rear end a car it is your fault.

The root cause of the wreck was the vehicle stopped because it ran out of gas.

If not for the car out of gas the wreck would not have occurred.

The final analysis of the wreck will indicate which driver was at fault for what percentage of the wreck.

Could be:

50% driver who ran out of gas
10% cab driver for having his wheels turned into traffic
10% truck driver for hitting the cab
10% each other driver involved
etc....
