Yeah windows can be replaced but why should the people who's windows he broke out have to spend the time and money to replace them and even if he dose recovery and tell his side of the story who would believe anything he says he was drunk at the time who knows if he even remembers what happened or even remembers being there that night.....praying for the family who had to go through this bs and pray that those windows don't cost a lot of money with this economy who can afforded it these days also pray for the great Joliet police who did what they had to do.

I think u all are fuckin nuts James did not deserve being. Shot 5 times or even 1 time if they wanted to stop him they would have shot the tires not in his face I mean they didn't feel threatened by him they are out of control police who should b stripped of there badges.I am not dismissing what james did but why kind of police shoot a man 5times and u all think its funny dam don't u know when u judge u to will b judged!!!!!!!!God is with u james and my family supports u to the fullest...

God will bring justice and I prray the police that shot an unarmed man 5 times and one was to his head will have to pay for there crime!!and this is a crime when rambo style police get away with a horrible thing like this. How do those lay there head down at night???????

Lets look at this logically, James is reportedly breaking windows at location "X". Someone, does not matter who, calls the police and reports this. A reasonable thing to do. The police respond. That's what's expected. Somehow, and this is the only part that is not clear, James is identified as the suspect. The police attempt to apprehend him. When they first stop him, he speeds off when the xit their patrol cars. The police give chase. Again, hot pusuit, the suspect is in front of them, they have no duty to retreat fro making a lawful arrest. Let's remember, any damage to property over a certain cash value is, indeed, a felony offense. While in pusuit, Jamse gets trapped by a train so he turns his vehicle around and apparently stops. This is reasonable to assume because again, the police have time to exit their patrol cars and give him orders to surrender. Why get out of their cars? Kind of hard to talk to a suspect from inside a police car while a train is going by. It's also kind of hard to put handcuffs on someone when he's inside of a car. Also, how long do you sit in your car and wait for him to get out of his, put his hands up and give up. On last thought on this part, James is "trapped" it's been suggested that the police "knew who he was, had his license plate and cuold just get him later". O.K. and what if, and this is a reasonable assumption, James resisted again and fled from police, do they just say "well maybe another time then". Given this viewpoint, all any criminal would have to do is resist and flee any attempt of arrest and the police should just let them go, this is not reasonable. Again, an officer has no duty to retreat from a lawful arrest. Now, given the circumstances, James elevated the use of force when, using his truck as a weapon, one that could cause the death of an officer, he attempted to resist arrest and flee. Just because one officer was able to get out of the way in time and not shoot, does not put the other officer in the same boat. Given the fast changing nature of this part of the situation, the officer who shot, responded to deadly force with deadly force. The fact that this did not immeadiately stop James is evidence tha the the shooting could not be excessive because the police are trained to stop the threat. Now if the 5 shots stopped James and dozens more shots were fired, maybe, depending on further perceptions by the officers, there could be an excessive force claim. Courts have ruled that an officers reaction to a perceived incident does not have to be the right one. They have also ruled that an officer does not have to try all other options available to them. The officer just needs to be reasonable. Here, shooting at a person using deadly force to resist arrest and facilitate an escape is reasonable.

Let's also look at the history, He's done this before. There is record of it. While the Joliet cops probably were not aware of this, his prior actions tend to make me believe the officers accounting of these events as reported in the Joliet paper.

it dosent matter what happened, noone knows the true story. But how about you think about his kids & wife for once? You guys are ignorant people. His daughter is going to be a senior in highschool, you know how hard that has to be on a kid? I want you guys to put yourself in those kids shoes. Nobody should have to watch there own father pretty much die before there own eyes. &yes, he did almost die. He couldn't speak for days, he stoped breathing on his own. That's hard on any kid. Noone should have to grow up without a father or a mother! & for you rude people saying his mother needs to take care of him & watch him? Yeah, his mother died of cancer 4 years ago. He's been through a lot these past 4 years. He does not have a lot of ex's. He has a wife, he just divorced. Stop runing your mouths when you have no clue what you are talking about! It dosent matter what he did, because none of us were there to witness it, its his word again the police.

Welll, my mother told me to stay off this stuff & what not, but iam james pachecos daughter. So say what you have to say, but just know I have to through so much, & id appericate if you kept all comments to yourself. I'm scared to grow up without my daddy & any other little girl would be to. You guys only see the bad, they never show what good my dad did for my family.

Poor little girl. Your daddy is not dead YET. If he cared about you so much like you think he does he would have put the first beer down thought about his daughter and drank a pop instead. James clearly is getting what he deserves. He deserves worse. People like him need to be kept off the street. It's people like him this world is so shitty. It's funny one minute you say wife and the next it's he divorced her. I couldn't blame her I'd get away from his fat thug ass too. If you don't like reading how your father was away from home then stop coming on here. He might have been nice in the home but he was just the opposite outside the home. He tried to kill someone using his car. If he meant to or not doesn't matter. When the police put on their lights you stop and do as they say even if you do not agree with them. You can argue why and what in courtt not the streets. At least that's how civil people do it. Not animals like your father.
