Unappealing day in court on traffic ticket protest

Full story: Lowell Sun

It didn't matter what I said. I could have been talking about the Red Sox or the BP oil spill or the proposed mosque at the site of ground zero in New York City.

I also got a ticket last year, the officer was 2 blocks away and he pulled me over saying that I drove through a red light, I didn't , he gave a ticket of $150. I went to the court, They didn't listen to me. I was really upset, Now I have to pay for something that I didn't do. On the lowell Sun the other day had a note about another Lowell Magistrate that was driving under influences, and nothing happened to her!!! That's so unfair.

The police trap is nothing new, This is how most cities, towns and the state raise addtional revenue by screwing it's citizens...As for magistrates they should have to be voted into that job rather than appointed ,Then maybe they'd listen to people..

we need to think outside of the box. don't play their game, change the rules, resist, figure out a way to cost the state money, make it not worth their while to prosecute you. We are living in a police state,

The exact same thing happened to me! Did NOT run the red light, same rude cops, same extremely rude magistrate who had no intention on listening to my side, same offer of lowering the fee or paying more to contest it further. Plus there's a fee to contest the ticket so you're still paying the full ticket. And I've never contested anything before either because I feel if I did something wrong it's my obligation to pay. But I did NOTHING wrong and had to pay and nobody listened or cared. This isn't about making the streets safe, it's about making money and the cops pushing around their girth. I've lived in a lot of places and I've always defended cops, but I'll never again defend Lowell cops. This is completely disgusting because there's nothing we can do about it except pay. And for those of you saying we're crybabies, wait until you have to pay a $150 fee for something you didn't do and get major attitude from the cops giving you the bogus ticket on top of it. I'm sure you won't be happy either.

Oh boy oh boy, does this remind me of my traffic nightmare. I was pulled over in January by police on Thorndike Street for running a red light. Never mind that it was rush hour, cars and buses (ever see a bus driver get a ticket?) were inching through the three traffic lights within an tenth of a mile of each other, the cop could care less. He gave me a $150 ticket and told me that the chief had sent them out that night to issue citations and that "it was like shooting fish in a barrel." I paid the $25 to appeal (scam #1). That day I spoke to the four people to the left and right of me and they were all there for the same offense, at the same light! When I lost my appeal, I decided to invest another $50 (scam #2) to appeal it before a judge. it was risky and I knew my chances were low. The day I appeared in court (with my maps, photographs, driving record in hand), I was stunned when my case was dismissed because the cop didn't show up. But even though my ticket was dismissed, the courts still made $75 of of me because of the appeal costs Sadly, we're a city under siege by our city officials and the Lowell Police. In this recession, it's unfathomable to me they would stoop to such low levels to exploit their constituents. But, thanks to you and others, people are finally speaking up about this travesty. It needs to stop before we all go broke.

You can all thank Chief Lavallee. All he cares about is statistics. He has no interest in real law enforcement. Statistics look good on paper and the revenue is a great way of sucking up to the city manager. Funny thing about real crime though, you can't hide bodies. There are some great guys ( & women too) working for LPD, but leadership and the tone it sets comes from the top and when you have a chief that is only interested in traffic stats, that's what you get.

the cops and the courts go by a percentage, how many will appeal until it is no longer cost effective.here is what you do,appeal to a magistrate, when you lose appeal to a judge, you have the right to face your accusers at trial,ie:the police, they are paid 4 hours minimum for appearing, which is all overtime, roughly 160-200 dollars, all paid by the city or town, the income received from citations is split between the city or town and the state,do the math, average citation 200 dollars, cops receive 200 dollars,in court a judge usualy leans towards a citizen and if the cops do not show, you win.

I'm not particularly sympathetic to the police in general, but in these instances they are merely carrying out mandates of the City Managers to increase revenues for their respective cities and towns. I'm sure they'd (patrol officers) rather be doing something other than traffic enforcement all day.

It's not surprising that this is simply another system in Massachuetts that is broken, and our elected leaders are clueless(or they are not and just don't care)

handicap parking placards are being used by many that do not qualify so that they get prime parking and do not have to put money in the meters.

you now have to "pay" to appeal a ticket, whether you are right or wrong, you still have to pay for the "right" to appeal.

If you get in an accident, just wait till you go in for the insurance surchage hearing(that you have to also pay to appeal), and then watch your own insurance company(that pays the hearing officer) reject your appeal anyways, and plan on paying increased rates for the next 6 or 7 years.

Massachusetts has found a way to break anything that they possibly can, and we keep electing the same idiots and time and time again

please understand, I am not picking on you or making judgements.

First many people have suggested that the aggressive ticketing is a way for officers to get OT, apparently not the case here.

The cop said "like shooting fish in a barrel"? That's what I've been saying in another thread, assuming you didn't do anything wrong and should not have been ticketed it still is happening as I type this in the city. Trying to make the lights is and has been an ongoing issue for as long as I can remember in the city.

you stated other vehicles "were inching through the three traffic lights within an tenth of a mile of each other" if the light changed while you were under it then you should get a ticket.(again though I'll assume you were not under it when it changed). If you said that to the magistrate I can understand him not believing you because it sounds like an excuse, not valid evidence that you were not guilty.

It's called selective enforcement, if you're travelling down 495 in a group of traffic that is going 80mph and you get stopped the worse thing you can say is "everybody else was speeding, why ticket me?"

When you get to a traffic light and you inch into an intersection with a light and you're not sure you'll make it to the other side you are rolling the dice. Yeah they got 75 bux out of you, it sounds like you feel perhaps you might have been guilty (again, not picking on you) but they didn't get 150 bux, you didn't get a surcharge on your insurance so you did get a break.

You bet in this economy they are going to crack down, people should be aware of this and take that into consideration when they drive. Other places they should crack down on is illegal parking, drive around the city and see how many cars are parked on sidewalks (we actually make jokes about it). Why this is a surprise is beyond me and when they crack down next month on school zones it's going to be just like shooting fish in a barrel and everyone will complain about that too.

This is an old story. Whenever the econmy gets tight, cities and towns use ticketing as a revenue stream. They hold all the cards and they don't care about fair or even legal. My advise to drivers, a general no ticket payment holiday. Most of these citations are bogus anyway. "But they'll suspend my lisence" says you. ReallY? How many Illegals are there without any auto papers at all? "They'll throww me in jail". Really? How many illegals are in jail for no papers. It's only the law abiding that get suckered.

Same officers who gave me my ticket for "failing to stop at a red." Which didn't happen. Same scenario for me - never 1 ticket in over 15 years of driving. NOT ONE! Same magistrate - same exact verdict. It's a scam.
