What a sad story . I wish him the best and a speedy recovery. The article doesn't mention his dad , but maybe someone could start a medical fund for him . Worker's comp should pay . If the restaurant doesn't pay , people should not go there to eat and watch them go out of business .

Heck, you can't afford Worker's Comp from all of the dang lazy people taking advantage of it.

Maybe NEWS19 needs to get some quotes on WC to show how it works.

Take a business that does 200,000 a year in sales and has 3 employees and see what is left and how they could afford to put WC on them.

I hope this guy will be OK.

What a wonderful employer to work for. I bet everyone there is part-time except for a few managers.

I wish you well and hope you sue the &*%$&^&* out of these people.

God bless his heart. that will be there there to remind him the rest of his life. Tell all them bill collectors that workman comp claims cannot be filed as collections. take all copies of bills to his lawyer. lawyer should send letter to claims with contact information. last thing this family needs is to answer phone about bills they are not paying. ignorance is not a defense against negl. nobody said why the grill blew up on the young man.

I agree with you about that. If he was doing something stupid that caused his injuries, the restaurant shouldn't be held liable. However, if he was following procedure and this happened through no fault of his own, I hope he ends up owning the place. What a lame excuse on the business's part: "We didn't know we needed it on our part-time employees". If that were the case, noone would hire any full-timers, only a bunch of part-timers that don't get any benefits.

"In case you are wondering, state law does require business with four or more employees to have worker's comp insurance. The State Worker's Compensation Commission does have a program for employees of uninsured businesses to file claims for worker's comp. Many times the businesses will end up paying in the end.

The owners of Smokehouse tell News19 they were told that's what would happen in this case."

Oh, so let the taxpayers and the 'good' businesses pickup the tab for your ignorance/non-compliance with the law!

i think the law should be that ever place cover any body that work for them. it should cover ever body they are people to.

That would be fine and dandy except that the rates for the insurance cost and arm and a leg and small mom and pap places in town couldn't afford the premiums for the one's working a few hours a week. The system is corrupt and needs fixed...period.

I hope this gentlemen makes a full recovery and if the business is at fault, justice will prevail.

Workers Comp payments should be charged according to the risk of a job and the hours that an employee actually works. Example: a secretary job is low risk so the insurance should only cost 50 cent for every hour that is actually worked. for a construction worker: 2 dollars for every hour actually worked. I'm not saying these should be the exact amounts but the concept is there. Anybody that opens a business should be required to go thru a business class that instructs them on all the required laws and regulations on running a legal business. At least the restaurant did continue to try and help the employee, though it's not enough but its a start.

OMG, that is terrible,
most companies just have part time employees so they don't have to pay any benefits, vacation, etc. I think that the company should be responsible for all of his medical bills and lost wages.

Heres my take on it....
If the Smokehouse already knows they are going to have to pay, why don't they just go ahead and do the right thing? Seems like it would save a lot of time and trouble for all involved. Cases like this have the potential to shut a business down.

His attorney will see that he receives the benefits he is due. If the restaurant had 4 or more regular employees (which includes full time and part time) they were required by law to provide compensation for their employees. The Uninsured Employer's Fund will front the claim and will have to sue the restaurant to get their money back. This young man will have coverage very soon.

MY PRAYERS GO OUT TO THIS YOUNG MAN AND HIS FAMILY. I AM SURE THIS WAS JUST A HORRIABLE ACCIDENT. THE SMOKEHOUSE DID NOT DO THIS. I THINK THEY SHOULD HAVE TO PAY HIS MEDICAL BILLS AND COMPENSATE HIM FOR HIS LOSS. THERE IS NO AMOUNT OF MONEY THAT WILL MAKE THIS BETTER. THIS YOUNG MAN HAS TO LIVE WITH THIS THE REST OF HIS LIFE. FIRE IS A HORRIABLE THING AND IF PEOPLE DO NOT REALIZE THIS WAIT UNTIL THE END, BUT THEN IT WILL BE TO LATE.

I dont know what they have to do but they need to get this guy's bills paid. The company must need a lawsuit to get the ball rolling. He is already severely hurt who needs this additional stress

If you cant afford the insurance for the safety of your employees you should not be a business. Regardless of mom and pop or whatever.

Right now I am having a hard time being concerned about company cost when i look at that young man!

that is why they work people part time. that why the law need to be change so that if they are in busines they need cover everybody or not have a business. we care home insurance so if any body gethurt so why do a business get by with out it

One of my employees fell outside on a smoke break (which only last about 5 minutes, if less then 30 minutes it stays on the clock) and twisted a right ankle. However, it was what it was. Medical, paid time off and the employee milked it for all it was worth. Injury on the clock W.C. must pay and is the liability of the employer
