Cops: 3 Baldwin teens attempt robbery on delivery man

Three Baldwin teenagers ordered a delivery of Chinese food Thursday night as part of a plan to rob the deliveryman of his money and the food, Nassau police said.

Because attempted robbery in the 2nd degree is a class "D" violent felony as opposed to assault 3rd degree being a class "A" misdemeanor. You don't charge an underlying offense of the bigger crime. Hope that helps. They also more than likely got two charges each of att rob 2nd because they met two of the subsections: 1) They were each aided by another and 2) The caused a physical injury. Here is the section.

S 160.10 Robbery in the second degree.
A person is guilty of robbery in the second degree when he forcibly
steals property and when:
1. He is aided by another person actually present; or
2. In the course of the commission of the crime or of immediate flight
therefrom, he or another participant in the crime:
(a) Causes physical injury to any person who is not a participant in
the crime; or
(b) Displays what appears to be a pistol, revolver, rifle, shotgun,
machine gun or other firearm; or
3. The property consists of a motor vehicle, as defined in section one
hundred twenty-five of the vehicle and traffic law.
Robbery in the second degree is a class C felony.

*Note: An attempt lowers the class by one degree making this class C violent felony a class D violent felony as stated above.

There was also a brawl on Tuesday at the Baldwin Public Library....kids were out of control and totally disrespectful. They beat the pulp out of one. No one could believe it.

Freeport was a beautiful town when I was a kid 40 years ago. The homes in the NW section were like those in Garden City.

Thank you for your response, Kelly. My friend is is the SW part of Freeport. What is keeping Freeport from becoming another Brentwood, one might ask. Well, there is a core of caucasians that kind of refuse to let freeport fall into third-world status. One year at a time they keep Freeport holding on. How much longer, we don't know for sure. But Freeport does how its loyalists and it does have a waterfront. Unfortunately, many people pass by on Sunrise Hwy. or Merrick Rd. All they see is the once American downtown that now looks like El Barrio. However, the waterfront thrives. So, between the gringos that stay and the waterfront, Freeport holds on, one day at a time.
God help America!!
