I agree, and although I'm a 'law and order' type of person, I think in this case the sentance was too harsh. No weapons. The deceased was 3 times the legal limit of intoxication. ONE punch. Both parties were working, productive people. I would think differently if the perp had a lengthy criminal record, or punched out the other guy repeatedly, or used a weapon of any kind. This could have happened anywhere, anytime.
The lesson to be learned here is, if you are stupid, stinking DRUNK, do not involve yourself in a barfight. You are likely to lose big time. I know from experience. Find a way to walk away and not escalate the situation. I understand the victim's family being upset, but I also understand the possible fact that the perp felt threatened and tried to defend himself or tried to teach a lesson to a person, who, if sober, wouldn't have been anywhere near that kind of situation. If you are drunk, the last thing you want to do is get into a fight like that, 9 times out of 10, you will lose, unless the person you are fighting is drunker than you.

Drunk drivers get less time in jail, typically, for killing someone on the road, than this guy got.
Think about that for a few minutes, before you disagree. Yeah, I know that the victim had a promising life ahead of him, but even good people can make BIG mistakes.

if you cannot do the time, don't do the crime, guy is lucky judge could only give him 5 years, the fact that he did not intend to kill is what earned him 5 years, if he had intended to kill, would have been a lot longer, what exactly was he intending to do by hitting the guy?

"Back in the days when men were men..." gtfo...petty violence is the start of most stupid and easily avoidable conflicts...read story above. both sides exhibiting normal petty human behavior, but one dies from a freak 'accident' that could have been avoided by both parties. could have been self defense, could have been anger; i wasn't there but i'm pretty damn sure either side could have found a way to walk away if they really chose to.

Works for me. At least we would get rid of the wusses that are making this country a world wide joke. It's too bad that a yellow streak seems to be replaceing so many peoples spines in this country.

i'm glad you agree. people have so little faith in themselves today, always thinking some skydaddy is gonna save them from their weaknesses. strength of arms is what should determine who should live and die. let evolution take its natural course, the strong survive the weak perish. that's the only way we will ever weed out the bad genes so we may evolve one day into a new species before another great extinction takes place.

That is the problem with this state, you can kill someone and only do 5-12 years.Accident or not, this guy will be out in five years.Maybe you will be his next punching bag.

Actually, if he's good in jail, he will be out in less than 3 1/2 years.

Every judge who passes a sentence on a convicted felon is well aware of the "time off for good behavior" sham. That is why they can (and do) elevate the sentence to take that into account. They will raise the sentence by 25% so that with 'time off', the felon will get the actual time behind bars the judge wants them to serve as 'hard time'.

The full time would be served only as a penalty for being a really bad inmate.
