Recently, this Route 46 business was purchased and named Ultimate. I purchased a 10 coupon set in April. I went there last week and was told they were no good, as the new owner would only honor them for thirty days.

It is not only a bad business decision, but remarkable bad faith to the small community it serves. The money is not the big issue, but I do feel "taken".

Has anyone else experienced this? I am probably taking them to small claims court, as I have not found any public posting by the new owner to warn us. I would like to "welcome" this new owner to the community he serves??? Wanna' join me?

If you take them to court you will lose. You purchased the coupons from the previous owner. The new owner did not get any money from you, so your complaint is with the previous owner. To be honest, it was pretty decent of the owners to give people 30 days to redeem the coupons that they were not paid for.

You are wrong legally! There is a legal obligation to post this in some public/written format. When someone buys a business, they assume the liabilities, regardless of what the contract with the new owner says. As to the owner being "generous" in his offering...that's crap. He serves a small community and should not antagonize those who would most likely use his new business for a few bucks. The customer pool in the 5 mile radius is weak. Bad Business. Bad Faith!

There is no blanket assumption of liability when you purchase a business. Go to court and find out the hard way. I bought a business a few years ago and my attorney cleared articulated that fact.

Actually I should clarify. If you purchase a corporation you are liable for it's liabilities. Since the name was changed I will assume that the new owner has his own LLC or corporation therefore not obligated to the previous "business owner's" promises.
