after reading the article I can only wonder why was the underage teen even at the bar? Why wasn't he charged for fighting as well since it takes 2 to tango? An why does this retired officer not realize that when his son brought a loaded fiearm to school when he was in high school the favortism shown there was just as unfair being a cop just means to this man that unless it favors him an his family then the rules and playing field are un just an thats the bottom line.

Little scumbag kids. Put them in prison. Assault like that would be mandatory jailtime for anyone else.. not a misdemeanor. The kids mom was an ADA and now a lawyer but her son is out beating the living sh-t out of others... nice parenting!!!

Young guys, booze, bar fights? Sounds like the son was an active participant in a drunken rage.

Like most fights, someone wins and someone loses. This case, daddy is trying to make his kid look like an alter boy.

The case is now over. I wish that everyone would just move on with there lives.I am sure that there was an intensive police investigation done.My son is a good kid. I have seen worst children out there on the streets doing drugs and so on. I am his father and I am proud of my son for what he has accomplished in life.He is a good kid

just to clarify some facts, my son was an unwilling combatant in this assault. he was assaulted while seat-belted in his auto attempting to leave. drugs and alcohol played no part in the assualt on behalf of the complainant, witnesses or defendants. it was not a bar fight. patrons are allowed in any alcohol establishment providing they are not served alcohol.an unprofessional and improper investigation was conducted by the nassau county police 3rd squad.nassau county police department initially refused to respond to the hospital.hempstead village pd refused to respond as well. two of the three defendants were never contacted or interviewed by the investigating detective. they had no intentions of ever effecting their arrests.a severe attempt was made to improperly charge the defendants and expect the complainant just to accept this and walk away. a more proper investigation was conducted by the nassau county district attorneys office at my request and complaint and resulted in convictions of all defendants. its is my opinion that the same nassau county district attorneys office is unwilling to take the same aggressive investigatory steps to find wrong doing on behalf of nassau county police third squad.what has happened to my son can and will happen again and again to the poor unknowing citizen and nassau county resident that doesnt have the knowledge of the legal system. police refusing to respond to a crime in a timely fashion, unwilling to conduct a proper investigation and unlawfully lowering charges has got to stop!. this is about what can happen to any innocent citizen that may become the victim of a crime or accident. to respond to the comment by charles nelson, my son was never convicted of any possession of a firearm, an if he was would be protected by the defense of infancy and not a crime. in=mproper stating facts is a slanderous attempt to put a smoke screen on the true facts of what has taken place in this case...wake up nassau county, its your tax money paying for police services you are not recieving!

I hope to Christ this guy can peel ALL THE STINKY layers of this onion and get to the cronyism, elitism and corruption that is at the heart of it. Sadly, most cops feel they are above the law, and would think nothing about helping out some spoiled little brat.

I feel you pain, in 1990 A drunk driver hit me head on, and the Nassau & Freeport police covered it up because he was the son of a Nassau County Detective. Had it not been for the Dr at the ER @ South Nassau Comm Hospital doing a bllod test on him the kid would not have been arrested. Day later Daddy the detective called and threatened me if is filed a law suit.

Sadly none of this suprises me, the corruption in Nassau is unreal....! My advice...GET OUT ! It's a beter life off LI !!!!!

Fact of the matter is that if this was never brought along (DA) and the three guys got what they deserved quietly some night, alone, one on one...

Then justice would be served!

Three to one are not good odds. I for one would love to have a shot at such punks, given the chance... Let's see how'd they handle an old street guy...
I could promise you they'd have some medical bills.

I give you credit though for plowing it into the system. It takes great strenght to not want to retaliate... I don't know if I would be so strong. 3 to 1... kid in the hospital.........

No, I wouldn't... have to fortitute to allow them to get away with it! I would confront them and have someone with a video camera recording... I would push their buttons until they would attempt to get physical and then I would let them recieve their lil' can of Whoop Ass!

The vid would be my defense!

Stop righ there dad. He had one, just wasn't convicted... Pretend your a deFective again, and try to figure some things out. It happened in Hempstead, and they took a report. It required a follow-up investigation, and it got one. Because YOUR world revolves around your son doesn't mean anyone else's does. The whole department should stop because Junior got beat up? yeah, ok.... They got arrested, and convicted. Your son, the victim, wants nothing done. Stop sniffing for cash, and move on. Looks like junior did.

explain to me how an event that took place that you or the defendants were not a witness to or apart of have anything to do were not apart of has anything to do with an assault that has occurred six years later. the biggest baddest drug dealer or organized crime figure that has committed a lifetime of crime will get a proper investigation if he was the victim of a homicide or assault. apples have nothing to do with oranges. hempstead initially refused to take a report and then took one as a felony..they referred to the nassaau county third pct who lowered the charge. they did an improper and incomplete investigation due to outside influence and due to my complaint and perseverance , the case was indicted and properly charged by the nassau county da's office.this wasnt the son of sam case, it was investigation 101 and the third squad was looking to bury it...i dont need to sniff for cash, i want a severe wrong to be made right...its police corruption and on my last dying breath i will seek my pound of flesh...shame on you to let it go if it happened to a member of your family....open you eyes my friend, these are the same police you may need to help your family one day..i hope you get the same service..

I wish you would look into the case of the woman who was murdered in Suffolk. Why is the killer being charged with manslaughter and not murder? He says it was consensual "rough sex," but the victim is dead, and the whole thing sounds wrong to me.

Let's be honest, your son, who had not reached the age of 21, was in a dispute at a bar in Massapequa. Several weeks later he is still underage and in another dispute in the parking lot of a bar located in Hempstead. During this dispute he is seriously assaulted.

Lou, I'm thinking your son is not an angel. Yet that does not give anyone the right to assault another. I'm sorry your son was the victim of a serious violent assault.

Though in your son's defense, it is quite possible he is completely innocent.

Growing up, a friend's older brother was a twenty year-old mutt who went to bars with his friends for one reason, and that was to start a brawl and to fvck ppl up. They did this all the time. Real scumbags.

Lou, quite frankly I think you should admit your son was wrong for hanging around bars before he was of legal age. Making excuses for HIM is not helping YOUR case. I think most of your readers would like to learn that you have counseled your son about hanging out in bars and that you are keeping an eye on him to make sure alcohol use does not become a regular part of his life. That's all a parent can do.

Lou, as far as having the NCDA charged detectives with criminal offenses, please don't hold your breath. In all likelyhood it is not going to happen.

First thing you have to understand, and I'm sure you do, is that the NCPD is not a professional police department.

Unlike the NYPD, the NCPD does not do a very good or honest job of insuring it members adhere to their training when serving the public.
Field officers are poorly supervised and will feed a complainant any line of crapola they feel like in order to avoid making an arrest. If you make a complaint against a NCPD officer, the complaint is not investigated by an independent agency.

Lou, I believe your allegations that because of police family ties, detectives from the NCPD's 3rd Squad attempted to shvt-can this serious felony case - until you made a ruckus.

I believe you allegation that due to police family ties, a few Nassau County Police officials conspired to charge Spagnuolo with simple assault, even though your son clearly sustained serious, protracted injuries.

Lou, take a moment and think to yourself...how arrogant are these detectives that they would hvae the balls to charge the mutt who stomped your son with a simple assault....obviously they thought they could get way with it...the question is WHY the detective thought she could get away with charging a simple assault.

Lou, in all likelyhood, the NYPD, a professional police organization, would have investigated a detective who apparently improperly charged a prisoner...especially if there were allegations of collusion.
That is not going to happen in the NCPD, Lou...

I believe if Lou Balestrieri was assigned to investigate this case, that in less than 60 days you would have accumulated enough credible evidence to establish probable cause that the crime of Official Misconduct has been committed by some uniformed members of the NCPD.

Unfortunately, Lou, I don't see the DA locking up cops for this type of police corruption.

I don't see the NCPD disciplining anybody in this matter. And you know why they get away with it, because the community does not care. For some reason most Nassau residents seem to think their cops are professionals...you have shown them that is not true....but the community still does not care....this is one of the reasons why Nassau police can get away with acting like prosecutors and judges.

How about you mark this case closed by 'exceptional clearance' and take your son golfing.

Oh, you WERE there? So he DID have a weapon before. He was either found not guilty or took a plea. Nice kid you raised, dad.

Let's see. A cop takes a one line report about drunk morons fighting, and refers it to the squad, and based on that, it gets classified as one level of charges. Subsequent evidence reveals further.

to typical and others that pass derogatory comments not aware of facts:....i am a prudent person and know there are three sides to every story, my sons side, the defendants side, and the right side...this was not a bar room brawl that took place at 4:00 am..drugs and alcohol WERE NOT involved on anyones behalf..this is about an assualt that took place..my argument is not how or why it happened..it is about the nassau county police being summoned to the hospital by hospital staff via the 911 system and refusing to respond..it is about hempstead village pd refusing to respond and forcing me to take my son from the hospital just after surgery still under the effects of anesthesia to file a police report for an assault felony..the case was refered to nassau County third squad to complete the investigation and effect arrests..this is a no brainer case with one complainant, two witnesses, and three KNOWN DEFENDANTS..in other departments, to whit nypd, it would have been handled as a funtion of patrol..members of the third squad made a deliberate attempt to "shitcan" the assault on one defendant and never made any attempt to ever contact the other defendants..i took the complaint to the nassau county da's office for a proper investigation and a successful prosecution..this is POLICE CORRUPTION!..if you cant see the forest through the trees, please dont comment...this must be brought to light because it will happen to anyone not in the know..it is my attempt to expose this so that others will not become victim to this.. dont condem me till you have walked in my shoes..it is unfair for anyone who is a victim of a crime, be a victim of the scrupulous actions of police..i refuse to condem all of the nassau county police department..i know many that are fine hard working police officers..i condem those who have wronged me and are making great effort to get away with it..i have done my research..when a police department creates a subterfuge by undercharging crimes to gain easy convictions, they are misrepresenting facts giving the appearance that felony crimes are misdemeanors..its a play on crime stats..silence is acceptance!..and those not in the know will be a crime victim and then a victim to police by accepting an unprofessional, incomplete investigation...i know better, and wont let it happen to me or members of my family..you never know what tomorrow will bring..pray that you dont have to stand in my shoes....good luck!

I give the dad credit. He never said his son was an angel. But he was the VICTIM of something here and justice should be brought.

NCPD cops seem lazy to me. When you have an accident, they don't bother taking any statements or look for eyewitnesses. They can barely get out of their cars to help. I've been a victim of this and I was shocked that the cop didn't so much as ask if we were ok after we were hit from behind. NCPD cops approach red lights and intersections and suddenly turn on their lights and sirens because they don't want to wait. A block after, the lights and sirens go off. So it does seem as if obeying and observing basic laws are beneath the average cop, so why would a cover up seem off base? I hope the punks that did it get justice served to them some day the way they treated this kid.
