I hear the Common Council unanimously passed some sort of resolution telling the city to give up the effort to tax the YMCA and end the law suit, and resolved that they would not pay any future legal bills relating to pursuing the law suit. I also hear that Peters is seriously contemplating just ignoring the resolution and telling the Common Council to go fly a kite. Is this what happened? And how can Peters just ignore the unanimous Council?

Yes, the link to the City agenda pdf did indicate Resolution N0.17 to renew the contract with the Herkimer County Human Society. Thus, proof that there are indeed humans in Herkimer County. Please not that the agenda was subject to change, however.

City Clerk= priceless or clueless.
#7 Feb 5, 2013
You're a moron. Keep stirring the pot....

The Herkimer County Human Society.
An outnumbered group if ever there was.

A bunch of blowhards on Topix. Not surprisingly, none of you attended the meeting. Too busy? Ya right. Anyone who has time to post on this site has time to spare. Typical yokel foolishness.

That is what Peters told the OD last night: http://www.uticaod.com/news/x930796097/Little... ... he said it is out of his hands and the lawsuit will proceed. WTH!!!??? Has Peters given control of city policy to some Utica shyster lawyer now??? RESIGN you stubborn old oaf!!!
And where was Rose last night? The paper said he played hooky. Was that another message the administration was sending the council? Does Peters think he has become some sort of dictator who runs the City his way regardless of what the voters and their elected representatives have to say???
It is time for IMPEACHMENT!!!!!!!

You're a moron. He/she called it like the newspaper reported it. Keep living in your fantasy world while Peters runs roughshod over every institution in this city, to include the Common Council. YOU are half the reason the YMCA is in this state now, with your conciliatory approach of trying to make peace with the beast. Well, Peters has the utmost contempt for everyone who get in his way, to include the YMCA Board and now the Common Council. He will simply ignore you all and do what he wants.

It was a GREAT meeting. Excellent job, Mr.Petrie! Mr. Gressler's remarks were respectful and spot-on. The people and their reps have spoken.
Hate to say it but perhaps impeachment of this Mayor should be looked at. I don't know what he could possibly be thinking. He is bad for this City.
Mr Rose, I submit, is a coward.
Spoken from Ward 3. But I am not alone.

Hey, relax a day or so and let this play out, and in particular remember that Bob isn't exactly the brightest bulb. He's stupid, yes, and stubborn, but he's not the complete and utter idiot that so many people think that he is. He'll figure this out.
Now, I don't think the Common Council can order him to drop the lawsuit. But they do have the power of the purse, and they used it last night like a nuclear bomb. They resolved not to pay any further attorney fees associated with this case. Which means the attorneys know that if they continue to work for the City on this, they won't be getting paid for it. So, they won't. Which means that the only way Peters and Presta can continue this is to go into the courtroom without counsel, and explain to the judge that they City doesn't have an attorney because the City won't pay for one.
Bob's only choice now is just how much he wants to get laughed at and ridiculed. His telling the paper "it's out of my hands" is essentially his way of making the point that he is not getting ordered around by the Common Council, but he is doing nothing, in other words, letting it drop with whatever scraps of dignity he can still muster after getting humiliated last night.

Hey, remember that Mr. Rose is not an elected official, and really has no role at the Common Council. Despite his tendency to comment on non-legal matters, his sole role is as a consultant on legal issues. And since there were no legal issues under discussion last night, there was no specific reason for him to attend. And surely, if the members of the council to have specific legal questions for him, they can ask outside of the meeting just as well.

Interesting analysis. Still, I have seen Peters do some remarkably irrational things, so I am not completely convinced.
Anyway, did you see how red and tight his face got as Ron was reading the resolution? I thought the poor old guy was going to drop dead on the spot of apoplexy.
And what is up with the City Attorney's absence? Responding to a resolution like that would have been a fine time to get some qualified legal advice. Are the rumors I've heard about him true?
#16 Feb 6, 2013
There's no advice needed. The council passed a resolution not to pay anymore legal bills. They do not need legal council to do that.
#17 Feb 6, 2013
I believe he said it was out of the city's hands. I would gather that the state court will follow through anyways. It never really was up to the city how this played out, it is in the process and back room deals and favors won't stop it. This should of been squashed long ago, and handled badly on both sides. I have heard the AG is involved, and we will see how it all ends.
#18 Feb 6, 2013
Exactly. Anyone can decide at any time to drop a lawsuit. It's when you decide to continue a lawsuit that you need attorneys.
#19 Feb 6, 2013
We both know that will not happen. That's the mayor's ego talking.
It's dead in the water.
#22 Feb 6, 2013
Never seen Bobby like that. The agony of defeat!
Perhaps now he will think about what it really ought to mean to be mayor of OUR city. He has failed to listen to the people and now WE ARE ROARING.
