If a guy is not carefull in what they say to cops after a plane crash, this is what can happen:
Count 1: HOMICIDE BY NEGLIGENT OPERATION OF AN AIRPLANE
The above-named defendant on or about Saturday, August 28, 2004, in the Village of
Port Edwards, Wood County, Wisconsin, did cause the death of Kimberly Reed by the
negligent operation or handling of an airplane, contrary to sec. 940.10(1), 939.50(3)(g)
Wis. Stats., a Class G Felony, and upon conviction may be fined not more than Twenty
Five Thousand Dollars ($25,000), or imprisoned not more than ten (10) years, or both.
And the Department shall revoke the defendant's operating privilege for one (1) year, and
shall order the defendant to submit alcohol assessment and if necessary, to comply
with treatment as a condition of reinstatement.
Your complainant is a deputy with the Wood County Sheriff’s Department and his
information is based upon the records and files of the Wood County Sheriff's
Department. Your complainant has relied upon those records and files in the past and
has found them to be both truthful and reliable. According to those records and files:
1. On August 28, 2004, Investigator Mark Gosh of the Wood County Sheriff’s Department
reports that he was dispatched the scene of an airplane that had crashed into the
Wisconsin River after hitting electrical lines that crossed the Wisconsin River near the
Domtar plant in the Village of Port Edwards, Wood County, Wisconsin.
2. On August 28,2004, Mark Strub stated to Inv. Gosh that he had been giving airplane
rides to individuals at the Balloon Rally being held at the Airport. Strub states that he was
giving a ride to Kimberly Reed in his 1941 Stearman biplane. While he was giving her a
ride, he was performing aerobatic maneuvers that included rolls, loops, hammerheads
and Cuban 8’s. Strub states he noticed that Reed was getting queasy from the ride and
decided to head back to the Airport. Strub states that while flying along the River at a low
altitude because he believed he could do so, he saw some power lines across the River.
He attempted to pull the plane up but was unsuccessful and struck the lines causing theplane to crash into the River. Strub stated that after freeing himself, he went to Reed but
could not free her because the top of the wing had collapsed over her seat. Strub states
that he had never flown that section of the River before but was aware that other sections of
the River did have power lines across it. Strub stated that he never looked at his altimeter
to see what his height was off of the River.
3. On August 28, 2004, Asst. Coroner Gabe Holczer did report to Inv. Gosh that after they
were able to retrieve Kimberly Reed from the plane, she was pronounced dead. Asst.
Coroner Holczer states that she had a severe laceration to her scalp, her jaw appeared to
be broken, possibly had internal injuries and broken ribs. His belief was that she likely
died upon impact with the power lines when her body and face struck the dashboard.
Deputy Coroner Holczer further states that later, on August 29, 2004, x-rays showed that
Reed had a cervical fracture that subsequently attributed to her death.
