I agree the sentence seems harsh.
The lawyer's statements and motivation annoy me. You could probably take any make and model and year car and find isolated accelerator incidents if you dig hard enough.

You had a '61 that got totalled out? Please tell me it was a biscayne or a bel air and not an Impala!!
Sorry, it was a four door Imparl 283 with a two speed turbo glide. Light tan with a white top. I was drunk and drove it 60mph off the road into a dirt pile. What a drunken fool I was in those days. Thank God my brother, friend and I all walked away.

There seems no reason why this case should not be re-evaluated under the circumstances. If it is concluded that the vehicle is to blame, we will all benefit from having this information.

Just let him go already. Even if he accidentally hit the gas instead of the brake, which now seems unlikely, he shouldn't have got so much time in jail. Most (all?) first-time DUI offenders who kill someone get less time than the 8 years he got. Any way you look at it, this is a case where an immigrant with poor English skills got railroaded by the a justice system including a ****-poor public defender, a bullish prosecutor and a judge with little common sense. All of them should be embarrassed by the result.
Yes, this is a prime example of just how phucked up the system can be. Add to what you said the fact he would not show remorse by admitting to the crime...BECAUSE HE COMMITTED NO CRIME...then the judge dumped him in prison. How nice.

Shouldn't we wait and see what the investigation concludes first? I know that every one is growing a salacious desire to fleece Toyota and I don't care but it's my opinion that the accelerator mechanisms in the car in question in mechanical and not computerized. Then again, maybe it's Toyota's fault that time I totaled out my 61 chevy.
Oh come on they found problems with the car what else do you need...

Car and driver magazine did a braking test on several different makes of cars because of unintended acceleration. From Camry V6s to a 540hp Roush Mustang. EVERY SINGLE ONE was able to overcome the engine at full throttle and stop the car from 70 mile per hour. EVERY ONE! Now tell me how people aren't stepping on the wrong pedal.

# A worn cable assembly from the accelerator pedal to the cruise control actuator.

# A worn cable from the cruise control to the engine throttle.

# A faulty throttle position sensor.

# An engine control unit problem that could send an errant acceleration signal to the throttle.

# A loss of hydraulic pressure in the brakes.

This car was 10 YEARS OLD at the time of the accident.

ALL faults are the owners lack of maintenance.

He is innocent. No one in their right mind with a pregnant wife and kids will delibertly want to drive 90 miles and want to just crashed into another car purposely harming others....that dont make any sense to me. The law dont make any sense to me and if it was any other race...they would of got off...HE NEEDS TO BE FREED
