word on the street is she will get her job back as a teacher in MASD and back pay to a tune of 300K, PLUS damages( maybe another 500K ) and attorney fees..........the tax payer will pick up most of the tab.........the guards at the doors? what do they get?

One must try to determine the core of the attempted miscarriage of justice or is it a carriage of injustice? The attempted miscarriage backfired in Appeals Court, finally and thank the good Lord.

I would suggest that the core is the teachers' union and in particular the union president and officials at the time. The door watcher and his mistress were well entrenched in the union and the union protected them.

MASD administration are all former union members and their colleagues and social friends flow with union blood. The administration is functionally an extension of the union.

The MASD board had a lot of City employees and other board members supported by the union.

The dominate political czar controlled the board and he had strong influence over the City employee/board members. Also, he broke bread frequently with the late and despicable Dr. Risha (implicated in a contract fixing scam with convict Imbrogno). The late Dr. Risha held political golf outings for the czar. The late Dr. Risha fixed the disciplinary report on file for the watcher from bad to exoneration.

With all of the above, I would not blame the law firm when others dealt them a very bad legal hand and political climate at the outset.

Now that it appears that the judicial system corrected a long overdue wrong, will the wheels of justice roll over the "watchers" and others disciplined in the "secretive" report????

The school directors who voted to fire Ms. D. should be surcharged immediately for their stupidity and coward conduct.

Let us hope that this failed attempt of justice does not contaminate that other alleged investigations believed to be in progress in the Mon Valley. Will indictments be dragged out like the Ms. D. case to protected the alleged guilty?

Ms. D. deserves every cent her legal team can extract from those coward school directors. There is no amount of money that cam buy back the stress and embarrassment and professional harm the MASD school board caused her.

The three Judges got it right, and the MASD school board majority got is very, very, wrong and let several others who committed transgressions go free - so far!

It is nice to finally answer "YES" in response to this poll. The other three actors got a pass and she got, literally and figuratively, hosed. I do not condone her actions but the verdict reeks of justice.

You are correct the local news will continue to screen what they report and make sure it promotes the "feel good" theme of HOPE, LOVE, etc.

The fact is that street and public know who were involved with Cornell School door supervision when the fired female teacher and her rewarded male colleague were in involved in precreation gymnastics.

This rung bell of despicable acts and even worst the cover-ups will resonate a long time in the City and Mon Valley. No amount of pictures in the paper and feel good themes and bulling of informants or information suppression CAN UNRING THIS BELL OF TRUTH. Sound cares long and far.

In my opinion the AG should launch an investigation of the MASD board members who voted to fire Ms. D. and protect the door watchers and others named in the secretive report. Who orchestrated this cover-up and protected the guilty?

I heard that Mayor Mickey Cherepko was going to ask for more RAD funds so he could place Love Shacks in each McKeesport school building to guarantee privacy for all McKeesport teachers in the future. The Union president is also behind this proposal.

All four were wrong. All four needed to be fired. Two of them were truthful, at least. Two of them became the prince and princess of McKeesport. They destroyed their families, embarrased their spouses, but since they are now married with children, it's like their past never happened. They have a lot of skeletons in the closet. They were too forward with too many people. I was among a group of them. Lots of pics and texts going around those days. They may think they are untouchable now, but their past WILL be back to haunt them. Stay tuned...

They were not fired because the MASD school board, MASD administration, teachers' union, the Chair of the MDC, and the thief late Dr. Risha covered it up.

Brewster was grooming the Watcher for a higher political office and he succeeded.

The school district should be compelled to release the confidential report on the complete scandal. There are a lot of well connected school employees that got away with some inappropriate conduct.

I believe the Trib got a boot leg copy of the secret report. They should publish it verbatim to enlighten the public. They know who the peeper and his mistress are.

You may be on to something. This will haunt them for long time. However, I think that public is placing too much blame and guilt on the culprits that participated in all these MASD sex episodes.

It was the Chair of the MDC that orchestrated and implemented made the cover up. And, now he is laughing at everyone for pulling off the biggest scam on the Port with everyone's eyes wide shut.

The MDC Chair was seen many time with the late Dr. Risha and they broke bread together to spawn the cover up scheme.

Sex between teachers in Pennsylvania’s public school classrooms is officially frowned on by the state, but former teacher Angela DiBattista had her firing for the offense overturned in Commonwealth Court Tuesday.

The court ruled DiBattista had “implied immunity” when she rolled over on her partner and fellow teacher Patrick Collins, and admitted the repeated trysts in a 2005 disciplinary hearing. Ultimately, Collins was given early retirement, while DiBattista was suspended and eventually fired.

Collins and DiBattista had sexual relations in their McKeesport classroom for several years prior to the liaisons being brought to light after Collins was accused of physically abusing the woman, according to court testimony. Collins said there were never any students in the classroom when the two were engaged in sexual activities.

The district’s lawyer told the Associated Press the ruling by the court was unexpected and he did not know if it would be appealed. He said DiBattista will be eligible for eight years of back pay and reinstatement in the school district if the ruling stands.

DiBattista’s lawyer said she had been working outside the educational field since her dismissal, but that she wants to teach again.“I think at this point, she would be happy to teach anywhere, including the McKeesport Area School District,” Phillip Fabiano said. Battista was an elementary school teacher.

A spokesman for the state Department of Education said there are no records kept in the department for the number of public school teachers fired each year “for cause.”
