The whole question boiled down to whether the DNR Commissioner had 60 days or 90 days to make a decision. The whole thing could have been avoided had he made the decision quickly instead of dragging his feet. There is no law that says he can't make a decision right away.

The MN DNR has a long history of ignoring the law. I've had them claim 3 years after I added ponds to my license and 3 years after THEY APPROVED them in writing that the ponds were never approved. But that was just unbridled arrogance on the part of petty criminals in the MN Department of Natural Resources. They had no legal standing to make that wild claim but in MN you have to take that corrupt agency into court to make them follow the law because Governor Pawlenty is too busy and the legislature doesn't care.

Just goes to show that with enough money anybody can do anything with or next to the river. The laws made to protect the river are nothing more then a politicians’ "hot air" written on paper. Does anybody of government have the right to uphold the laws meant to protect the river?...in Minnesota apparently not.

DNR - Damn Near Russia.

If you tree huggers want to preserve the scenery along the river you should buy it with monies collected from willing donors, not taken by force from the unwilling in the tax code.

I agree with the court's ruling, but it just shows the injustice of our system. You can only fight back against the goverment if you are a millionaire and can afford it. The average person's only option is to take it up the butt.

You can lay this squarely on the doorstep of those petty little jerks on the Lakeland City Council and the Lakeland mayor's office. That whole burg should be bulldozed and returned to its natural state.

I must admit my first thought was money talks...but...You also have to spend a-lot of money
when you think you are right. The MN DNR is a very expensive foe to have.
The law had to be clarified and could have gone against Mr. Hubbard . That would not have changed his financial investment to get the law clarified.
Now we know.

Plus, in the interim, Hubbard has built the house set back 40 feet anyhow?!
Is this an everbody wins or everbody loses?
Oh, and the 'Sconies up north have already trashed the river!!
