Can you explain what a "security interest" is in a bankruptcy case?My ex-husband left me when I was almost 6 months pregnant with our child. We divorced and I got child support. I have been using the child support and student loans to put myself through school as well as to raise our child. It is not enough and I might have to file bankruptcy. There is a debt collector who is bragging to my neighbors about taking all my stuff. He claims he is entitled to half of my possessions as his fee for forcing me into bankruptcy. I haven't checked my credit yet, but he claims to have two seperate judgments against me. One is for a gas card and the other is JC Penney. I paid faithfully on these cards for eight years and when gas prices went to four dollars per gallon a couple years ago, I was forced to pay for food and electricity with the money I normally spent on credit card debt. I am an Arkansas resident and have been for a couple of years. He has supposedly gotten a judgement against me in Louisiana. This is what he has told my neighbors. I would have went to court if I had known and worked something out. My question is this... Can he legally take all my pots and pans (stuff I did not buy with gas or department store cards and my daughter's Christmas gifts i.e. Nintendo dsi, etc.) or anything else I did not buy with the cards? Also, is there anything else I can do to defend myself other than hire an attorney because I obviously do not have the money for his/her fee. I looked on this site and found something about a security interest and I do not understand it...please explain if you have knowledge of what it is. Thank you in advance for your answer.
