Code Enforcement, Cronyism, Yard-Sale Tyranny, Missing Murals and Budget Matters

Code Enforcement
I have noticed a continuous patrol of code enforcement officers, sometimes two officers to a car, and often wondered what code enforcement situation would require two “codies” to respond to it and why are we paying for this. As a business man, I have to question the purpose of such an expenditure. Do we write thousands of dollars in violations at night? So, at the village meeting, I asked that question to the mayor who couldn’t give me a response which is odd because he is the Commissioner of Code Enforcement. The village attorney offered an explanation that some of the female officers were intimidated by some of our residents (as am I) but I always see the female officers alone and it’s the men that are doubled up. Quite honestly, that was a “lame-o” response.

The village meeting is required by law to have the head Code Enforcement Officer present a code report detailing the amount of violations and the activities of his department monthly. I did ask for this report to be started and hopefully by the May meeting it will. But in the meantime, I’ll present a code enforcement report to you so you can judge for yourself.

The purpose of code enforcement is to issue tickets for violations against the village code, period. They should not be used as a “faux” police force pretending to patrol the neighborhood and giving a false sense of security to the residents. They have no authority to stop and detain anyone or make you identify yourself and have no training to do such. We are paying for a very expensive neighborhood watch that will inevitably result in an injury to an officer or resident or much worse like what has happened in Florida with the Trayvon Martin/Zimmerman case.
The budget presents a code enforcement salary appropriation of over $240,000. That doesn’t include fuel which for the sake of this example we’ll estimate at one tank (20 gal.@$4/gal) per car per shift with two cars per shift x two shifts comes to app. 80 gals or $300/day in fuel x 362 days =$108,600. There is also vehicular maintenance and insurance, which I could only guess at but the point is to show how expensive these patrols are and do they generate the revenue or the security results to justify them?
Consider that in the 2012-13 budget there is only $50,000 in revenues anticipated to be generated by code enforcement. This is not enough revenue to justify the employment of 15 officers and double shifts day and night let alone fund the court system necessary to process the violations.
Let’s consider another aspect of this department. During the election, we were told that Code Enforcement issued 1,330 violations in a six month period. OK, let’s break this statistic down. Divided by the six months it comes out to 220 violations issued per month or 7.3 per day over two shifts which brings the total to about 4 violations per 8 hour shift. Does this seem like viable productivity to justify keeping 15 officers employed operating with two cars per shift and sometimes two men per car? I don’t think so.
I totally disagree with the concept of paying for patrols that lack the authority and training to do police work or that I will be protected by them from any danger real or imagined. What do you think?

Cronyism
Cronyism is defined as partiality shown to long standing friends by awarding favors or positions to them regardless of their qualifications or the value of their service. I’m pleased to say that a form of what I consider to be cronyism has been cut short. Sources have told me, two months ago, that our village process server and accused racist/anti-semite/homophobe, Mr. Victor Zeleny, had been paid to deliver code enforcement violations at $30/item rather than send them out by registered mail for $8 or have the Code Enforcement Officer deliver it free. So, under the Freedom of Info. Act I requested all monies paid to him as well as an itemized accounting of the invoices. It seems that over a period of time, from the end of October until the beginning of January, Mr. Zeleny received 160+ summons to serve for a total of $4955 much of which was unnecessary in my opinion.

I received the invoice numbers but not the detail of the invoices however the high amount of work given to him in such a compressed time frame indicates my source was correct and I am told that this practice has stopped. But that is not enough. There are enough citizens in this town who are outraged at Mr. Zeleny’s actions and do not want any of their tax dollar spent with this individual or any agent of his business; “Attorney’s Choice Process Server”. I received an affidavit from a reader documenting the racist remarks made to him at his house by Mr. Zeleny while Mr. Zeleny was campaigning for Bob Morrow. If you have had a similar experience then write it down or print it out and bring it to your bank to be notarized and get it to me. We will then present these to the Board of Trustees and request a cessation of any services contracted by the village to this individual.

On another note, I found it interesting that Trustee Bissonette abstained from approving two appointments worth $75,000/year because there was no submitted resume or job narrative. One was Tim Brojer appointed as the Village Administrator and another was Chuck Southard as the Village Engineer. Mr. Southard is a licensed architect but not a licensed engineer and was appointed interim Architect/Engineer of the village last August. He was also a lead member of the Zoning Commission debacle. But still, a resume should be available along with a job narrative. At this time I don’t know if those jobs were even posted in the paper. So two jobs worth $150,000 were assigned to individuals who may or may not be qualified and quite honestly, the taxpaying public has a right to know an employee’s qualifications before a dime in salary is paid. That’s reasonable isn’t it?

Yard Sale Tyranny
Well, in addition to the village ban on roller skating and skateboards we now have a very restrictive policy on yard sales. Let’s start at the beginning. My personal view is that yard sales should be permitted but heavy fines should be levied against anyone hanging a sign on a telephone pole or running a business out of their yard disguised as a yard sale.

The new code allows you to have four yard sales; one in the spring, two in the summer and one in the fall and you must get a permit. Fine, no problem with that. I do have a problem with the yard sale being restricted to your backyard (yes, no more front yard) and the Code Enforcement Dept. inspecting your grounds before a permit is issued (Sieg Hiel!). Really, I’m not kidding. Before you get a yard sale permit the “brown shirts” have to inspect your property. Seeing as how the code enforcement is not allowed on your property to begin with, this is an egregious misuse of power as well as a violation of your civil rights and it is embarrassing that I even have to tell you this.

All this nonsense stems from the “bait and switch” tactics pulled on us by the original board back in December of 2010. You see, we were originally told we were going to keep Brookhaven’s code but enforce it more thoroughly. But after the first election, your elected officials deemed it more appropriate to adopt Patchogue’s more stringent and restrictive code which I believe some of our Trustees have not familiarized themselves with to this day.

Missing Murals
The Village of Mastic Beach received a $5,000 grant originally given to the Mastic Peninsula Historical Society by Suffolk County that was later transferred to the village by the board of said historical society. The purpose of the grant was to encourage tourism. The idea from our own village historical society was to use the money to paint murals on some of our buildings showcasing the art work at the Floyd Estate.

But members of our local historical committee at that time inform me that Mr. Stiriz showed up at a committee meeting and announced that there were not going to be any murals but that instead we were going to have 2’ x 4’ signs painted and placed along Neighborhood Rd. for a “walking tour”. Fine. Mr. Stiriz unilaterally made the decision to commit the village to all costs of maintenance and installation of these signs. Then, according to sources, he again made another decision to change the dimensions of the signs from 2 x 4 to 4 x 8 full sheets of masonite or “masonite-like” material. The signs were painted but no one figured out that the material the signs were painted on would not be weatherproof. So now I am told we need to make waterproof enclosures for the signs. I am told the artist that was hired did a very nice job painting the signs and we should be allowed the viewing pleasure of her work. So where are the signs? Story Developing………..

Budget Matters
On Monday, April 16th at 6pm there will be a meeting on the proposed budget at the Brookhaven Senior Nutrition Center located at 369 Neighborhood Rd. I strongly encourage you to make the time to attend this meeting. Download the tentative budget. Please review it. I will tell you that the final budget that will be presented Monday night will not be like the “watered down’ version of the tentative budget but at least you can get an idea of salaries, dept. expenses etc. Hope to see you there. Make sure you attend!

P.S. The street sweeping you may have noticed last week was paid for and compliments of the Town of Brookhaven’s post winter clean-up. Thanks TOB.

Final Musings: Do you remember when the “battle cry” to form the village was to reduce sex offenders (0 to date), reduce section 8 (0 to date) and reduce slumlords (0 to date)? Well I do. But here is the “rub”; There are an estimated 1,500+ rentals in Mastic Beach which account for 27%- 35% of our residency and the landlords pay the village $350/year for what will eventually be the largest chunk of revenue generated for the village. Building and rental permit revenues are already estimated at $200,000 for next year in the budget (the largest single source of revenue for the village). Rental permits will become the new “GOLDEN IDOL” of the village and will end up being not reduced but revered. Mark my words.

I'm sure he didn't read it at all. They just see the name Bruce Summa and start seeing red in their eyes. It's easier to blast him as a nut then to actually read what he has written and realize that he's SPOT ON with his analysis. Whatever is right! And we all know you are not Mr. C.
