the big problem with the rules is that they post the rules but dont say if you break them a certain amount of times then you will be asked to leave or a certain amount of times you will be kicked out for a week or a certain amount of times you will be banned. So anyone kicked out could come back on the hockey assoc. and cry discrimination. its left to the rink people to enforce the rules without a standard to go by. Cant blame the workers at the rink for that.

This would be a great resolution!

Anyone who is banned from the rink for breaking a rule is mailed a letter stating what they were banned for and for how long. The letter also states what the consequence will be if another infraction occurs. Anyone wishing to see our layout of consequences is welcome to attend a board meeting. Also, the facts listed here in regards to the arrest and ban of three people on Sunday the 27th are not accurate. The individuals were charged to the fullest extent of the law as pertaining to their behavior and were dealt with in regards to banning from the rink in accordance to the policy that is in force for everyone. Anyone choosing to behave in the same way will be treated in the same manner.
So your telling me if my kid does something that can cause harm they are only baned for a week? And if thecould possibly cause harm to others its only good for a week? And no I spoke to someone about the throwig of the skates. More could be done. If the association would press charges. And should ban them for the rest of the year. The park is not a ublic place, the grounds are owned by onegroup and the rink is run by another. Are we just waiting till both have a lawsuit because of these actiosof these kids and someone is hurt bad?

Tanya the letter is after the fact..a good lawyer would argue it was made up after the incident to cover yourself. In short it doesn't cut it. It has to be posted for all to see. What the rules are, and what will happen if you break them. If they aren't you're set up for a law suit. I know the rules are written on the board, and that's good, but it doesn't say what will happen if you break them. I have looked at the board.

assault 1) v. the threat or attempt to strike another, whether successful or not, provided the target is aware of the danger. The assaulter must be reasonably capable of carrying through the attack. In some states if the assault is with a deadly weapon (such as sniping with a rifle), the intended victim does not need to know of the peril. Other state laws distinguish between different degrees (first or second) of assault depending on whether there is actual hitting, injury or just a threat. "Aggravated assault" is an attack connected with the commission of another crime, such as beating a clerk during a robbery. 2) n. the act of committing an assault, as in "there was an assault down on Third Avenue." Assault is both a criminal wrong, for which one may be charged and tried, and civil wrong for which the target may sue for damages due to the assault, including for mental distress.
Now reading this definition it appears hummmm is correct the rink could do more legally to prosecute but they act like they are reluctant to for some reason. Punishment from the rink people i agree with but it needs to be done consistent and it needs to be done correctly to keep lawsuits away. The reason i bring this up is the throwing of the skates is a criminal offense by definition and she should have been banned for the season like he was. Because you didnt ban her for the season it can now be considered discrimination.

Ok let's get something straight here now!
If Janet was there this crap wouldn't be happening. False, she never reported any incidents and tried to handle these things herself. The kids have been wild and obnoxious down there for years and the last 2 years it's all been coming to a head.
If something would have been done to the girl that shot the skate people on here would be complaining that "great, now the kids don't have anywhere to to."
I think this is a no win situation or a damn if you do and damned if you don't.
Please 80 degree weather come so the ice will melt and this crap can end.

No one threw a skate at me. Her actions, while inappropriate, were not dangerous. Again, no skate was "thrown".

I have spoken to law enforcement agencies as well as individuals involved in the legal system here in Lewis County have been told on all sides that her actions do not fall under the guise of assault because she did not "throw" a skate. I treated her as I would've anyone else and banned her for a week for swearing. Swearing was her only punishable offense.

I agree - I was there last weekend and there was no out of control kids, no smoking pot - just a bunch of teenagers skating and hanging out. Janet played favorites and that kid would've never gotten arrested with Janet there. Even if he walks on the charges - he is gonna be charged with trespassing if he comes back this year- and I bet his two gf's won't be back either.

That's funny skater mom last Thursday said skates were thrown and others that were there including one of your workers said they were thrown. Guess your trying to pass it off so it don't look so bad or covering up her actions. And they swear all the time on the ice. Half the teens should be banned. And I'm sorry conduct should be regarded not just words. They shouldn't be back.

so lets summarize this.. Several people seen the incident happen and confirm the skates were thrown. Tonya first said they checked with police to see if there was an assault and now she says there was no thrown skates. Why the lies? which is true? I tend to believe there was thrown skates.

Have your people not walked down the halls of any school, sidewalk, or in any store and heard how these kids talk? What makes you think their language would be any different if they were at the rink?
Fools that think the swearing would be curbed or different are living in a freaking dreamworld.
Listen to the adults speak anywhere you go, their mouths are no different.
As for the skate being thrown or not, who the heck cares. The kids throw their hats, gloves and footwear at the rink at their friends.
Please tell me what are you supposed to do have them all banned or arrested.
Wake up people and get off your high horses.

My consultation with law enforcement concluded with a decision on their part that what she did did not fit the definition of "throw". I never said a skate didn't gain some air. I said that the skate was not "thrown" (per law enforcement definition) and so it did not qualify as assault and no charges could be pressed.

OMG lol the skate left her hand and was airborn and its not considered thrown?...ok how about lobbed or tossed it doesnt matter...once in the air its a projectile. and you work at a school and you actually are that gullible? I also checked with a lawyer friend and also a judge which is where i got the definition i posted on here for assault. just go back a couple of my posts earlier and you can see how ridiculous what your telling everyone here sounds...you make it sound like the police dont want to do anything so they are making up crap and there is nothing you can do because of it.

not trying to run the rink or Lowville but there is such a thing as honesty and consistency and fair play which is what we all are supposed to teach kids. That isnt happening here and its being pointed out. You watch even the kid that smoked weed will end up getting off because the system in Lowville and the rink is horrible. It teaches the kids they can do anything and get away with it. So you dont want me to say anymore then ill make a deal with you. Stop all the posts on here about how bad kids are now. Stop everyone from asking what we can do to stop the hoodlums and ill gladly stop. Sounds fair to me ..what do you think OMG?

Why don't they vote and ban them for rest of the year. It is private property not public. That would solve a lot of this.. this was not just swearing it was an act of aggression and a threat. I think that justifies banning them how about everyone else?

I dont see them doing it hummmmm. They cant even agree what is wrong or not. Looks like a battle of semantics. Twist one word so they dont have to be responsible for making an unpopular decision. I do have one question for all the rink workers. If a skate comes out of someones hands and goes through the air and strikes one of your kids and hurts them would this be a different debate? Notice i didnt say throw.
