WE NEED TESTS MACHINES TO BE RECHECKED AND SEE IF ITS IN GOOD WORKING CONDITION BEFORE PEOPLE ARE TESTED ALSO WHATS MORE COMPANIES NEED TO STOP PUTTING ALCOHOL IN FOODS MOUTH WASH ETC SINCE ITS NOT NEEDED IN IT!!!!!!!!!! IF THIS MAN SWORE AND THE TEST STILL SAY S HE DID IT THEN ITS SOMETHING ELSE SO BE IT!!!! HE SUES THEN HE WILL WIN IT THEN AFTER THAT LET IT BE LEARNED THAT MACHINES FOR TESTING ARE WRONG!!!!!!!! LOT OF TIMES IVE SEEN PEOPLE ON MAURY SHOW GET BLAMED FOR THINGS THEY DONT DO ON LIE TEST AND SOMETHINGS WRONG WITH THEIR MACHINES SO ITS GOTTA BE CHECKED ON OR REPLACED SINCE ITS USED EVERYDAY CAN CAUSE FAULTY ON THEIR MACHINES!!! IN THE FUTURE IF MACHINES CONTINUE TO BE FAULTY OR WRONG THEN MAKE A LAW TO NOT USE IT IN THE USA!!! USE HARD PROOF OR VIDEO AS PROOF! GOT IT THANKS!

that is scary, so even though i don't even drink, it could show that i'm intoxicated. now i'm afraid to take one of those tests if i'm ever pulled over. that's insane. they should have to verify every positive test. like repeat it every 5 minutes and make the person take 3 tests and only then accept the results.

NO! Did you read the article?

The test in question can detect whether you drank alcohol within the last 5 days (or apparently just came in contact with it). This test is NOT used to check for alcohol in the bloodstream.

This is precisely why this goof ball doesn't have a case. If he has a case against anyone it is the police entity that used it as the sole basis for legal action. Of course you aren't likely to get a huge settlement (or even win anything at all) if you sue them. Sue where the money is. If this company gives this guy a penny without litigating the case I will be extremely put off.

You haven't been reading about the payouts then by police departments here in MN and nationally. Charge first, ask questions later,(and make payouts for said damages on the taxpayer dime.) Why should they change if we are the ones paying for it yet again??

Actually, the title of this article is wrong. The accuracy of the test is not in question. I work in a lab and deal with this type of test daily. It's the interpretation of the results that can be inaccurate. This lab (unlike others that also do this test) misrepresents what the level of EtG or EtS means. The two controlled studies of alcohol-based sanitizer use (which has to be very frequent use) show that indeed you can get EtG and/or EtS, but at very low levels. This CA lab was neglectful in their misleading interpretation of the levels they accurately measure. There has to be some level of benefit of the doubt. Also, EtG (and not EtS) can be degraded or created in certain circumstances in the sample. EtS is a great marker with accurate interpretation, as is EtG in combination with glucose and bacteria testing.

I applaud this Public Defender. He did a great job representing his client. It's nice to see that not all of them are so quick to make a deal with the D.A. for a guilty plea. I'm pretty sure this guy was hammered though.
