ObamaCare in death spiral after federal appeals court strikes down some subsidies

Tuesday, a federal appeals court slapped down the Obama administration in a 2-1 ruling that could kill the president’s signature health care law. If upheld by the Supreme Court, the ruling would force Congress back to the drawing boards to design a health law that is actually affordable, rather than bearing the false title “Affordable Care Act.”

The ruling in Halbig v. Burwell bars the federal government from handing out taxpayer-funded subsidies to people who buy ObamaCare plans in nearly two-thirds of the states. Those subsidies took the sting out of being forced to buy pricey ObamaCare plans. If the ruling sticks, buyers in those states will have to pay full price, on average a whopping four times the subsidized price they paid this year.

Quadrupling the price would likely trigger a mass exodus out of the plans,causing what the insurance industry calls a “death spiral.”

The ruling by the influential appeals court for the District of Columbia also chastised the Obama administration for rewriting the law to suit its own ends.

Halbig is the latest in a series of warnings from federal judges that in America, the rule of law is king, not Mr. Obama.

This is a great story that cuts through the nonsense with hard facts. Despite the insistence by Republicans opponents of health care reform that there has been a "net reduction" in the number of insured Americans from Obamacare, this report shows that millions of previously uninsured Americans are now covered. Those "millions" alleged by the GOP to have "lost insurance" due to Obamacare simply do not exist.

There's one fundamental reason why Republicans were willing to risk political disaster to stop the rollout of the Affordable Care Act last fall, which included shutting down large portions of the federal government rather than pass spending bills that funded the new law. It's certainly true that since the shutdown, when Republicans were overwhelmingly condemned by the public,

But today, with the truth now coming into focus, it's undeniable: millions of Americans are benefiting from Obamacare. And it's becoming more and more obvious with each report on the number of newly insured that Obamacare isn't going anywhere. Before these 9.5 million previously uninsured Americans got insurance, or the millions more who are saving big with premium assistance got that assistance, Obamacare was a less tangible reality–something that could be taken away without as great an outcry. It's arguable that as soon as the early provisions kicked in, like the requirement to cover pre-existing conditions or allowing children to stay on their parents' health plans longer, there was already too many people benefiting for repeal to be a realistic possibility.

But now, it's flat-out impossible to repeal Obamacare without hurting millions of people–and any Republican who is unwilling to admit this is deluding themselves and their audience. As ABC News reports today, even conservative opposition to Obamacare is fading:

Independents, potential swing voters in the midterm elections, continue to tilt against the law, with 44 percent in support, 54 percent opposed, but that compares with 36-62 percent last fall. And while just 37 percent of independents approve of Obama’s handling of the rollout, that is 14 points more than its low four and a half months ago.

Among other groups…support for the ACA is up by 16 points vs. November among adults under age 40 – a coveted group for the law’s insurance pools – from 38 percent then to 54 percent now.[Pols emphasis] It’s gained a similar 15 points among those with incomes less than $50,000, from 38 percent then to 53 percent; 14 points among nonwhites, to 68 percent (compared with just 40 percent support among whites); and 12 points among those who lack a college degree, to 46 percent support.

Speaker John A. Boehner said Thursday that changes brought about by the Affordable Care Act make it impossible to repeal the health care law unless Congress has a replacement ready as well.
Speaking at a Rotary Club meeting in his Ohio district, the speaker also mocked members of his own conference for not wanting to address immigration, knocked the tea party — or, more specifically, organizations that raise money purporting to represent the tea party — and expounded upon the role of money in education, according to a news report from a newspaper near his district.
On health care, Boehner said simply repealing the Affordable Care Act “isn’t the answer” and it would take time to transition to a new system
The GOP, however, has taken a number of votes to repeal the law, including bills that would have completely repealed the law without replacing it. The party hasn’t unified behind a replacement, let alone voted on one, since Boehner took the speaker’s gavel. Republicans however have been working to craft such a bill for years, but no one has yet to see it .????. Boehner’s comments seem to reflect the new reality of the law. With 9.5 million people having signed up on the Affordable Care Act exchanges, and every state having adapted to the new regulations, repealing the law effective overnight would be messy in the extreme without at least a transition period.

The Five Worst Things About The New Republican Proposal To Replace Obamacare...

On Monday, a trio Republican senators unveiled an alternative to Obamacare eerily similar to the one that former presidential candidate Mitt Romney proposed in 2012. Every now and then a scholarly journal retracts an article because of errors or outright fraud. In academic circles, and sometimes beyond, each retraction is a big deal.

Now comes word of a journal retracting 60 articles at once.

The reason for the mass retraction is mind-blowing: A “peer review and citation ring” was apparently rigging the review process to get articles published.

You’ve heard of prostitution rings, gambling rings and extortion rings. Now there’s a “peer review ring.”

That is the argument former Secretary of State Hillary Clinton made during a Thursday interview about her much talked about 2009 reset of U.S.-Russia relations.

The statement comes as Russia, under President Vladimir Putin, has distanced itself from the United States, and the country is widely seen by U.S. and European analysts as linked to the downing of a passenger airliner earlier this month in Ukraine.

"What I think I demonstrate in the book, is that the reset worked," Clinton told guest host John Harwood on NPR's “On Point” on Thursday during a conversation about her new memoir, "Hard Choices."
