It's Absolutely fair that you are required a drug screen before receiving welfare benefits. There are very few Employers who do not require a Drug Screen before hiring you.

It is a violation of the 4th Amendment. When Florida tried the courts ruled it in constitutional. It is a gross miscarriage against our most basic rights as Americans.

Since the Supreme Court ruled corporations are people to, then any time a company receives a tax break or receives a governmental subsidy, the owners of that company should be subject to drug testing. I see zero difference between the two.

I get so tired of hearing about people getting food stamps and then selling them. But they can pay for their car, beer, their cigarettes, pills and cell phones. But, they can't pay for food??? I AGREE 110%, drug test for anyone that gets any kind of assistance, even if it's only for food stamps. I guarantee, they won't get them long. And if u test positive ONE time, you never get any kind of assistance ever again in any state!

Let's see, you said the 4th Amendment...Right? The 4th Amendment states...The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized...You have the right to protest anyone searching your person, Your house, your papers and effects which would pertain to your property. I agree, but that doesn't say anything about someone requesting you take a Drug Screen (You have the right to refuse a drug screen , you just wouldn't be awarded the Welfare benefit.) Also your Property is protected and they would need a Warrant to search your Home, Car , Children or dependents...ok but still nothing about requiring you to take a test for a substance that could endanger the health and well being of fellow employees or possible damage to company(private property). I haven't looked into the claim of Florida declaring it unconstitutional which would be strange since they are one of the states enforcing it now...so your argument that it is unethical and unconstitutional is invalid and nothing about requiring you to have to be drug screened FOR a Monetary Benefit is in violation of any part of the 4th Amendment. Would you like to try again????

Unconstitutional and I think it is very fair. You get drug tested before almost any job. You get tested in the Army. Why would it be illegal to test welfare people? If they are able to work and choose to keep having babies to get more money then I say test them. If they have nothing to hide, they won't bitch about it.

I agree, but welfare recepients shouldn't be the only one that should be screened, all state employees, representatives, senators, governors, president and anyone else who's paycheck/check comes from the government (state and federal) Then I believe we can truly weed out that bad apples and truly make a difference.
When I hear people only complain about welfare recepients I can see that they have a low iQ.

tax payer wrote: KY, along with Florida and a few other states are going to start doing mandatory drug tests for people on welfare. Anyone know when this will start? They should also be made to show proof they are actively seeking work, just like you must do while drawing unemployment. I'm fine with my tax dollars helping those that actually NEED help, but I'm tired of supporting lazy, sorry bums. The law didn't pass in KY. The bill never came out of committee.

Would you like to try again???? Drug testing that is voluntary is not a violation of the 4th Amendment; but the 4th Amendment DOES protect against forced drug tests. That is a violation of your person and has been ruled unconstitutional by the Supreme Court. Having said that- the proposed bill would have required tests for those who want to receive welfare benefits. If you don't want to take the test you don't get assistance. Ergo, it is a voluntary procedure and is not a 4th amendment violation.

Of course you cannot, nor should not be forced to do anything.Like you said, if you take the test voluntarily you get the benefits. If you choose to not to take the test then no benefits. In my previous post I said you could be requested to take a Drug screen. That though does imply the drug screen as a Requirement and some people think that being asked to do something is the same as being made to do something...

My taxes pay for roads too.
