Tyrone: I honestly don't think that anyone is trying to scare anyone else, but keep in mind that any attorney they hire to proceed with any civil case may want to have an investigator in the courtroom in order that they can get all the evidence they need as well as transcripts etc. It is not at all uncommon for someone to hire an attorney to proceed with gathering all needed evidence from a criminal trial some of which will be needed in a civil trial.

There have been cases where the civil trial was actually held before the criminal trial was held but more often than not parties wait until after any criminal trials to proceed with civil suits.

I can certainly understand why the family is looking into a civil action and most anyone else can too. The burden of proof in a civil suit is not as great as the burden of proof needed to win a criminal conviction.

I believe the girls have been failed in many ways. By their grandparents, the City of Lovington and the State of NM.! I am hoping that with a new Prosecutor, the State will make things right!

I agree that the victims have been neglected by more than one source in the justice system. It does no good to rant about it now. What needs to take place now is for the name calling to come to a complete stop on both sides and some of those with inside information about the DA's etc need to keep it directed to only those they can trust or those who really need to know.

Yes, I agree that the girls have been victimized by the system, but often times too much talk on this blog is not good because the element of surprise is very valuable. In other words loose lips sink ships. This case does not need to be tried here on this blog or anywhere else except in a court of law.I have suggested several times that the name calling and bickering stop as have others, but some still continue to do it. It doesn't help the victims at all for so called grown folks to act irrational and immature.

If it continues it could cause some people not to come forward with evidence that could really help the victims.

Justice will be served whomever is prosecuting this case.

I have been around the judicial system long enough to know that you can run, but you can't hide.

The girls will be ready to tell the truth, yet again and get the perp who did evil things to them. If anything this has made them know that he is trying to get away with it, and they know truth will prevail.

Former Lea County Sheriff ’s deputy
Danny Surratt walked in the courtroom in tears for

a sentencing hearing Thursday morning, but walked

out with a second chance to prove his innocence.

On April 13, a jury found Surratt, 61, of Lovington

guilty of one count of criminal sexual penetration

in the second degree of a child 13 to 18 years
old.

On Thursday, Judge Steven Bell of Carlsbad ordered

a new trial in District Court in Lovington after

throwing out that April guilty verdict reached by
jurors.

Bell ruled based on a defense motion on Thursday

that criminal intent language was left out of jury

instructions in April.

“On many levels this is unfortunate,” said Bell

before granting the defense’s motion.“... It was

not tendered to me by the state, the defendant’s

council does not have the obligation to say the

instruction was left out. We had a week-long trial,

in which a jury worked extremely hard to diligently

arrive at what they believed was a fair verdict.”

Defense attorney Barry Crutchfield said there was

an omission of general criminal intent in the jury

instructions, which is required by New Mexico

criminal law and would void all the proceedings in

the first trial. Crutchfield is Surratt’s new

defense attorney, hired after the last jury trial.

“I have come in this case very recently. I found

and noted in the instructions the absence of the

criminal intent,” he told the court.“... We
believe that that is fundamentally an error.”

Prosecutor Courtney Hewes of Alamogordo asked after

the case was reversed that the court increase

Surratt’s bond previously set and posted at

$500,000.

“He has more information and more to be
scared of,” Hewes told the court.

She also asked the judge for the trial to be
scheduled as soon as possible and said the longer

the wait, the worse it was for everyone involved in

the case.

Judge Bell agreed with Hewes.

“This case needs to be finished as quickly as
possible,” he said.

Hewes said after the hearing she was shocked
by the decision.

“I feel horrible, and I feel it is a tragedy, but I
respect the judge’s decision,” Hewes said after
the motion was granted.

Crutchfield said it is regrettable delays occur
but the law requires certain actions.

The courthouse was patrolled by New Mexico
Police agents during the hearing and about 70
spectators in the courthouse consisting of both
defense and prosecution supporters were separately

escorted out.

The victims in the case are the defendant’s 11-
and 18-year-old stepgranddaughters, who testified

allegedly Surratt molested them on multiple

occasions, with one of the incidents occurring on

May 15, 2010.

Surratt was originally charged with one count
of criminal sexual penetration of a child under
the age of 13 in the first degree, one count of
criminal sexual penetration of a child under
the age of 13 in the second degree, one count of
criminal sexual penetration of a child 13 to 18
years old in the third degree and one count of
criminal sexual penetration of a child 13 to 18
years old.

Counts two and four were dismissed during
the second day of trial. The jury was instructed
to deliberate on counts one and three but were
not able to return a verdict on count one due to
mistrial related to jury instructions.

Surratt took the stand during the trial and
denied the allegations.

“No I did not. I loved my granddaughters,” he
said, sobbing during his testimony.“I love my
granddaughters ... I feel that they have been
pushed into this.”

The retrial for count one had already been

tentatively set for July 9.

1. There were several alleged victims that weren't allowed to testify at the last trial. Do they have the option to testify at the new trial and/or bring up additional charges?

Comment: I am relieved to see the last few pages of this blog actually being informative as opposed to the usual bickering and low grade attempts by opposite sides of the family trying to convince each of Danny's guilt or innocence. It gets exhausting sifting through all the garbage.

While speaking with the victims's mother last night I learned something I find really, really disturbing. I know I will probably get attacked for sharing it, but oh well, it confirms my belief that some of the TEAM DANNY people would support him no matter what.

One of Tanya's uncles that is supporting Danny, told her father that, HE KNOWS DANNY DID IT, BUT IT IS VINCENT'S FAULT FOR ALL OF THIS BECAUSE HE CALLED THE POLICE!

It's mind boggling to say the least.

Yes, more hearsay. As I've said before, this is a forum, NOT A COURT OF LAW. Discussions, debates, hearsay, opinions, ect. are allowed here.

For example, Vincent's history of alcohol abuse is totally irrelevant to this case, but TEAM DANNY has brought it up over and over and over since day 1 of this case.

It was Tanya's Uncle Andy, and well even though I have not met Tanya's dad, I believe him. Rose's family has done nothing but blame Vincent. So it doesn't surprise me that he'd say that.
