Last week, when President Barack Obama came to the Hill to meet with Senate Democrats, he informed them that he would personally get involved to sort out the confusion, and the White House said that OPM would issue guidelines this week.

The guidelines, released Wednesday, allow for members and staff to retain their subsidies from the government, an exception in exchange for giving up “premium tax credits” that they would otherwise be eligible for under Obamacare.

“The amount of the employer contribution toward their Exchange premiums is no more than would otherwise be made toward coverage under the [Federal Employee Health Benefits] Program,” the OPM release notes.

So the labor leaders are demanding that their workers with employer-sponsored coverage also gain eligibility for ACA subsidies. Otherwise, their workers will be “relegated to second-class status” despite being “taxed to pay for those subsidies,” a result that will “make non-profit plans like ours unsustainable” and “destroy the very health and wellbeing of our members along with millions of other hardworking Americans.”

‘The law as it stands will hurt millions of Americans’

The leaders conclude by stating that,“on behalf of the millions of working men and women we represent and the families they support, we can no longer stand silent in the face of elements of the Affordable Care Act that will destroy the very health and wellbeing of our members along with millions of other hardworking Americans.”

President Obama, of course, pledged that “if you like your plan, you can keep your plan.” But the labor leaders say that,“unless changes are made…that promise is hollow. We continue to stand behind real health care reform, but the law as it stands will hurt millions of Americans including the members of our respective unions. We are looking to you to make sure these changes are made.”

Blue Cross, Aetna, United, Humana Flee Obamacare Exchanges:

Aetna, a fortune 100 company with $34.2 billion in revenue, has pulled out of the government-run exchanges in three states, including the state of Connecticut, where it is based.

United Health Group, the largest health insurer in the United States, has taken a pass on California's individual health insurance exchange.

Two of the three largest health insurers in Wisconsin will also not participate in the state’s Obamacare exchange.

YET ANOTHER White House Obamacare Delay: Out-Of-Pocket Caps Waived Until 2015

The Obama administration had missed as many as one-third of the deadlines, specified by law, under the Affordable Care Act.

Obamacare contains a blizzard of mandates and regulations that will make health insurance more costly. One of the most significant is its caps on out-of-pocket insurance costs, such as co-pays and deductibles. Section 2707(b) of the Public Health Service Act, as added by Obamacare, requires that “a group health plan and a health insurance issuer offering group or individual health insurance coverage may not establish lifetime limits on the dollar value of benefits for the any participant or beneficiary.” Annual limits on cost-sharing are specified by Section 1302(c) of the Affordable Care Act; in addition, starting in 2014, deductibles are limited to $2,000 per year for individual plans, and $4,000 per year for family plans.

There’s no such thing as a free lunch. If you ban lifetime limits, and mandate lower deductibles, and cap out-of-pocket costs, premiums have to go up to reflect these changes. And unlike a lot of the “rate shock” problems we’ve been discussing, these limits apply not only to individually-purchased health insurance, but also to employer-sponsored coverage.(Self-insured employers are exempted.)

Reuters recently reported that security testing for Obamacare is months behind schedule. And Michael Astrue, former HHS general counsel and Social Security commissioner, has warned in THE WEEKLY STANDARD that "unless delayed and fixed" the Obamacare exchanges will "inflict on the public the most widespread violation of the Privacy Act in our history."

Low-premium, high-deductible health plans are endangered by Affordable Care Act

Rod Coons and Florence Peace pay $403 a month for a family health plan that covers barely any medical care for either of them until he or she reaches $10,000 in claims in a given year. And that’s just the way they like it.

“I’m only really interested in catastrophic coverage,” says Coons, 58, who retired last year after selling an electronics manufacturing business in Indianapolis. Beyond their premium, the couple typically spends no more than $500 annually on medical care, Coons says.“I’d prefer to stay with our current plan.”

That won’t be an option next year. In 2014, plans sold on the individual and small-group markets will have to meet new standards for coverage and cost-sharing, among other things. In addition to providing 10 so-called essential health benefits and covering many preventive-care services at no cost, plans must pay at least 60 percent of allowed medical expenses and cap annual out-of-pocket spending at $6,350 for individuals and $12,700 for families.

A ray of hope:

OKLAHOMA CITY -
A federal judge has denied part of the federal government's motion to dismiss Oklahoma's lawsuit challenging the new federal health care law.

U.S. District Judge Ronald White handed down the ruling Monday in Muskogee. The ruling grants parts of the government's request to dismiss the case but denies other parts.

White rejected the government's argument that Oklahoma lacked standing to challenge the law. The decision means that parts of the lawsuit, filed by Oklahoma Attorney General Scott Pruitt in 2011, will continue to be litigated.

Pruitt challenged implementation of the law after the Internal Revenue Service finalized a rule to allow the government to punish "large employers," including state governments, with millions of dollars in penalties in states without state health care exchanges. Pruitt says that is not permitted.

In a White House news conference a week ago, Obama said: "They used to say,'well, we're going to replace it with something better.' There's not even a pretense now that they're going to replace it with something better...they used to say they had a replacement. That never actually arrived, right? I mean, I've been hearing about this whole replacement thing for two years -- now I just don't hear about it, because basically they don't have an agenda to provide health insurance to people at affordable rates."

WHEN IN FACT:

"I think the president has an incredibly short memory," said John Goodman of the National Center for Policy Analysis in Dallas. "He seems to have forgotten his campaign spent millions and millions of dollars attacking the John McCain health plan. In fact, that was their major argument against John McCain."

After the campaign, that plan was championed in Congress and co-sponsored by Sen. Tom Coburn, R-Okla., and Rep. Paul Ryan, R-Wis.

Bondi said that the Department of Health and Human Services (HHS) is making it easier for someone to be hired as a so-called navigator, cutting back on background checks and eliminating a fingerprinting requirement, which could make it easier for a person’s private information to fall into the wrong hands.

“Because of time constraints, HHS [is] cutting back on the requirement to become a navigator, meaning they're not going to be doing background checks. They're not going to be fingerprinting these people,” said Bondi in an interview with Fox.

CHICAGO TRIBUNE: How President Obama is flouting Obamacare

Democrats strong-armed Obamacare into law three years ago. Now they're busy flouting it.

The mandate that employers provide insurance next year or pay a penalty, as the law requires? Delayed for at least a year.

The law's dictate that people applying for federal subsidies to buy insurance provide proof that they're eligible for the government aid? Scaled back.

Sharp limits on Americans' out-of-pocket costs for health care? Suspended for a year.

Providing members of Congress and more than 10,000 staff members with federal health care subsidies that the law does not allow? Done, via a deal brokered by President Barack Obama.

And on and on.
...
BOTTOM LINE: Let's delay and rewrite this ill-conceived law. Congress need not start from scratch. Lawmakers can build on what all of us have learned from three years of painful trial and error. Three years of attempting, but failing, to make this clumsy monstrosity work for the American people.

UPS to drop 15,000 spouses from insurance, cites Obamacare:

United Parcel Service Inc. plans to remove thousands of spouses from its medical plan because they are eligible for coverage elsewhere. The Atlanta-based logistics company points to the Affordable Care Act, or Obamacare, as a big reason for the decision, reports Kaiser Health News.

The decision comes as many analysts are DOWNPLAYING the Affordable Care Act's effect on companies such as UPS, noting that the move reflects a long-term trend of shrinking corporate medical benefits, Kaiser Health News reports. But UPS REPEATEDLY cites OBAMACARE to explain the decision, adding fuel to the debate over whether it erodes traditional employer coverage, Kaiser says.

Thanks to the (oxy)moronic Affordable Health Care and Patient Protection Act (Obamacare), University of Virginia employees will suffer ill, and perhaps unanticipated, financial side effects.

UVa announced today that due to “rising health care costs,” some working spouses will become ineligible for University insurance coverage:


Working spouse provision: Starting Jan. 1, spouses who have access to coverage through their own employer will no longer be eligible for coverage under U.Va.’s plan. Spouses who do not have coverage elsewhere can remain on the employee’s plan, and coverage of children is not affected.

“Rising costs” are cited as the culprit for the spousal (and several other) health coverage policy changes:


In all cases, those costs have marched steadily higher annually. U.Va. anticipates its medical plan costs to rise by about 6.8 percent each year. Total medical claims have increased from $99 million in 2008 to $127 million in 2012, an increase of 28 percent.

The University goes on to blame Obamacare for an anticipated $7 million cost increase next year:


Provisions of the federal Affordable Care Act are projected to add $7.3 million to the cost of the University health plan in 2014 alone. Federal health care reform will create new costs related to the “individual mandate” that requires all Americans to have health care coverage (or pay a penalty).
