I agree with you - there is a lot of information missing from this article.
No matter how one is hurt, or what training he has had or haven't had, when someone is hurt on the job the company is responsible for his care period. The restaurant needs to pay.

Change your policy for smoke breaks. If you must smoke then you must clock out for 30 minutes each time you need a smoke.
Yeah! Smokers rob companies every day. They also cheat their fellow employees by taking several breaks a day while the others have to pick up the slack. At my former job, we requested that smoke breaks be banned, or at least have the smoking area moved away from the back door so we would not have to walk through a cloud to get in the building in the mornings.(They would come in early & clock in, then sit outside for 15-20 minutes smoking and drinking coffee while the rest of us were getting ready for the day). Finally got to the point that th nonsmokers among us starting taking "smoke breaks" as well and would go into the break room to read a magazine or something for a few minutes.

How can you feel or measure that person's pain. How many days does it take for your twisted ankles to
heal? If the employee was hurt and needed time off
for it. Just accept it. I would hate to work for you because you are not sensitive to people being sick. You're just mad because the injured person got paid something. It didn't matter what the amount was whether it was $100.00 or $5,000.00. You're just
mad! GETOVER IT!!!!!!
I would be mad, too. Smokers already steal from companies every day by wasting company time. And I hurt my foot and had to work in another position on desk duty for a week while it healed. Moochers who milk the system P me off.

I would be curious as to the condition of the equipment and as to how well the owners maintain it and trained the personel, Coming from a service company that maintained and serviced Kitchen equimpment, There are many safety's and I have found owners change these to avoid what they feel are unnessary expenses to correct problems. I hope that was not the cause of this unfortunate incident.

<quoted text> MOST OF THE TIME THE MEDICAL BILLS ARE PAID FIRST AND THEN THE LAWYER GETS 1/3. OF COURSE HE INCLUDES THIS IN THE SETTLEMENT BEFORE THEY MAKE THERE AGREEMENT. EITHER WAY THE LAWYER WINS AND THE CLIENT GETS !!!!!. ACTUALY THEY GET 33&1/3%. AND YOU ARE WRIGHT THAT WILL HURT ALSO, BUT NOT AS BAD AS WHAT HAPPENED TO HIM.
I've already been thru this already. The lawyer gets 1/3 of the total lawsuit and then the doctors get their share and the victim gets whats left if any. I got 40,000 out of 150,000. The lawyer got 50,000 and the hospital took 60,000. My girlfriend got 22,000 out of 150,000, the lawyer took 50,000 and the doctor took 78,000. The victims always end up with the life of pain and the least amount of money. Then the victim will always end up paying for future medical costs later down the road. SC's victim lawsuit caps really suck. You can win larger claims but the business's will only close and all you will ever get is a piece of paper that say's you win the judgement but it will run out in 10 years and then you will have to file more papers to extend the judgement. By the way a judgement is hardly ever cashed in on and you end up paying all of your own medical bills.

Want some cheese with that whine? Bet you 'steal' from your company in other ways, i.e., gossiping about smokers, Desperate Housewives, hair, nails, etc., talking on the phone, talking too many bathroom breaks, etc.

Be happy to throw that rock at you. I don't spend my time at work gossiping, making peronal phone calls or otherwise wasting my time. I'd just go home if that were the case.
