If the town knew the tree was diseased and didn't do anything - the town could be liable.

If the town's insurance carrier is CIRMA - get ready for the run around. CIRMA doesn't settle - no matter how reasonable the claim is. Call the CID and ask about this.

We had a tree limb fall on our car and the insurance called it an act of God. The city we lived in would not cover the damage. We actually had to use our homeowners insurance to have car repaired.

If they could send people out to cut the tree up AFTER it fell.Why didn"t they get the same people out to cut it down BEFORE it fell? Makes absolutely No sense to me.

As an insurance professional for over 26 years, I hope your prior complaint to the Town was in written form. I would also urge you to take photos of the tree so your home owners carrier can determine if it was diseased or not. An arborist would need to see photos of the inside of the tree and good luck. Dealing with a municipality on matters such as this are more often then not difficult. To the bloggers any time you have an issue with the state, town or a municipal entity always, always plcae them on timely, written, notarized and certified notice.

just wait until the homeowners file a claim with the town's insurance carrier - that is when the real games will begin.
