Sandusky appeals forfeiture of $59,000 pension

HARRISBURG, Pa.– Jerry Sandusky has appealed a decision to revoke his $59,000-a-year pension, arguing the law did not support the action by the Pennsylvania State Employees' Retirement System.

Sandusky attorney Charles Benjamin's five-page letter to the system's board, dated Nov. 21, was obtained Wednesday by The Associated Press through the state Right-to-Know Law.

Benjamin wrote that Sandusky's pension rights became vested in 1969 and were not changed by later amendments to state law. He argued that Sandusky, a Penn State assistant football coach who retired in 1999, was not a university employee when tougher forfeiture rules were passed in 2004.

"We trust that SERS, upon further reflection, will agree that no legal basis exists for forfeiture of Mr. Sandusky's vested retirement benefits," Benjamin wrote. He did not return messages seeking comment.

The retirement system yanked Sandusky's pension after he was sentenced in October to 30 to 60 years in state prison for sexual abuse of 10 boys.
The retirement system said Sandusky's convictions for involuntary deviate sexual intercourse and indecent assault triggered forfeiture provisions of the state's Public Employee Pension Forfeiture Act. The law, first passed in 1978, was amended in 2004 so that it applies to any public school employee convicted of a sex crime against a student.

Benjamin said the pension board's argument that Sandusky was a "de facto" employee of Penn State in later years was "illogical and untrue."
He said many of the payments made by the university to Sandusky after 2004 were smaller speaking fees and that tax records indicate Sandusky described himself after retirement either as self-employed or as a consultant to the charity for children he founded, The Second Mile.

"At no time after Mr. Sandusky's June 30, 1999, retirement did SERS cause the retirement benefits he was receiving to cease," Benjamin noted. "Had Mr. Sandusky returned to active service at Penn State for regular remuneration as a school employee, SERS would have caused his retirement benefits to cease."
Sandusky collected a $148,000 lump sum upon his retirement in 1999, and by September 2012 had received about $900,000 in pension payments.

Benjamin told the retirement board that if it does not reconsider the decision, he wants an administrative hearing.
The pension forfeiture also applies to Sandusky's wife, who would otherwise be eligible for survivor's benefits if he dies before she does.

We have been good business persons all year. We paid all our taxes on slot machine revenues. St. Nick please deliver six Cherry Master slots to our establishments ASAP.

The ones we had just disappeared from our establishments today. I think they were victims of wealth redistribution by the government. The smashed pieces were shared with the needy for disposal at local salvage yards.

The City public works department had another good week. There was no snow or ice storms to combat.

And, all was tranquil at city hall this week. The bully stayed in his cave cage all week.

The public works department can now prepare for the next unexpected storm.

Yes the MACM Chairman did have something to do with forcing Mr. Rost on to administrative leave. He was ordered to do so to open up the highest paying job for the senator's relative.

What is wrong with this administration? They fire the beetle and MACM top gun and both know where the entire closet skeleton population resides and all the skeletons’' off springs.

Talk about handing the prosecutors friendly, knowledgable, and expert wittiness’s. Wow this is too dumb and foolish!

Yeah, the senator ousted the qualified for the unqualified. Some lost money on those gaming machine raids. Which places were raided? Illegal gaming machines brought negativity to the city.

Firing qualified workers for relatives is negative for the family of the ousted workers! I think these illegal gaming machine raids could be requested about. Someone should file for all kinds on information with the Pennsylvania Rights To Know website. Ray used it and is on file, as all McKeesport request with follow ups, appeals are.

You should go on the site asking for all kinds of information! Anyone can make the request, read the website FAQ.

The way you frame and portray it seems much more than dumb and foolish it is approaches inexplicable self incrimination.

It seems like some narcissistic actors want to self-punish themselves by cultivating witnesses friendly for the prosecution.

However, I do not think this is a concern because in spite of street rumors I doubt the city or any person is the target of any authority’s attention. The City, MHA, and MACM are efficient and law abiding operations that we should all “respect” and have “pride” in.

The web of deceit and corruption never seems to end. I wonder if the federal agents should be interested in the MASD construction management contracts over the years and if Imbrogno did any business with MHA.

It seems like MASD (inside) contracts were a lot more $$$$ than what they are looking into with the Pittsburgh Police Department’s dubious contract.

Don't forget the MHA loaded contracts & contractor mis-use of labor & material. Not all of them kept their dealings private . Work done off site with materials & labor paid for the state - which means us TAXPAYERS.

My favorite is the one when a contractor installing sidewalks complained to the Authority that the derelict breeders were destroying freshly finished sidewalks & he was told,''Don't say anything , just re-do them , the more we spend this year - the more they give us next year'. Typical McK Dems with the same mentality as the career welfare breeders. All the same.

The MHA is federally funded. If what you allege is true, then you should be contacting the federal authorities at Carlson Street, that is FBI Pittsburgh. You must have evidence or witnesses of such misdoings or names of witnesses.

Your timing may be very appropriate if the street rumors are true that the MHA may have had some dealings with the paint firm related to the recently federally convicted Mr. Ralph Imbrogno, former Clairton Business Manager.

Go for it rather than venting your displeasures and knowledge on Topix. We commend you for your information and posting and hope you contact FBI Pittsburgh. Someone has to help to slow down this constant raping of our tax dollars.
