Gingrich's desire is that they should have to answer to Congress about their decisions. The Supreme Court has transcending powers over any branch of government we have. That was not the intent.

Supreme Court justices have unlimited power. Bureaucracies are actually unelected officials creating laws, fines and taxes which is what our elected officials should be doing. There is no mention of bureaucracies in our Constitution, yet they are there without challenge.

This is why we need to go back to the thoughts, words, and yes, the intent of our founders. Eliminate all bureaucracies, hold SC justices responsible, and equalize all branches of government.

Also, you might want to look into the historical evolution of the takings clause, how it ended up in the 5th Amendment, and how it has been interpreted in light of the 14th Amendment.

The problem with that is you would start a pssing contest. When Republicans are in charge, they would hound the liberal judge. Once that is done, it's only a matter of time before the Democrats do the same with a conservative judge if they ever regain leadership of Congress. From there, it would just go back and forth, back and forth.

Well justice's are nominated thru a politically partisan Party representative in the executive branch and confirmed by a majority of a politically partisan Party group of the legislative branch. Politics dictate the appointment of a justice, yet they are viewed as a separate, non-partisan decision making entity, as a group interpreting laws.
But like Reagan in his passing days and probably other politicians who develop mental illnesses such as alzheimers or other maladies, who determines their potential defecient mental state ? And remove them from power before they screw things up, like Hitler or Hairy Weed or Nazi Suposi or Obama or.....?

Who monitors and evaluates incompetent politicians, who make long-term decisions for millions and millions of people affecting their lives either positively or negatively ? And not know the reason behind their decisions. Hairy Weed continues to thwart the vote of a national budget for millions and millions of Americans ? He alone stops the budget vote.....
