Miami Businessman Claudio Osorio Arrested for Allegedly Swindling Millions From Investors

A Miami businessman whom Ernst & Young once named "Entrepreneur of the Year" has been accused of swindling $40 million from investors, including some NBA stars, to support a lavish lifestyle.

Venezuelan-born Claudio Osorio, 54, was arrested Friday and charged with 23 counts of fraud and money laundering for exaggerating the success of his company, InnoVida, between March 2007 and March 2011, according to a Securities and Exchange Commission's complaint.

Craig Toll, 64, InnoVida's chief financial officer, was also charged along with his former boss.

Toll's attorney Richard Klugh released a statement to ABC News saying his client was "an honorable employee of the company and should not have been charged with anything."

Neither Osorio nor his attorney has responded to requests for comment. It's unclear whether the two men are still in custody.

Osorio allegedly took the money from about 10 investors, telling them that InnoVida produced building panels used to construct houses and other structures resistant to fires and hurricanes. Authorities say the high-flying businessman lured potential investors with false financial statements and high-profile connections, including a blue-chip board of directors that included former Florida Gov. Jeb Bush, who has not responded to a request for comment.

Osorio used the money to finance a lifestyle that included a $12 million mansion on Miami Beach's exclusive Star Island, which boasts nine bedrooms and a swimming pool with a gazebo. Osorio also illegally used investor money to buy a Maserati, a Colorado mountain retreat home and country club dues, according to the SEC complaint.

"From his lap of luxury, Osorio concocted a compelling story about InnoVida by recruiting an impressive board of directors and boasting a bogus financial condition to lure investors into funding his scheme of lies," Eric Bustillo, director of the SEC's Miami Regional Office, said in a news release.

Osorio allegedly even duped the likes of current and former basketball stars Dwight Howard, Alonzo Mourning and Carlos Boozer.
"Individuals who are looking for investors very often will have celebrities involved either as investors or on the board of their entity in order to give an air of credibility and attract other people to invest with them and we see that very often," said Dan Schorr, of Kroll Advisory Solutions, who has no connection to the case.

The SEC says that Osorio told one investor that InnoVida was valued at $250 million, and then a week later told a different investor that the company was worth $50 million.

Another one of Osorio's alleged victims was Miami businessman and lawyer Chris Korge, who says he met Osorio in 2008. The two men became close and Korge eventually invested $4 million in InnoVida, he says.

"Everything about the company added up," Korge told ABC News. "Once he got everything he could get from me, I started to notice the interaction I had with him started to slow down,"

Korge and others eventually filed lawsuits against Osorio, forcing InnoVida into bankruptcy in 2011 and his Star Island mansion was auctioned off.

"He convinced me that this was the opportunity of a lifetime," Korge said. "He was a fraudster and a sociopath."

I think the results of the Veon, Perzel, DeWeese, Orie, and Habay indictments are 100% proof of the power of immunity.

The corrupt elected officials and their staffers have no formidable defense against the gift of immunity to those they have used and abused for their illicit activities or personal gain.

This formula and strategy has worked almost infinite times and are well and available to neutralize and threaten Mon Valley corruption.

The latest success story is Clairton’s Mr. Imbrogno who spilled the beans to the federal investigators.

We wish the beleaguered solicitor a favorable verdict on December 19, 2012. There may be many depending on your availability.

With some serious gaming machine matters on the horizon and closing fast, the city solicitor will become a high demand asset for his confidants.

As the investigation converges on some deeply embedded in schemes and other nefarious activities, the barrister’s services are desperately required to create an impenetrable barrier veil for some.

Let us hope the non-jury trial judge(s) is benevolent and recognizes that bringing the city back depends on the legal skills of the consigliore due to unexpected circumstances.

We wish you the best possible outcome counselor. The victory celebration will not be at the watering hole on Versailles for obvious reasons.

What are the chances of those subpoenaed keeping silent or opting for immunity? This could be very worrisome for all the beneficiaries of the gaming profits.

Who knows what's next ? The Feds bypassed the Dems 'Z Man' in Pittsburgh - so no alarm was sounded. Did they really use metal detectors & other electronics at that house out in the West Newton area ? Was someone really burning money ?

Are they really looking at campaign contributions , golf outings & so on , etc ?

I doubt the task force left any stone unturned. The raids were too precise and flawless.

I believe the major concerns for all those alleged tainted by these illicit enterprises are the voices captured line taps, the brown bag couriers, IRS interests, and RICO violations. This could make for some sleepless nights.

These gaming devices were in operation with the County and local law authorities eyes with shut. Why and why and why?

Now the County and local law authorities have an opportunity to stop the quick replacement of the slots. How about a City elected official being host to many slots?

The worst politician in Port history will be the first politician or employee indicted and then convicted.

This has not happened since the infamous and illegal telephone line tapping of a MASD school director by a Haler Height Councilmen. The Councilman ended up in the federal cage.

There was just a postage size picture of a raid on gaming machines in the Daily News with no story attached.

I think these raid street rumors are a hoax and only one place was visited. I would guess one device was removed to give the DN a picture and to show the city is on top of it. The street rumors just blew this way out of proportion with only one incident, in my opinion. The local MPD law authorities did their job and we thank them for their services.

It is business as usual and this matter dropped off the end of the plant.

The City and political party can still expect and accept gifts from the machine vendor to support benevolent causes like elections, etc.

Thanks to all, we are back to normal and the Circus will return to City property. The machines could even show up at IV -- who knows? That certainly would help the IV balance sheet.

How come no machines are installed at the Marina and Palisades? I think this is city property like behind the fire station that hosted the Circus? This is a good revenue source being overlooked.

I agree with some of your suggestions. I also think that gambling devices should be installed in McKeesport Schools. After all, the school district survived the Cornell sex scandal and if teenagers can be exposed to teachers having a good time on taxpayers dime, why can't the kids play the slots. I also think that the level of teachers willing to work in McKeesport schools knowing that on any given day they are expected to cover-up criminal behavior, many would want to gamble their not-so-hard-earned paychecks away.

It's really amazing how all the democrats under the leadership of scoundrels like Lou Washowich and Jimmy Brewster destroyed anything sacred in McKeesport.
