Here are some of the issues at ebay that need to be investigated: It is ILLEGAL for a corporation to allow a glitch or malfunction (the automatic five-star on shipping DSR for instance) that adversely impacts a user (many of those "purged" were only out of compliance by 1 star) to continue for an extended period of time without fixing it (ebay did and has admitted this, see Ebay Drags Heels In Fixing Automatic Five-Star DSRs article by Ina Steiner). This is a BREACH of the user agreement that ebay has with the users affected by this. PAYPAL HOLDS; many (if not most) states do not allow a hold on funds of more than 10 days. Ebay has often slapped 21-day holds on sellers' PayPal funds. A Florida man contacted the banking regulators in his state, they contacted Paypal and got his funds released. Although PayPal is not a bank, it is a money transfer entity and as such falls under the banking regulators of each state. UNLEVEL PLAYING FIELD: As has been pointed out by many people in many threads, DSRs disproportionately impact and are used against small sellers while big box retailers such as TRUS remain essentially untouched. That's also ILLEGAL. These three are right off the top of my head, thank you for asking, I am certain there's more but i will have to study the matter further. I have said many times that a good sharp legal mind needs to look at what's going on at ebay (including the user agreement). Attorney general's offices are very good at that sort of thing. Remember, I am not an attorney, but like many on ebay I am sharp enough to know when there are some things amiss.

Media Bias Favors Ebay: From poster StockMiser on a PowerSellersUnite discussion board: "The investigative journalism" idea has been thrown about for years.

This is why is hasn't happened:

1 - Although Ebay sellers are technically ebay "consumers", the media is only interested in "ordinary consumers" - which we call "buyers".

2 - Most anti-ebay stories have historically been about ebay sellers scamming buyers. Ebay sellers are almost always seen as the villains.

3 - Ebay tells the media about all the "safeguards" they have put in place to protect them. Ebay is the hero.

4 - Ebay sellers ("the villans") complaining that ebay ("the hero") is being unfair because the rules are too strict gets a "ahh, the poor stay-at-home profiteer scammers are upset" reaction from the media.

The last time I can remember a seller-initiated media campaign resulted in no big story, but a nice little story (probably ebay-fed) about some buyers scammed by some sellers, and how ebay helped them out.

The morale, IMHO, is the media is NOT a friend, and never has been a friend, of the ebay seller. THe end result of all these stories is "Ebay really needs to keep a better eye on those evil sellers, and if they don't, we need stricter laws".

Ebay is always painted as the enabler of stay-at-home moms and dads, creative crafters, and entrepreneur housewives. Anyone having a problem with Ebay is always a scamming lying thief that needs to be kicked off ebay.

A seller purge? KUDOS to Ebay, the protector of the Consumer, Hero of the public good. Damn, they need a tax break!

Ebay just settled a $4.75 Million class action lawsuit. One of the things that is uniquely sad about the ebay situation is that a viable platform that actually was working well for small sellers (ebay) was PURPOSEFULLY and DELIBERATELY hijacked in a different direction by the CEO coming in charge in 2007 and that he made no bones about it and put into place systemic mechanisms (DSRs, PayPal holds, suspensions, restrictions) that are nto fairly and uniformly enforced. Is the new ebay profitible for stock holders (much of which consists of the top brass themselves)? Absolutely. Is there something wrong, unfair, and unethical with the way JD has gone about all of this and the small sellers who have suffered in the past 6 years? Absolutely. Have lines been crossed in terms of legality? I think the various lawsuits (including the $4.75 million class action suit settled recently) attest to that. Is this a media event? It could be and should be if the right investigative reporters were paying attention and doing their homework. But there are a number of factors that seem to have thus far prevented this, as were pointed out in the post prior to this one...

I am so sick of getting promotional e-mails from ebay, but they refuse to do anything about a buyer who stiffed me on a purchase right before Christmas. They are still taking their fee from the non-sale though.
Unfortunately there is no alternative to ebay that generates so many sales.
