Served Summons and Complaint?I was served this afternoon with a summons and complaint by a creditor for a car that I was repo'ed in February of 2007.

My grandmother was the co-signer on the car for me.

The account was originally with Wells Fargo and then another company bought it and that is who is on the court documents.

I have tried to make arrangements with them on the past due balance which I KNOW that I owe. I'm not disputing that. However, I am unemployed ( autoworker ) and my grandmother is on social security. So her and I have both tried to make attempts with the company to try to come to an agreeable monthly payment. They want the same amt I was paying in my car payments. Well if I could afford that, the car would not have been repo'ed. They refused any offer I suggested for a monthly payment. They wanted 300 or more dollars a month.

Now they are suing me. I have no idea what I'm suppose to do since Ive never been sued before. Do I call an attorney about this? I know that I owe the money but I'm afraid if I dont answer the complaint that the default judgement will be entered against me and Im not sure what happens then. I know that they can not garnish my grandmothers social security. But I'd much rather come to some agreement about a monthly payment and maybe the court will back me up on a REASONABLE payment instead of the 300 or more a month they want.

I dont understand the paperwork though, only that I have 21 days to respond. So do I just call our family attorney tomorrow morning???
