May i ask if u are an attorney yourself? I really appreciate any help i can get on my situation. But here is a summary of my circumstance:
I am filing a civil claim against the county sheriff's department (under the Section 1983 of the Title 43 US Code) essentially due to an injury i sustained (torn rotator cuff that requires surgical correction) during transport from the courthouse to jail.
I was originally in court over a traffic violation. But I smarted off to a judge who then held me n contempt and sentenced me to jail time.
I am disabled. Have a paralyzed leg. Require a leg brace and crutches at all times. But when i was transported from the courthouse to the county jail, the officer taking me to the van took my assistive device (crutches) then when loading me into the van, he refused to seatbelt me (at my insistence), refused to allow me to unlock my leg brace for support to sit (at my insistence), and refused to place me between other ppl and NOT on the end of the bench seat (at my begging and pleading that my disability compromised my safety). I was nevertheless seated on the end with my leg brace locked n extension, cuffed behind my back, and shackled at my feet , and despite my best efforts, I was dumped into the fender well /floorboard on the very first turn the officer made out of the parking lot. As a result, my right rotator cuff was torn n the process and i had to remain in the floor the entire way to the jail (unable to move or adjust myself at all due to the shackles and paralysis of my leg).
Furthermore, they refused my requests for a nurse or any assistance throughout my sentence.
Basically, they showed indifference to my disability/condition, and their negligence directly caused significant injury to my rotator cuff.
That is the basis of my claim and I need an attorney in Cincinnati since this type of claim must be filed in Federal District Court there. I am from southern central Ohio. But i have been urged to seek counsel in Cincinnati.
