Judge reduces charges against teens accused of attacking gay classmate

There are 98 comments on the www.kentucky.com story from Apr 30, 2010, titled Judge reduces charges against teens accused of attacking gay classmate. In it, www.kentucky.com reports that:

A gay Jackson County teen testified three classmates threatened to push her off a cliff and crush her head with a large rock, but a judge ruled there was not enough evidence for felony charges against the three.

After a hearing Thursday, District Judge Henria Bailey-Lewis reduced the charges against Ashley Sams and Corinne Schwab to fourth-degree assault and menacing, both misdemeanors.

It may have happened just as she said, but has no evidence to prove it. It's just the way the law works.

You guys are clueless, truly. The q ueer girls mother reported this crap 3 days after it happened. If the girl was so scared she never would have waited to tell, and surely would not have went to school where she knew they wold be to in the days aftet they "tried to kill her". Her mom found the video they made and started flipping out or seeing dollar signs. They are the criminals in this case, and when this is all over the charges are dropped, and chrges are filed against the girl and mom I will be laughing and saying ?I told you so!

Lorrie, Dont pay any attention to these morons. They dont know anything about jackson county or the case. Its easy to sit back and judge. We jackson countians need to stick together and stop hurting each other.

Why would anyone make up a crime and report it? Who the hell knows but it certainly happens, a lot.

I'm not say she did or didn't but it's mighty strange further proof such as the cell phone movie wasn't presented. We shall see.

The media has looked at the video and says they think the whole thing was staged. It was a prank and the "victim" was in on it.

I am for gay rights, but people like this young girl only hurt, not help when they cry wolf.

Whether she made it up or not I don't think verbal threats are felonies (unless directed at certain government officials, such as the Pretzeldent.)

I wouldn't be surprised if she or her family's property become targets after this matter, though.

According to the article, she somehow managed to video at least some of what was happening, but apparently not even that did much to bolster her claims, at least according to the Judge. This may turn out to be the first test of the federal hate crimes law, at least the investigative portion of it. Given the steep downgrade in the charges, from attempted murder and kidnapping to minor league assault and menacing, the feds are going to be hard pressed to not at least do some looking into the facts.
