Exotic Herbals and Botany Bay were busted last week for selling illegal incesne smoking products. I thought they would never go after that, I mean I heard it was outlawed months ago ,but they kept selling it at both stores for monthes afterward. I guess it was just a matter of time. I know everyone is like, it's not drugs- it's incense how can the outlaw it? But come on, we all know better than that. If it's being used like drugs, then it pretty much is a drug. I wonder if they got the felony charge for it, because it was moved up to schedule one controlled substance like cocanie. I guess wayne and ron are going to prison. That sucks, everyone liked wayne. That sucks for everyone. There were a lot of people going to that store. I guess its all over now.

Listen up, you fucking moron. First of all, to settle the facts:
-Botany Bay does NOT advocate the sale of marijuana at their establishment
-Botany Bay does NOT grow marijuana on their property. Period.
-This business is being charged for distribution of SYNTHETIC cannabinoids in the form of an herbal
blend.
-Yes, this blend is commonly smoked in place of marijuana. It is, however, more expensive and
less potent than actual marijuana.
-The sale of substances containing synthetic cannabinoids was rendered illegal by an EMERGENCY
DEA notice of intent. This means that, without further ruling, the ban on synthetic cannabinoids
will be lifted one year from the issue of the notice of intent.(November 24, 2011)
-This notice of intent was NOT reviewed and voted on via any sort of democratic process.
-These synthetic cannabinoids were declared to be Schedule I substances by the DEA ranking
system, with I being the highest and V being the lowest in terms of judicial regulation. These synthetic cannabinoids are considered more dangerous than cocaine and oxycodone.

So there, thats it. Make your judgements off the actual information, for heaven's sake. I personally feel that the only thing preventing the legalization of ALL cannabinoids is the inability to field test an individual to determine whether or not they are under the influence. Without that, you can't legally be charged with a DUI while 'high', and since no one should drive under the influence of synthetic or regular cannabinoids, this raises quite a bit of concern. On top of that, the production of synthetic cannabinoid containing substances is not monitored whatsoever, so that raises some health concerns.

@they sell to kids: Fuck off. If you have some legitimate facts to contribute, please share them with us. Otherwise, please spare us of your ignorant bullshit. Why don't you try reading a research article every now and then, or maybe even the judicial statutes that are at play in this situation. Oh, wait, researching a topic requires brain power: something that you clearly lack.

Reread my post. I never advocated the use of synthetic cannabinoid-containing substances in my statement. Now pay attention, because I did my homework and researched this issue before I made any judgements on the matter, rather than making irrational statements based on biased newspaper articles devoid of true facts. The reason I am concerned about this situation has nothing to do with synthetic cannabinoids (which are NOT the same as 'synthetic marijuana'. Get your facts straight) whatsoever. I am concerned because individuals are being jailed for a "law" that was enacted without due process.
The DEA issued a Notice of Intent last November that articulates the agency's desire to place synthetic cannabinoids in an illegal status. This notice serves as a mandate by the DEA which is granted to them via federal laws that provide for emergency 'scheduling' of substances of potential abuse. The scheduling of controlled substances is a guide for the potential of use and abuse of prescription and narcotic drugs, as provided by Title 5, Chapter 5, Subchapter II of the United States Code (USC). According to the Controlled Substances Act, to schedule a drug requires initiation of proceedings in congruence with the aforementioned subchapter of Title 5, which outlines the legislative process that defines what we know as 'democracy' via House and Senate rulings in order to amend any legal precedent; in this case regarding the legal status of psychoactive substances (21 USC Sec. 811).
What happened here is simple: The DEA used a provisional loophole to render these synthetic cannabinoids illegal to possess and distribute without any legislative review. This mandate is a violation of the very essence of our government -- to make something illegal without any deliberations or amendments made to current legal statutes is unconstitutional. The DEA bypassed the House, Senate, and Attorney General of the United States, and because of it, people are being imprisoned and stripped of their property. Does this sound like justice to you?
Try to think about whats really going on here; think about what really matters. People are being jailed for a ruling that the population of our country had NO say in whatsoever. To you,@Good, its your turn to be reasonable and rational. Its time for you to wake up, and read between the lines, and understand what is at stake here. Get off your pretentious pedestal and realize that due process has been ignored by the DEA, and that the arrested individuals are being held illegitimately because of this 'Notice of Intent'. Once again, I am not advocating synthetic cannabinoids, I am advocating justice.

Your condescending attitude inflates your ever-present ego here, and you dare call me pretentious? I can appreciate your quest for justice. However, your egomaniac approach confuses the issue. If you feel this strongly about it, why not crusade your way to the media? If there is merit to your claim, the courts are at your ready. My issue is that the drug epidemic is growing at an alarming rate, and those in question (suppliers) should be held accountable, regardless of the verbiage, or the lack thereof, in the laws meant to alleviate the problem.

I wonder why they hit the Bay before all the others and kept that one quiet in the media. Why are the cops trying to keep quiet what they did to those people over there?

To anyone who thinks they know anything about this then just be quiet, the bay was raided on thursday. There was nothing on the news about which means COVER UP, you know the 6 gas stations raided the next day were all over the news.......

Second stop buying into everything you hear. Everyone on here bickering about this situation and any other situation they dont belong in makes me feel pathetic to be the same race as you low lifes.

Then i would think that any store that got raided and was actually gonan get in trouble for felony drug charges wouldnt be open 3 days after the
raid........

AND FINALLY how about the BOTANY BAY IS THE ONLY POLITICALLY ACTIVE HEDSHOP IN LEXINGTON. No other shop got hit like this one, The owners of this store fight everyday to make sure people like you keep your rights and freedoms and you thank them by slandering them along with our fucked up governement.

So guys dont be blind out government and our police force are fucked up. Ang guy you can get legal herbs at EVERY OTHER HEDSHOP IN LEX cause they dont have the balls to speak out against injustices to the people.

really this whole situation is out of hand and if people will not buy into what they here and go learn for themselves then the real villains (the city of lexington) will be brought down.

When the herbal blend were outlawed Botany Bay stopped selling them. The manufacturers of these products then began marketing new blends that did not contain the banned substance (jwh-18, jwh-73, and HU-210). There is a label on the packaging that very clearly states that it contains no banned substances from the several states who have began to ban the products. And as mentioned in a previous post the sale of the banned substances is a MISDEMEANOR. And FYI there will be no more meth lab busts this fiscal year because KSP blew their budget for cleaning up the labs...so, until next fiscal year Lexington Metro is going to waste valuable tax dollars busting law abiding citizens.

YOUR A FUCKIN IDIOT.. YOU OBVIOUSLY KNOW NOTHING.The owner of the store is in the works of proveing they did NOTHING illegal and had NO ILLEGAL PRODUCTS in there store.... the lpd needs to worry about the real criminals who are actualy selling illegal drugs and leave inoccent buisness owners alone.... the woman who owns that shop has had that store for years and was never bothered...selling tabaco pipes and tabcco products is how she made her liveing and supported her family and she was doing it honestly just like she should hae been so were her employs... they were not selling drugs and the cops found no illegal drugs in the store...yet they call still charefge them with a class 1 felony?... that bull shit!!!!!!!!!. the police need to worry about the head shops selling white lightning and other "legal" narcotics... and stop worrying about the innocent people smoking fuckin plants... i mean seriously... but they wont and ALL legal inncents are now being outlawed.. guess we enjoyed it while we could...
