New York strip club to take tax case to Supreme Court

Why should anyone get a tax exemption for money made from an "artistic" performance? Who judges whether or not a performance is "artistic"? Do you really think the guy sitting on his hands think that the stripper giving him the lap dance is "artful".
"The club had argued that exotic dance fell under the exemption because it required practice and choreography."
So a prostitute should get the same exemption because her profession requires practice and acting, right?
