A former Liberty County Judge and Commissioner, and a local businessman have all been indicted in a hurricane fraud scheme in the Eastern District of Texas announced U.S. Attorney John M. Bales today.John "Phil" Fitzgerald, 51, of Liberty, Texas, Herman "Lee" Groce, 62, of Cleveland, Texas, and Mark Wayne Miksch, 52, of LaVernia, Texas, were named in a 25-count indictment returned by a federal grand jury on Jan. 26, 2011. The defendants have been summoned and will make their initial appearances on Feb. 1, 2011 before U.S. Magistrate Judge Earl S. Hines.The indictment alleges that following Hurricane Ike's landfall on Sep. 13, 2008, Fitzgerald, the Liberty County Judge, and Groce, the Liberty County Precinct 2 Commissioner, used their elected positions to fraudulently influence and award debris removal contracts to a company in return for sub-contracts being awarded to Fitzgerald's brother-in-law and businessman, Miksch. As part of the scheme, Fitzgerald is alleged to have received approximately $611,000.00 in kickbacks disguised as legitimate business transactions. Additionally, Fitzgerald is charged with the unauthorized use of a 155 kilowatt generator which was purchased by and for the benefit of Liberty County and then reimbursed by FEMA. Instead, Fitzgerald is alleged to have commandeered and used the generator to power Fitzpak, a convenience store and gas station in Moss Hill, which Fitzgerald owned and operated.

It upsets me how thing seem to be swept under the rug and people don't recognize back woods politics. people have their own agenda and the law only works according to who you rub elbows with.

i dont know nothing,an i dont condone whatwent on or do i really know. but make no mistake fitzgerald is a good man and has always been good for liberty co. he just got on the bad side of chap cain.

Liberty County's assistant district attorney is still on the job and some are wondering why. Joe Warren faces charges of tampering with a witness, making a terroristic threat and deadly conduct.n the small city of Cleveland, much of the talk Thursday is about the arrest of Warren.

"Can they trust him as a DA?" asked Cleveland resident Sheila Hightower.

"He should be on standby or something until they can clear him of that," said Sam Bass of Cleveland.

Warren is leading the prosecution of a gang rape case that has drawn national attention in Cleveland. Nineteen young men and boys are accused of sexually assaulting an 11-year-old girl. The case is so sensitive that a judge has issued a gag order prohibiting those involved from talking publicly.

But the arrest of Warren now has some of those calling for his removal from the case.

"Now you have a man intimidating state's witnesses. But this is the same man who has to put state's witnesses on the stand in the Cleveland rape case. I wouldn't trust him in any case," said community activist Quannel X.

Warren was arrested Wednesday on suspicion of deadly conduct, making a terroristic threat and tampering with a witness. The charges stem from an incident in April of last year at his home where a neighbor's dog allegedly killed one of his.
