Reckless Homicide Charges Against Bushart

Yesterday's Messenger had an article which indicated that Graves County Circuit Judge Tim Stark dismissed the reckless homicide charges against Michael Bushart. Stark indicated that he did that because a new law presumes the shooting was in self defense.
Based upon Stark's past actions, I was shocked that he would dismiss a case without it going to trial.It is good to see him take this stand. After all a Judge is suppose to be more than a conductor of the legal train.
With our legal system a case with very little merit can be forwarded to the Grand Jury. How many indictments were turned down by the Graves County Grand Jury in the past five years? They act as almost a rubber stamp for the prosecutors. Well Done! Judge Stark

Yep, and I seriously think the girlfriend pretty much set that murder in motion!!! She should be charged also. Clapp was shot in the back how is that self defense??? Especially when there are proven text msgs between the girlfriend and Clapp and she told him to come get his stuff??? Small town politics....

Our judical system in Mayfield/Graves County is a joke!!! Not only has Bushart murdered someone but he has also been in trouble his whole life. For those that think justic was served hope you don't meet him on the road while he is drugged up (which is all the time). He will kill again it maybe in a different manner. I wish people would stop saying Clapp broke in he lived in the home for 2yrs except for 2weeks prior and paid all the bills for Boyd. Boyd and Bushart conspired to commit murder they did it and got away with it. I guess all you have to do is invite someone to your home that you don't like tell them the doors unlocked or where the key is and shot them (be sure to say self defense) because you will get away with murder in GRAVES COUNTY. What an example we are setting for our children who will and have heard all about this story!

Charges should be brought against them both. The shot that killed him was in the back. If I ever decide to kill anyone I will text them meet me in Graves County. So sorry for Clapp Family.

could not have said it better myself!!! I know both of the boys, and clapp had a lot of issues also, but our legal system really failed on this case!! Just a lil money in this town goes a LONG way to keep you out of trouble in this town

Someone please explain this to me. How can you be shot in the BACK and call it self-defense. Maybe I have watched to much t.v. But,I thought that was an automatic GUILTY. I hate it for the friends and family. His son, his mother. We can just post a comment on this page and go on but it will affect them forever. Death is bad enough but like this is horrible. Please pray for the Clapp family.

Its called the "castle doctrine"...look it up and maybe you will understand this a little better. He had the LEGAL RIGHT to fire those shots, be it in his back, front, side, etc...It's the legal system doing what it is supposed to do and that is upholding the law

Thanks for clearing that up for me. Now will you help me pray for the CLAPP family for the rest of there lives!!!!

i have seen Judge Stark in court and you could not ask for a more honest man. He was only doing what the law says. We were not there so it is not fair to judge what really happen at that house. I am sure Judge Stark did what he thought was right and that is all you can ask for a person to do. You can not please all the people

I am glad you saw this side of Judge Stark. That's not what I have seen. Frankly, I am suprised that he dismissed the case even though it appears that the law required him to do so. He would normally just pass a case like this to the jury. That way he does not subject himself to any criticism.

I thought the crime was committed before the new law took effect, if so my understanding is that law would not have applied to his case and he should have been found guilty. Either way everyone involved in this case needs prayers. Bushart included...he has lived a life of addiction, and he needs prayers to change and cope with what he has done, and his family too because they are good people and this is their family. Mostly the Clapps, Micheal's son Jake really has been hurt by the loss of his dad and Jake is a good kid. Pray that God will comfort him, because Bushart not being charged for this has to be very hard on him. Pray that God will give Jake and Micheals other kids someone to lead them in the right direction.

Stark may be a honest man,but that does not make him a competent judge. He had almost no criminal experience going into the job. So what do you expect? He is a member of the Republican party, and was appointed by a Republican govenor.

For those that don't know....Jacquline Boyd is Tina Connors sister. Tina Connor was Gov.Paul Patton's mistress.

Wasn't there another shooting a few years ago, in Wingo area, under the same circumstances with same outcome?

Well Jacquline Boyds house just happen to burn down after the shooting which was not an accident! They all knjow how to cover their steps!

I will always believe she burned it to cover up the evidence or someone in clapps famiy possibly did it to get even....either way she should be in jail...I believe she is 90% responsible for it happening to begin with. They have records proving she text Clapp trying to get him to come over, and if I was guessing at that time of day Bushart was stoned and would have believed anything he was told. He stayed stoned all the time anyway.
