The NM Supreme Court scheduled a hearing for Oct 23rd.

I think it's significant that they didn't issue an immediate injunction preventing any more marriage licenses from being issued in the meantime.

That tells me their presumption is those marriages are likely legal.

In a related news item, the federal govt (Kirtland AFB) is recognizing the marriages which have taken place in New Mexico as valid.

In addition, there are federal lawsuits underway in 13 other states, ballot initiatives started or likely in 4 more states, and state lawsuits in 3 more.

The problem is that the ACLU doesn't represent Civil Servants/Office holders for actions taken in the performance of their Office. Such cases are not, per se, "Civil" cases. A person operating as an Official is not functioning as a private Citizen in the realm of Civil Law.
