LUCEDALE, Mississippi -- George County Sheriff Dean Howell is asking the circuit court to overturn a Board of Supervisors ordinance limiting his use of overtime.

The appeal, filed June 14 by attorney Jeffrey Pierce, claims the ordinance is repugnant, unlawful and "invades the province of the sheriff's office as to how he can allocate the work and duties to be performed by the deputies and by the sheriff."

On June 3, county Comptroller Amye Havens reported that the sheriff's department was more than $100,000 over budget through the second quarter, news that prompted supervisors to pass the overtime policy.

County attorney Robert Shepard alerted Howell that the "supervisors will not approve payment of any overtime for any employees of the sheriff's department that is incurred after midnight (on) June 4, except for investigators who are working on a major felony case."

Major felony cases include homicides, rapes, armed robberies and burglaries of occupied dwellings, among others.

"The sheriff's department needs to schedule its employees so that they do not have to work overtime because the department is already way over budget," Shepard's letter continued.

Later that week, Howell said, "I was elected by the people of George County to provide police protection and safety of all the citizens, and it is apparent the supervisors seek to curtail police protection by budget constraints."

Howell admitted that his department is over budget, mostly due to overtime and fuel costs.

The sheriff's department budget for the 2011-12 fiscal year was $1.072 million and is $1.112 million for the current fiscal year.

The appeal claims "the Board of Supervisors has no jurisdiction to tell the sheriff how to run his office or allocate the work and duties to be performed by his deputies."

Shepard said Monday that the county has 30 days to answer the appeal. Then, he said, it will be up to a judge to rule on the ordinance.

Shepard noted, however, that it is illegal for the sheriff to continue to exceed his budget and that the board passed the ordinance to "slow the bleeding."

In a separate move, Gulfport attorney Bill Pettey Jr. said today that he plans to file a federal complaint on behalf of several deputies regarding the overtime ordinance.

The deputies "have already filed an (Equal Employment Opportunity Commission) complaint regarding overtime," Pettey said. "The ordinance, I believe, is in violation of the Fair Labor Standards Act."

Pettey noted "we have no complaint about the sheriff; he's caught in the middle here."

That suit will be filed in federal court in Gulfport within the month, he said.

I like the sheriff, he has done more than anyone in my recent memory to improve the county. George County is not the small nice place it once was, they may have to come off the money for the sheriff's dept. I would like to see more deputies on the road with two in each car.

I should have known if somebody said Dean Howell stuck a corn cob up his ass in Aunt Jenny's at lunch Cipsaw would say that is cool and he must be a real law enforcer to do something so neat.

Chipsaw where have you been living at the last few months and where do you get your information from Dean himself. He is a legend in his own mind.

We all have our own opinion - I have never even had a conversation with this man. I get my opinion from the road I live on and he has made a difference. I look at results and not what someone else tells me. We still have so many bitter people on here because Mr. Keel did not get re-elected. If Mr Howell runs again, he will win or if Marty Davis runs he will win. I know of no one in the county that can beat either of them.

I certainly hope Marty runs myself - I have heard that Mr. Howell will not seek re-election. If he does and Marty does not run, I will vote for Howell.

Wow, it is illegal for the sheriff to CONTINUE to go over budget yet he files suit with the board of supervisors for them putting an ordinance on over time?! How can you say he has done more to improve the county than anyone else? His incompetence has crippled the department. Bet that unmarked grey car might have something to do with fuel costs and the one driving it might have something to do with the overtime issue.

There may be jealous folks, but there is no need for our little sheriff's office to have a Spokeswoman. That is for big cities where someone has to talk to different media outlets several times a day. If the sheriff can't talk to the media, he needs to resign. I don't know him, but I don't think that he has done much good or bad. He has just stuck to the status quo.

I agree with you on the spokesperson - that money could pay a deputy. I have seen a change in the area that I live in and everyone will have to admit that he has arrested people on some pretty large cases - we have had murders and a robbery gang that were all caught. We have a Loper case from the past that was never solved.

Jealous by no means just fed up. It seems like every week there it's something in the George county Times about the board and the sheriff regarding the budget and how he cannot seem to follow it or hell even try. I would love to see who is actually causing all the over time. It even said one week that it was bc off the secretaries. Why do they need over time? then when you see that car grey car sitting at Wal-Mart and groceries being put inside it. That part of overtime? It's sad when the incompetence and actions of the sheriff and his spokeswoman affect the hard working deputies who are out putting there lives on the line day and night. It pretty much appears that he does not give a damn.

Well, before the election, those same people were singing his praises and complaining about Keel. Now you see them reverse their stance. Always another election to correct the last one. Be more careful.

Meanwhile, Gulfport attorney Bill Pettey Jr. said several deputies have filed a complaint with the Equal Employment Opportunity Commission over the overtime ordinance. Pettey, who represents the deputies, said they "have no complaint about the sheriff; he's caught in the middle here." Pettey said the deputies may file a federal lawsuit over the issue.

I like how the sheriff threw the purchase of tractors in the supervisors face in his George county times article but completely forgot to mention the brand new SUV he just got.
