SOURCE: FOIA request city of marion and/or williamson county / lease agreement between city of marion and williamson county events commission - and original "BANK" agreements filed with county (3 documents filed aug 04, 2003 PRIOR to city lease).
Robert Butler and Robert Toupal both signed the city's missing lease document referred to by county tax assessor, jeff robinson, in saturday's southern.
The lease agreement related to the pavilion, according to the document, was made effective on Dec 27, 2004.
Even though, Robert Toupal's name, representing the events commission, was also found as signature of three documents which were signed AND FILED with the county, months ahead of the city's lease.
Those documents, filed in the county clerk's office on aug 03, 2003, promise a pavilion with a FREE AND CLEAR TITLE and the acknowledgment that the commission IS subject to real estate taxes - However, to avoid real estate taxes, Toupal and Butler's name appear on the city's lease AFTER the original set of agreements (which say supersede all others).
The following information is printed from the third paragraph from the front page of the city's lease.
This third paragraph explains how a LEASE AGREEMENT becomes a document as only the means in which to,..."eliminate any further real estate taxation of the pavilion and all improvements for which neither the lessee nor the pavilion were able to generate sufficient income to pay..."
THIRD PARAGRAPH (all one sentence - good luck):
"WHEREAS, Lessee WAS previously the owner of the premisis (pavilion), constructed the pavilion (actually the debt is in the name of the tourism bureau NOT commission) WITH THE ASSISTANCE OF THE CITY, incurred substantial indebtedness to finance the construction of the pavilion for which lessee is still indebted (its the tourism bureau - different company - same people), mortgaged the premisis to partially secure the indebtedness incurred by lessee to construct the pavilion, and has conveyed the premisis to lessor simultaneously with the execution of this lease subject to all mortgages and other liens against the premisis to eliminate any further real estate taxation of the pavilion and all improvements for which neither the lessee nor the pavilion were able to generate sufficient income to pay..."
No wonder jeff robinson said he knew nothing of this lease. Interesting, there are two page 2's - and on page 4,(7.1 Taxes, utilities and additional services) it reads: LESSEE shall promptly pay to the appropriate taxing authorities, when same become due, ALL REAL ESTATE TAXES with respect to the premisis for ANY taxes assessed against the premisis for ANY PERIOD before or after the term of this lease."

The AG's filing on the Pavilion shows this;
Williamson Co Bed Tax-------$373.228.00
interest on savings----------8539.00
Rental Fees & Deposits------$114.546.00
And they say they dont generate sufficient income to pay real estate tax's, I wonder how they are paying the salaries of the workers....BULL. Also whats up with this Bed Tax, they will come up with a way to tax everything they can dont they !

If more folks visit the AGs web site and discover for themselves that the year the pavilion was given by QUIT CLAIM DEED to hide the commission's real estate taxes - according to those documents at madigan's web site, the CHARITY, the events commission also gave the city $1.1M - had five cd's of $100K each - claimed more than $600K in cash - AND even though the city claims the building et al - these documents (signed by bruce troutman) show the commission claiming the building plus tens of thousands of dollars in depreciation.
The tax bill was around $136,000 which commissioner ellis said on tv, "went away."
The taxpayers have been left holding the bag on the pavilion to the tune of more than $10 million by the time the aaa Moody PUBLIC bonds mature in 2032. You can thank the 20 or so board members for this fraud - along with Butler, troutman and many other elected officials and business leaders. Their collective ego is on display in the lobby of the pavilion, because the bank demanded a bronze placque naming everyone --- who by the way are the names we as taxpayers SHOULD BE SENDING THE BILL TO!
A CHARITY! Really!
Visit the tourism bureau's web site to see the names of the folks hiding behind the city's tax free fraud scheme. Ask them if they feel any shame for cheating us and the school kids - ask if they feel shame for calling themselves a CHARITY!

Be careful about letting folks know of your web site - the last one, marion exposed dot c o m was taken down admittedly by the MARION CITY ATTORNEY, STEVE GREEN.
Like your site, marion exposed posted not only proof of the pavilion fraud and conspiracy and names of those involved (according to their filed documents)- but also offered insight into the out of control TIF scheme, which has milked literally millions of dollars AWAY from the tax payers and into influential friends and associates of those involved.
Green himself made calls announcing, "he was the city attorney - and that HE had the site taken down."
The attorney's words resonate - first amendment or not.
Way to go Steve Green. Once the news and truth was out, Green, acting as marion's mayor, re-wrote the first amendment in his attempt to protect his client and friends.
Here's another site stevie - one which disseminates public records. You better run by the court house, borrow your buddy's cape (you'll find your cape under the desk), and take down another bad web site which exposes your client's fraudulent ways.

My site isnt going any where, all things posted are and will be public record, I will look at the facts and it wont be rumors or hear say that I post. There would have to be a court order for me to shut the site down, I know Steve Green, he him self telling me to shut it down wont work.
We the people of Marion need and want a place to speak out, we need a informational site, my goal is to let people know whats going on in Marion.

Doesn't matter how, why or when. Bottom line is that if it meets the IRS code for Non-profit then it is. You may not like it but perfectly legal.

Sure... Perfectly legal until someone asks... OR unless (or until) FRAUD and CONSPIRACY proves otherwise. The city was told once before they don't own the pavilion. They actually gave away 5.5 acres of the pavilion's land to an organization wishing to find a home for their new facility. A week later, quietly, during the next city council meeting, the city was forced to take the land back - because the land they claimed to own (and gave away) was encumbered in the ORIGINAL DEAL's Mortgage or aaa Moody PUBLIC bonds - naming the TOURISM BUREAU -NOT- COMMISSION as debtor.
Can you give away your property and leave the debt behind?
Perhaps you can. They did. But, sooner or later, especially if you survive by tax dollars and NEVER acknowledge the open meetings act, you'll do something or say something which causes the scheme to fly out of control - say for example if your buddy the mayor whips up a lease the county says they know nothing about, which is a lease that somehow the mayor has the ability to "eliminate real estate taxes." Really?
The lease, which the county knows nothing about, which says the events commission MUST pay their real estate taxes. INCLUDING the $136,000 which was assessed - which commissioner Ellis said on tv, "went away?!"

You say its perfectly legal?
Do you work for the tourism bureau? The CHARITY, the williamson county events commission corporation?
SINCE in 2003, the commission entered into contracts with the bank, with language stating its importance, FIRST, in front of all other contracts - AND - MUST MAINTAIN free and clear title on premises... "Warrants that the commission will remain ABSOLUTE OWNER of pavilion."
And that signs contracts which ALSO say the commission MUST pay their real estate taxes...
HOW CAN THEY enter into a contract. A year or so later with the city in the first place? Let alone give everything away?!
Ask the bank listed on the bonds - the LeSalle Bank, "who owns the pavilion.?" That bank's documentation show the events commission AND pavilion as a PROJECT of the TOURISM BUREAU!
Millions of tax dollars - no one paying attention!
Perhaps it is time to file a writ to STOP THE BED TAX UNTIL A JUDGE CAN RULE ON THESE ISSUES.
Isn't there a local attorney who specializes in stopping taxes?
But then again, perhaps that may be a conflict of interest for him?

I know it seems that most of the Marion attorneys work with the city in some way, so it might be hard to get one to file something about those taxes. Its all a joke just as everything else they get their hands on, Any one heard of Doug bradley, they need to check him out about the ball park. The city paid 32 million dollars for strip land that it sits on and the marion residents got took again on that deal.
The point is there is alot going on in Marion and some how it all needs to be brought out so us as the tax payers can see whats really going on in Marion !
The bed tax, I never heard of it beofre all of this, that tax should be given to the school system, not to the tourism bureau for the pavilion, how they came up with that I dont know.
Just wondering but do you "By the way Indianapolis, IN" live in Marion or Indiana and you are from here ?

Of course there are different names and headers on these posts...
Yet they're the same... Same people, different posts.
Just like with the tourism bureau and events commission. Same people, different PRIVATE COMANAIES.
Only, I didn't swear an oath particular to the laws these folks have destroyed. Nor do I file false documents with the AG's office, like the treasurer has for FIVE YEARS NOW. The tourism bureau and events commission receive their total support from taxes in the name of tourism.
Or, bank roll a second company from public funds, tie them up in hundreds of thousands of dollars in CD's in ONE BANK - and then claim you have no money to pay your taxes.
Let alone, receive the (wink-wink, nudge-nudge) deal butler gave with the taxes BEFORE and AFTER the deal.
And, who cares where I live. I can say I lived in marion and know these things first hand. And I can say I moved from marion because it's really not the hub - and I know that as long as butler is there, the "squeaky" wheel isn't the only thing getting greased.

Butler has always said his door is open. Perhaps he'll take a call under the same "open" auspices...
Give the mayor a call, ask who owns the pavilion? Ask him who got the $1,350,000 the events commission gave to the city according to their financial documents. Ask him why a charity was done a favor, claiming to be broke, when their financial documents (signed by the county treasurer) clearly show they are not.
Mayor butler's direct line is listed in the book.
Offer to run a copy of the city's MISSING LEASE over to jeff robinson and saundra gent's office.
Better yet, why won't you run a copy over yourself, mayor? Perhaps that would clear up your point of view once and for all? You said that there have been "no mistakes regarding the pavilion."
If these weren't mistakes, that only leaves fraud.

Butlers time as mayor is running out on him anyways, his main man died(Dog Connel)and more and more of the old timers that kept voting for him is dying off also. After everything comes out on all of this we may be starting over with all new people in city hall,that might be soon, I hope !

Though the vision of a butler-free marion is a nice one. Bob, like many of these people who will be named in the pending investigation(s), for the most part, started off with the best intention(s).
Unfortunately, greed got the best of their over-inflated egos, and power, as is custom, brought on their corruption.
Just before dog died however, he attended one of his final city council meetings, naming the mayor's daughter in law, gail west, to the city administrator position - thus changing the form of government in marion- and setting in to place the reins which are to be handed to the mayor's daughter's significant other.
You see, the citizens got west much the same as we got the $10M boat anchor and tax debt, the pavilion.
No one voted on $3.7M worth of PUBLIC aaa Moody bonds when they met behind closed doors and pulled off the pavilion scam - and another favor was perpetrated by mayor butler when he appointed gail west, with ZERO experience to her post.
They may be dying, as you say - but, with things like the CWI contract, signed by the mayor without council consent or knowledge - more than a million dollars brought in to question - the landfill challenge with the mayor spending tens of thousands of dollars - the quarter of a million dollar fraud case over the hospital - the pavilion - the tif districts and squandered future funds, even when the old man perhaps only exists in bronze for the pigeons, we will have five decades of deceit and back room deals to suffer through and figure out.
One thing is for sure, bob has seen to that, too. The mayor has been around long enough that he will surely leave a memory-stain behind. You know, like when an image gets burned into a computer monitor - or like the brown scummy ring left behind in over-used coffee mugs and coffee pots - those ghosts and stains which no matter how much you scrub or what you use - won't go away -
And WHENEVER bob is FINALLY out of office, just such a stain will be running the city - left behind to discolor and smudge marion, just like her father-in-law wanted it.

Your so right, it would take along time to get over whats been done, but we do need to try and change some things though. For me I want to see more things open to the people , we need and should beable to know something about whats going on, not hide things. To much information is being held from the residents in Marion, I have all ways thought that and now see it more and more.
I as one person cant get anything done in Marion, but if many come together maybe we can make a difference and I know many would laugh about that. The problem is if most people sit around and just talk and complain , nothing will get done or change just as in our federal government.
I am retired now and have the time to check things out and try to do what I can and I am willing to do so. Right now I am learning where to search things out to get the information that I need to help me out. I have found out that Im not the only one that wants to try and change things here, I would like to reverse the home rule for a start in Marion, worse things that could have happened here or I should say it was another bad thing that took place and added to the change of the power in Marion.
Yes it maybe a waste of time and some may think someone is nuts and say you wont get any where trying to change things in Marion, but you dont know unless we as the people try !

You are not alone - once the law suits and other public record information flood the foundation built by butler and those in his inner circle, the results of their illegal actions will not only come to light. Local elected officials and others like mayor butler & bruce troutman will have to explain their part - but other folks - who have not been mentioned - YET - include at least three "bank" documents which were penned and signed by ranking state level state officials.
Some of THESE officials are ALREADY IN PRISON, linked to Blago.
One of these elected officials was an attorney in the private sector - and when HIS participation and explanation is made public, things will definitely change.
You're right though, if enough facts and documents outlining their deeds and back room deals surface - then those documents serve to expose those who chip away at the mayor's foundation of marion which we all know is placed on shaky ground - at best.
If people start asking questions from their mayor about his actions - perhaps we should weigh his actions against the warning from his peers, when butler was dis-barred.
When those judges judging him, used such damning phrases like that they doubt that mayor butler would EVER place the interests of his clients above the interests of his own.
That was when butler the lawyer who took advantage of his clients -
This is mayor butler now. Of whom we were warned. Of whom the citizens now, have become his client.
And, of whom butler has clearly - just like before - taken advantage of his client - the tax payers and citizens of marion, and williamson county.
It is clear to those of us who can read - and understand - the english language, by the continued and total mis-use of the open meetings act alone that butler has not learned his lesson - nor did we heed the warnings of those who stripped butler of his law license to keep him from causing further harm to his unsuspecting legal clients.
The butler before was sanctioned severely before, for screwing a few clients over.
That wasn't good enough for him.
The modern day butler didn't screw-over a few clients, he's screwed everyone in the county. From the youngest child who gets the next generation daughter-in-law, to everyone living in the county today.
