Temporary insanity, slap his hand, probation and police protection for him and his property. Again this would never had happened if the COPs had been proactive and caught the crimminal kids.
COPs could utilize current technology to catch crimminals instead of forceing howmowners to enforce the law and making mistakes like this. COPs love to fill out reports after crime has been commited OR in this case aprehend an innocent homeowner who was harrassed by kids into doing something dumb.
Are you saying that the cops should have caught the kids before they committed the crime? He never even called the police. Also temporary insanity will not fly. His own words were that he wanted them dead.

He had reported the breakins to police, his neibor also stated he was being harrassed for a long time.

Insane people say stupid things and after long term harrassment he probably wanted them dead. Havn't you ever thought you wanted someone dead, it's not abnormal?

The teens were crimminals, not the homeowner. Had the teens not been threatening the old guy they would have not been injured!

I agree that Smith seriously crossed the line. He is not "all there". Hard to say if we will ever know the whole story.
Wonder what prompted these kids to do something this foolish in the first place?
In stories like these I want to know more about the kids and their past actions and why they broke into that house. I don't need to know anything more about Smith. Apparently, he has had at least one reported burglary at his home with significant property loss, including guns. I'm guessing the kids assumed he would be away from his home on Thanksgiving.

The police said there was a single break-in reported. I have also never wanted anyone dead let alone acting on it to commit cold blooded murder. It is chilling that you think that is normal.

It wouldn't surprise me if these same kids broke into the house before and got away with the loot, so they came back for more. Nice way to spend Thanksgiving.

Maybe YOU are abnormal?

It might make an interesting Topix poll.

"Have you ever wanted anyone dead?"

In my mind there would be: Osama Bidladen, Ed Gein, OJ Simpson, the Ft Hood Muslim killer, SOS, Tim Mcveih (sp? help seattle), Colorado Movie mass killer, anyone entering my house uninvited.

Actually I wanted Osama Bin Laden tried and spent the rest of his life in a cell (The same with the rest). Even if YOU wanted these people dead, that is not the same thing as wanting someone you are face to face with dead. Then to act on that feeling and execute a boy and girl is beyond that.

If I killed an intruder in self-defense, I'd call the police to report it.

This guy didn't call the police. He told a neighbor a full day later what he had done, and the neighbor called the police.

I'd rather have the Bidladen's in this world dead, no chance of a parden/release like the Lockerbie killer got, was that OK with you.

Pent up anger is powerfull, COPs did nothing to protect this homeowner basically turned the job over to him and he did it.

The homeowner was temporarily insane but not a murderer.

The crimminals in this case commited suicide by homeowner.

The criminals (with one "m") in this case are the school that gave you a degree. You are illiterate and obviously not schooled in the law. The homeowner will be tried and found guilty of second degree murder, anthough he will likely plead guilty to manslaughter in a plea agreement.

You do not know the legal definition on temporarily insanity or the definition of murder (or are trying to change them to fit your notions). Just because you call yourself Slew doesn't mean you have to act like Slew.

P.S. You are trying to compare two kids to the Lockerbie bomber or OBL...

The comparison was used to identify someone who I would want dead! The example lead to someone saying they would rather have someone sit in prison for life and I responded I'd rather see them dead because they couldn't be released and enjoy life after killing so many innocents.

IMHO anyone who kills anyone is insane to some degree. I'll bet this homeowner will plead insanity based on the COPs ignoring his needs and his frustration with the breakins. COPs didn't do their job and the elderly homeowner did.

The Woodbury COPs loaded an innocent hostage with lead in public and they arn't even charged. This homeowner loads up 2 crimminals with lead IN HIS OWN HOUSE AFTER NUMEROUS BREAKINS and is charged.

Makes no sense!
