These "no knock" warrants ARE ILLEGAL, PERIOD. THESE VIOLATE THE 4TH AMENDMENT, "THE RIGHT TO BE SECURE IN YOUR PAPERS AND IN YOUR PERSON." A MAN'S HOME IS HIS CASTLE. Right is right, and wrong is wrong. Police KNOW THE LAW, AND THEY TAKE AN OATH OF OFFICE WHEN THEY ARE SWORN IN. THESE OFFICERS VIOLATED THEIR OATH, PERIOD. You don't break into someone's house, for if you do, you have put yourself at risk. If you want to enter someone's home, knock at the door and announce yourself. Apparently these cops screwed up, and they screwed up big. If someone broke in my house, I'd shoot the intruder. The intruder (regardless of who they are) is not paying my rent or utilities, and they don't have the right to break in.
You have the right to protect yourself and your property. Most folks will shoot an intruder these days; anyone can come to the door and say, "police." The police DO NOT HAVE THE RIGHT TO BREAK INTO SOMEONE'S HOME LIKE THIS; THESE OFFICERS NEED TO BE HELD ON MURDER CHARGES. THIS WOMAN'S HOUSE WAS WRONGFULLY BROKEN INTO (THE "NO KNOCK WARRANT" USED WAS ILLEGAL), AND SHE THOUGHT IT WAS AN INTRUDER BREAKING IN, SO SHE HAD HER FIREARM. I WOULD HAVE DONE THE SAME THING SHE HAD DONE. HAD I BEEN THE JUDGE ON THIS CASE, I'D HAVE THROWN THE BOOK AT ALL THE OFFICERS INVOLVED, AND THERE'D BE SOME COPS IN JAIL OVER THIS.
All the above should be categorized as "your opinion". That opinion is not supported by State or Federal case law. No-knock warrants are indeed legal-they are issued by a Judge-and supported by both Statute and applicable case law based on prior arguments.

It is not legal-it violates the 4th Amendment! The police have to obey the same laws we do, plus they take an oath when they are sworn in. They wrongfully killed this woman, and they need to pay.

Given that she was an elderly woman, and alone, I feel it was probably a natural reflex for her to grab a gun when someone unknown comes busting through the front door. Lots of us would have done the same thing. It probably took her an extra second or two to realize that it was the police. Obviously those extra seconds was too long for her to stop anxious deputies. It is a bad thing any way you look at it.

Your first sentence was the funniest. She was an elderly woman? Her reflexes were slow? Anxious deputies? What a laugh.

I want to tell every one of you idiots that I have known her for years. I have worked with her. I'm not going to get all dramatic like Howell Wade and make idiotic comments like "they blew her face off." What I will say is, her reflexes were not impaired. She was not feeble. She was very alert. I don't go by hearsay, I go by what I know.

Sorry, jackass, but I am not going to sit here and trash the LEO for doing their job. That is what they have done... their job. The deserve a medal of honor.
Let me ask you something, dipshit... if you were a law enforcement officer and someone pulled a gun on you, what would you do? Now lets hear your drug infested brain answer that question.
sheriff’s office maintained defective customs and policies under which said Defendant officers were led to believe that they were permitted to enter a home in search of a suspect or evidence without a warrant and without regard for the requirements of the Fourth Amendment.
38.
Said defective customs and policies were the moving force behind the violation
of Holli Gooch’s Fourth Amendment rights by officers who believed that they were empowered by Sheriff Millsap to enter her home without a warrant irrespective of the requirements of the Fourth Amendment, because they knew that they would not be disciplined if they entered the home without a warrant.
39.
Upon information and belief, Sheriff Millsap did not discipline or retrain any of
the individual Defendant officers who flagrantly violated Holli Gooch’s Fourth Amendment rights because the sheriff condoned said unconstitutional behavior since it was consistent with his policy.
40.
As the policy maker for the Bartow County sheriff’s office, Sheriff Millsap
was deliberately indifferent to the Fourth Amendment rights of Holli Gooch and other citizens of Bartow County when he implemented or condoned the customs and

after reading all these post, I have to believe Hammer woman two is either a Cop or a wanabe Cop or is a family member of these young inexperienced officers that made a Bad decision. I have served in Law enforcement for many years and have always believed No-Knock Warrants are reserved only for the Law Enforcers safety. IE a dangerous known felon who will engage the Police. Two officers serving a drug warrant on an 60+ year old woman does not fit this criteria. A Special task force serving a felony arrest warrant on a Known Violent offender is what this law was implemented for, not for LEO'S TO USE AT THEIR DESECRATION ! It's A 4TH AMENDMENT VIOLATION. This is supposed to be a Government of the people, By the people, for the people.

Many of the shootings that kill random victims happen in No Gun Zones. Laws do not stop criminals, they take guns where they want to. I have the right to protect myself and family! If you and I was in church and some guy came in and started shooting, would you want me to protect you as well?
