The MASD members, school administrators, an elected official, and union members involved in her illegal firing and blotched cover ups SHOULD BE SURCHARGED FOR ALL EXPENSES AND SETTLEMENTS WITH MS. D. and her attorneys.

The Cornell school sex scandal report covertly sneaked to the out of town news media should be published on the MASD website.

In addition, the costs of this matter from day one MUST BE REPORTED TO THE PUBLIC.

What was the total damage to the taxpayers due to the stupidity of the school board member who blindly fired her and rewarded the former union president.

Everyday the tick off the clock adds the total sum of money owed to Ms. D is accumulating very rapidly..... the sooner they settle the less tax payer money they have to shell out.
Ms. D is in total control of her future fortune coming her way.

I'd say back pay, slander, defamation of character ,attorney fees, are only the tip of the iceberg .....maybe final number could reach 7 figures.

Ms. D should hold on to their testicles and squeeze as long as possible..

The MASD school board members who voted to fire Ms. D neglected the duty to exercise good judgment, unbiased judgment, and impartial judgment and succumbed to the influence of the indicted late superintendent, Dr. Risha.

Section 318. Removal for Failure to Organize or Neglect of Duty.--If the board of school directors in any district (1) fail to organize as hereafter provided, or (2) refuse or neglect to perform any duty imposed upon it by the provisions of this act relating to school districts or (3) being a party to a joint board agreement refuse or neglect to perform any duty imposed upon it by the provisions of this act relating to joint boards or by the joint board agreement, any ten resident taxpayers in the district or, in the case of a distressed school district as defined in this act, the special board of control provided for in section 692 of this act, may present their or its petition in writing, verified by the oath or affirmation of at least three such resident taxpayers or, in the case of a distressed school district, by the Superintendent of Public Instruction, to the court of common pleas of the county in which such district or the largest part in area is located, setting forth the facts of such refusal or neglect of duty on the part of such school directors. The court shall grant a rule upon the school directors, returnable in not less than ten or more than twenty days from the date of issue thereof, to show cause why they should not be removed from office. The school directors shall have at least five days' notice of the granting of the rule. On or before the return day of the rule the school directors, individually or jointly, shall file in writing their answer or answers to the petition, under oath. If the facts set forth in the petition, or any material part thereof, is denied, the court shall hear the several parties on such matters as are contained in the petition.

McKeesport Area School District fires teacher in sex scandal

Published: Thursday, Feb. 24, 2011


McKeesport Area School District's board of directors voted 6-0 to fire a teacher who allegedly had sexual relations with another teacher in district classrooms.

Angela DiBattista was charged with immorality in an alleged 1999-2004 affair with Patrick Collins, a fellow teacher and former McKeesport Area Education Association president.

The decision came without comment toward the end of Wednesday's board meeting. District officials referred comment to solicitor Gary Matta, who was not at Wednesday's meeting and did not return calls requesting comment.

Director Thomas Maglicco made the motion to approve the recommendation of dismissal from hearing officer Thomas M. Costello. Director Jim Brown seconded it.

"Due to my previous involvement," director Patricia Maksin said, "I must abstain."

Maksin was MAEA vice president and Collins' successor as president. She also was a witness during a series of hearings conducted by Costello last summer.

Board president Wayne Washowich Sr., vice president Steven Kondrosky and directors Joseph Chiaverini and Joe Lopretto also voted yes, Lopretto by phone.

Directors Mark Holtzman and Christopher Halaszynski were absent. It may have been a turning point rather than the final word in the case. DiBattista could appeal the decision to the Pennsylvania Department of Education.

She also reportedly retained counsel for a lawsuit, separate from her attorney for the hearings.

Attorney Charles LoPresti declined comment, saying he wanted to wait "until we get official word" from the district and could talk to his client.

The hearings recalled events between June 2004, when DiBattista and Collins allegedly had a confrontation in a classroom from which DiBattista emerged with a black eye and May 2006, when Collins accepted a $53,000 settlement and retired. According to testimony last summer, DiBattista refused an offer of a settlement that was smaller because she had less tenure.

"It is not the district's fault that (Collins) had 33 years (tenure) and (DiBattista) 12," said Carl Beard, the Altoona attorney hired as special counsel by the McKeesport Area School District in January 2006. "Both were treated equally under the circumstances." LoPresti called his client a scapegoat. Beard said DiBattista had a hard life but wasn't a scapegoat.

DiBattista's brother John M. Zoscak testified that he didn't believe his sister's original claim that she hit herself with a coffee cup or pie tin that she threw at Collins.

Zoscak asked his sister, "Did Pat Collins hit you?" He said his sister replied, "Yes, he hit me."

Collins allegedly threatened to tell his wife and DiBattista's now- deceased husband of the affair if DiBattista ended it.

In his closing argument last July, LoPresti referred to an alleged offer of immunity by Matta and fellow MASD attorneys Jack Cambest and Jacob Skezas.

LoPresti said allowing his client to teach for nine months after Collins faced a March 2005 disciplinary hearing showed the district fulfilled its part of the bargain.

MASD special counsel Carl Beard argued that DiBattista violated community standards and failed to provide a good example for her students.

In his conclusion last July, Beard refuted LoPresti's claim that DiBattista was offered immunity if she testified against Collins at his hearing.

"It just doesn't make sense that (Cambest, Matta and Skezas) would make a carte blanche guarantee," Beard said.

McKeesport Area School District has rehired a former teacher who testified during a district judicial proceeding that she had sex with another teacher on school property in 2005.

Commonwealth Court judges ruled in an August 2013 decision the district wrongfully terminated Angela DiBattista from Cornell Intermediate School after promising her immunity for her testimony about the incident. The state Supreme Court declined to hear the district's appeal in the spring.

Ms. DiBattista’s first day back to work was Monday, Philip Fabiano, Ms. DiBattista’s attorney, confirmed. She will be working as a Title I math specialist for the district, he said. While he could not confirm which building she works in, she is certified to teach grades K-6.

“For everything she has gone through – the scorn, the judgment, she still wants to be there and wants to help her students,” Mr. Fabiano said.“Now it’s just a matter of her regaining what she has lost.”

Ms. DiBatttista and her attorney are still negotiating over lost salary after the district suspended her without pay in January 2006 and officially fired her in February 2011, he said. Before being rehired by the district, Ms. DiBattista was working as a dog groomer.

According to the approved 2014-15 district calendar, students are scheduled to return to school today, while teachers began professional development days Monday.

"There is no one happier for the first day of school than Angela DiBattista today,” Mr. Fabiano said.” She is back doing what she loves to do and wants to do and what she's good at."

Agree this is the best news in years. Justice prevailed because it got out of the county court system.

She should enter a suit against those who plotted against her.

The board who voted against her should be surcharge and/or removed.

As soon as these few remaining indictments move out of the county court system, justice will prevail again. What was the legal bill for the taxpayers for this mess m
