A federal civil rights lawsuit will be filed this Summer against the Martin Police and Weakley County Sheriffs Dept for conducting numerous illegal searchs without obtaining proper search warrants in addition to other civil rights violations. A large law firm in Memphis is preparing the lawsuit. In a few weeks I will post more information. If you have been the target of an illegal search by the Martin Police or the Weakley County Sheriffs Dept in the past 12 months then keep posted to this topic for more information as you may be able to piggyback onto this lawsuit and receive damages if the suit is successful. In a few weeks I will post the name of the law firm in Memphis to contact.

It said they would post the name of the law firm in a few weeks. I was a police officer for a few years in the 70's and went through a lawsuit deposition once and it was hell even though I was not the subject of the lawsuit. Its called discovery. Thats where the plaintiffs atty asks all kinds of questions and you have to answer them. Its not a courtroom. Its before the whole thing gets to court. They drag in ex wives and generally just do anything they can to trip you up. If they catch you in one lie you're cooked. You people may find it difficult to believe but we were even trained on how to lie in court but a deposition is ten times worse than a courtroom. Lawsuits are one of the reasons I changed careers.

If you're innocent of any wrong doings then by all means file a suit. If you're guilty as hell, then shut up. Probable cause and exigent circumstances are grounds for searches. If it's out in the open, they don't need a warrant. Ever heard of the saying "On a clear day, you can seize forever"?? If you don't want to get caught, hide your shit better.

Very few attorneys take on civil rights lawsuits without overwhelming amounts of airtight evidence.

I find it disheartening that WarriorJudge (his name reveals his psychotic bias doesnt it?) is ignorant and disdainful of the Bill of Rights or perhaps hates the fact that people in America still have rights. He obviously lives in a world of fascist wetdreams where the police do as they please and abuse as they see fit. Im an old man WarriorFudge; I've lived a long time and one thing I KNOW is this: If you wish bad on others and abuse other people it WILL come back on you. Its just a matter of time.

First off, I'm not a he. Second, I'm a firm believer in the Bill of Rights and the Constitution. However, I am sick and tired of those that are guilty whining and complaining. For those that are innocent and have been wronged, they have an even harder time getting the courts to take them seriously because of the guilty ones clogging the system. Are there bad cops, yes. But there are also honest cops. For everyone that complains about the cops, you very rarely see people praising them. But if a person is guilty of a crime, it's their fault, not the cops. Nobody wants to be held accountable for their own wrong doings. If you don't want to go to jail, stop breaking the law, it's that simple.

T Parker, I think you are just trying to stir up a bunch of bullshit. Don't threaten it just give up the law firm and the lawsuits they will never win. Let me remember my constitutional law classes and criminal procedure. The police get their probable cause, draw up the search warrant, get the judge to sign it, execute the warrant, return of service on the warrant back to the signing judge, and the criminals go to court. Sounds pretty airtight to me. On another note if the police see evidence of a crime, contraband, or narcotics in plain view there is no need for a warrant.
What we have here is a bunch of worthless crackheads, methheads, and low life people clogging up our court system with frivolous lawsuits that will go no where and tie up law enforcement agencies with bullshit depositions, hearings, and legal fees when there are actual persons out there with legitimate grounds for lawsuits. Just thinking out loud T Parker. I hope you get stuck with the legal bills when the cops win or get the frivolous suits dismissed.

This is all a total lie. U can all just ignore this post and kill it. People get on here all the time and get stuff started just for kicks. The police do get warrants for their searches. Also, if you think about it, it is the drug task force who get the searches together and get the local departments to help with them. People need to at least sound like they know what they are talking about before getting on here to make up stuff- LMAO!!!!!

If you want people to believe your statement then it is best say what law firm is preparing the lawsuit. It is also a good idea to proved proof of where you got this information.
In almost all instances, a search warrant is required for the police to enter a private dwelling. In most other instances when a search warrant is not required, the officer must have probable cause. However, there are exceptions to the rule.

If an officer has probable cause (more than a reasonable belief that a crime has been committed), and he cannot take the time to obtain a warrant without loosing evidence or the suspect, then he may enter and search and seize without a warrant.
If contraband, paraphernalia, a weapon, or some other piece of evidence or if criminal activity is "in plain view", an exception to consent arises under the law. That type of voluntary exposure allows the police to view the article without a search. Since a search is not needed to view something "in plain view", then there is no violation of a person's reasonable expectation to privacy. To put it another way, the law assumes that if the person intended that which was "in plain view" to be kept private, then he or she would not have placed it in a position where it could be easily viewed by anyone.
Police are not responsible for advising you of your rights to refuse an illegal search. They are not required to tell you if and when they can make a permissible search. Police need not tell you that you can withhold permission for them to enter your home, nor that police have a right to seize anything in plain view.

I have read a few of your post and I do not know where you are from and nor do I care but what I can say is that you are VERY prejudice and with a last name that you are using I would not throw any stones and that soon it will be your race that will be looked down upon, or may already been frowned upon. You all can not judge people by their race and smile in their face once you finish your posts. Stay true to thyself and remain just not for one race but for all.

I see you are putting your rants on here about racism too. I checked the other forum on Mandatory Drug Testing and I have checked this one. I.ve alway's found the Martin police that I.ve dealt with to be ok.But they searched my daughters car and tore the glove box completely off.They said they saw her purchase illegal drugs.they found nothing and had no warant.

I too have had dealings with the Martin Police Department, and have found them to be inept, incompetent, and inconsistent. The police chief is very arrogant, dispensing his opinions as if they were laws, while al the while ignoring actual laws.

The police chief and his other supervisors think they are above the law. The enforce opinions on those they hate or dislike and not protect those who are hurt with laws. Too much personal stuff there.
