Just a question...On a first offense, record clean..my son gets pulled over for spinning rocks on a turn (he does not dispute the charge) he just got off of work ( night shift 10:30pm to 7am) the officer gave him a field test because his eyes were dilated and searched his car or course found nothing and passed the field sobriety ...my question is.... Does the city of Lucedale always make arrest on careless driving after writing a ticket and in pound the vehicle (that was $160.00 to get out)and signed a $1000.00 bond?

Thats new to me check into it is what i do its like tthe city judge told me these cops does not know the law and it sounds like to me city is out of line with the law

First and Foremost, every motor vehicle violation is a form of breaking the law and the tickets issued are a form of arrest. In lieu of going to the police station or jail the police officer writes these citations as a matter of convienence. Secondly,We do not know the whole the story, perhaps there was some disorderly conduct going on during the stop i.e the driver getting lippy with the police officer. we don't know. So while you continue to wanting to place blame on the police officer's competence (not saying all of them are competent) I'm just saying maybe some of us should be a little less judgemental and a little less quickly to jump to conclusions.

Wow..... I was just asking a question... He was not mouthy.. In fact he was upset and crying... He only opened his mouth to say yes sir or no sir... I am not judging anyone just asking a question... Is this normal protocol for first offenses for the city of lucedale?

Its just a toy for anyone to use. I often don't even notice most of the time. like it affects anything.

This is a boxing ring for letters and numbers...lol...I couldn't find an answer anywhere so I came here... And then it hit me that so do smart "aces".... Thanks for trying to answer a puzzling question about my and my sons situation... We will find out on July 8th court date... Will keep you all posted, maybe?

Legally Speaking covered the high points. I'm sorry you mistook his informational post as being "smart ass."

As he stated, careless driving is a misdemeanor offense. Typically, one charged with careless driving is released with a citation. If the officer feels a physical arrest is prudent, however, one can be made. The vehicle will usually be towed when a driver is arrested due to liability, as in the department does not want to be responsible for any damage/burglary of the vehicle.

Just from the information you provided, it sounds like perhaps your son was tired or fatigued to the point his driving was impaired, and made the decision not to let him continue driving. Or, it could be your son has only told you part of the story. I'm confident you or your attorney could obtain a copy of the officer's report. Out of curiosity, how old is your son?

Also, if he is not disputing the actual charge, then the court is not the appropriate venue to question the physical arrest or the tow. You should bring these concerns directly to the agency involved, as they are matters of policy and procedure--not a criminal matter.

My son is 22...the officer told us the same thing our son told his dad and I... I was not saying( should have made a better statement about what I meant) anyone in particular was an ass.. It's just it's been years since I have visited this site and forgot that sometimes an ass will use a thread to say mean and/or rude things that have nothing to do with what was posted.... I am here for my children no matter what age they are and I have questions that I needed answers to so I will know more how to answer my children's questions so we all will be informed and know what for the next time... I will not tell them something just to make it seem like I know everything... I don't, so I ask
