A man who was an employee at the Clare County Jail was fired recently. He was fired while on FMLA leave. He hurt his shoulder last year while at a training academy. He injured his shoulder and the doctors from the county put him off work. He received workmen's comp after having to fight to get it. When the doctors released him to go back to work he fell in his backyard and broke his tibia and fibia and crushed his ankle requiring major surgery. He was off since last November for this injury. He is considered "part time" so he had no benefits. During this time period he had to beg his boss for paper work in order to get cash assistance. They dragged their feet going so far as getting upset because this man came to his work and asked them to please turn the necessary paper work in. It took many months and this was one reason it did. Now he is released to return to work. He has been a good employee and missed very few days before these incidents. He has worked hard to get back to work since his family has no income coming in. His boss wanted to talk to him about his "schedule" so he was suppose to have a meeting. The first meeting was canceled. When this man attended the second meeting his boss fired him! He was told that he lied on his application about a previous shoulder injury. This is not true because he had surgery while he worked at a facility in Arizona and was returned to work without a problem. Then he changed his story saying that he was fired because he faked his shoulder injury at his job now. That is funny because it was the counties doctor that put him off work and the xrays proved that it was not from the previous injury and indeed his shoulder was injured. This is a man that made sergeant in Arizona at a state prison in under 2 years. He has been a good employee. I believe that they hired a replacement for him and now just have it in for this man and want him gone. Seeing that they changed their story as to why they fired him. This is a flagrant violation of the FMLA law. The law does state that an employer cannot retaliate against an employee for using their FMLA leave and an employee has to allow an employee to use it and this employee fell under the guide lines of the Act. Seems like they could be in some hot water over this.
