Prison Abuse, Torture & Deliberate Indifference
David Elie Rabie died Nov.10, 2005 under the care of Dr. Maria Marrero.

Elie lived his final 3 months locked inside a Secret Prison inside a Prison located in Lexington, KY while Maria Marrero was allowed to to prescribe a treatment plan and medications that WORSENED ELIE'S CONDITION.

The Medical Director, Dr. Grouse, watched over the process of Elie's decline and did NOTHING. The State Atty General's Office Did NOTHING when I phoned them in tears (athough their motto is "Abuse, neglect or exploitation of a patient or resident of a care facility is a crime. The punishment for this crime is imprisonment".) The warden, FBI and State Atty Office are aware this is happening but they don't care. Because the F4 Unit is a under High Security, very few people see what is happening. The ones with clearance, risk their job and their life if they report it. I have confirmed the torture and cruelty through inside witnesses and copies of medical records obtained through the FOIA.

Elie had to Pay for Oxygen during his final hours....

Before David Elie Rabi died on November 10, 2005, he asked that I put the story on the Internet to expose the Real Criminals within the Federal Medical Center Prison in Lexington KY. Ignorance and apathy by You and I has allowed this to happen. I can't move on I knowing others are still under Marrero's treatment plan inside this Hidden, Secret Locked Prison inside the Lexington Medical Facility. Something Must be Done . I am ashamed that our Country has stooped this low. I am hoping that people who read this will Not Accept this AND Report This.

Well I thought of writing to you about this place. Judge Cedarbaum ordered the US Atty to put me in the best and most suitable Federal Hospital in the system, also that all medical papers should come with me and she meant All Papers, well nothing of the sort happened, part of the papers came which is not enough for any one to make any sense of it so here they say they have to start all over again., which takes months and I repeat it is not a medical center, it is a low security prison with an infirmary (where I am). It holds 20 people with 3 nurses, handicapped with severe severe illnesses like cancer ect.. They give them medications but the only Doctors they see are local prison doctors which are all MD's with no specialty who think they understand but actually they do not specialize.
In my case they totally do not understand Pulmonary, one doctor comes once a month and will see the patient a few minutes, he comes from the local hospital. I would say in total my breathing capacity is 25% less in the last 2 months since I got here but there is no way to measure since they lack the equipment here, in fact there is no equipment worth while period. Their xray machine is at least 30 years old, the eye measuring devices are over 30 years old, the eye doctor who comes once a month agreed with me that it is so.
The doctor in charge in my case is an MD, although she is probably a nice person, we do not see eye to eye, she even thinks I do not need oxygen. She thinks she understands all about lungs but actually she does not. I told her there is no sense to see her since she comes once every 10 days, in conclusion the US Atty did exactly the opposite of what Judge Cedarbaum ordered. I feel honestly that they delibertly put me here to die, so many die in this prison, but it is all covered up from the Inspectors and I HAVE A FEELING THEY KNOW ALL ABOUT IT. Here if one is healthy he will survive and if not will die, for lack of medical attention, like my neighbor. He had an infection in his Toe, but it was too late to have treated properly, now they will Cut it out. When I came here after 2 days the fellow across the room from me died, they just put the sheet over his head and left. No one knows whether he could have been revived.
I have to be transferred now into a proper Hospital and certainly not in Kentucky. So I have to fight now, I never wanted to expose the federal prison system it isnot something I indulge inbut to survive I have to. If you can publish this letter AND SOMEHOW HAVE SOMEONE PUT IT ON THE INTERNET AS A BLOG IN MY NAME. I am not afraid, the thing that worries me is if I go into a Coma like 3 years ago, they will not be able to bring me back, they do not have the equipment, and not enough time to go to the hospital.
The federal system has proper hospitals, I've heard Butner in Carolina, or they have also in Florida, also maybe this should be sent to Judge Cedarbaum because I don't think she received my mail.

The oxygen here is not 100% oxygen, it is a processor which takes local air and converts it into 75% oxygen so breathing will come difficult and liable to get infections. If I go out for fresh air they give me a tank if they have one but the program lady has to be with me for one hour, I cannot go outside like every one because they will not give me a tank on my own like when I was at Westchester Medical Center - NY.
I can write a book about this place, and for the life of me I cannot see why they call it medical, I presume to get more budget money but not spent on the prisoners. The food is terrible mostly potatoes, beans and rice with a little uneatable meat. Imagine in the mornings breakfast 4 times a week is potatoes and bread and white something of paste. I would like to send a copy to Senator Clinton and maybe she can open and investigation.
One of the preachers told me confidentially that he was told if he will talk about medical , he will be fired and should stick to religion only.
Here the nurses are very nice, but what can they do, they do not have the authority to do anything besides give medications and have to do what the doctors tell them to do.

I spent 7 years at fmc lexington federal medical center and

can agree with these posts. i worked on the hospice team so i spend many hours on the hospital unit f4. this is a real joke of a hospital. the unit holds about 30 to 40 inmates depending on how they pack them in. i watched men die every month some who just gave up on life others who lacked the best medical care for their condition. i saw the lack of care, lack of staff to handle the inmates. there were inmates who worked to keep the hospital clean and help the nurses by changing bed sheets and keeping water filled however i hate to say it but most of them would only watch tv and sit in the a/c in the summer. i came to see one of my patients only to find ants on his face and up his nose and dirty diaper. the man was dying and someone tryed to give him coolaid to drink and spilled it then the ants walked down the call button cord and on to my patient. the hospital care is a joke.



An outside hospital would be shut down and all over the news but they are only inmates. This was my first time and i know manyinmatefamilies do not know these problems. thanks letting me air.

Lawdog, he was not a murderer or a violent criminal. He was not sentenced to torture or murder but behind the closed doors of the f-4 unit, there is foul play.

Here is one of the many letters I received from an inside witness:

I am writing to express my sympathy in regard to mr rabi's death. I met him here at the fmc when he arrived from ny. I started talking to him everyday when he came to the recreation yard. I am a doctor. Rabi was in good spirit and health when he arrived here. Then later on he started to complain about the medical staff, how bad they were treating him and avoiding his needs. Including he was complaining they were not giving him the right medications.I can't give you more information without a lawyer present. I am sending this letter through my atty. Future will tell how bad Rabi was treated. I know he is in a better place.

Elie Passed Away on 11/10/05. He spent his last week gasping for oxygen and pleading to be transported to the ICU at the local hospital for help. Elie wanted to Live but he was severely dehydrated and cruelly treated by the staff who made mean sarcastic comments, cut off his phone and family visitation during his final days. The staff locked him in an isolation unit and even the hospice worker was denied to see him during his final days. Records state 73 year old Elie refused medication but insiders say "it didn't happen like that". Elie couldn’t swallow due to infection that had spread to his throat and mouth. He begged for intravenous antibiotics but the cruel Marrero said NO. She insisted he swallow his 14 pills per day. Elie could not so he begged for 14 days for and IV. He was finally transported to the Emergency room only 30 hours prior to his death.
It is time to Stop the Torture in US Prisons that WE ALL KNOW ABOUT!
The Warden, the BOP, the Judge, FBI and many others were notified by Certified Mail, Phone Calls, Emails and Faxes 10 – 30 days prior to his death
Not one letter was responded to.
No one contacted me when he passed..... Insiders have agreed to testify that Elie was abused and tortured. He had to Pay insiders to sneak him Oxygen during the final 2 weeks.

LAW: Deliberate indifference to serious medical needs of prisoners constitutes the 'unnecessary and wanton infliction of pain' proscribed by the Eighth Amendment." A medical need is considered "serious" if it "causes pain, discomfort, or threat to good health." Financial constraints may not be used to justify the creation or perpetuation of Constitutional violations.

The mission of the Kentucky Board of Medical Licensure is to protect the public by ensuring that licensure qualifications and standards of medical and osteopathic physicians are met and that appropriate disciplinary action is taken in a timely manner when violations of the Medical Practice Act occur. The Board is also responsible for the regulating of qualified physician assistants, athletic trainers and surgical assistants practicing in the Commonwealth.

Abuse, neglect or exploitation of a patient or resident of a care facility is a crime. The punishment for this crime is imprisonment.(From the Office of the KY Atty General)

Please take the initiative to contact the KY State Medical Board to report the neglect and abuse going on inside the F-4 Unit. Contact the Media to investigate this further and to Expose the Truth.

Please report that patients are dying under her treatment plans.Ants crawl over dying patients and there is no air conditioner. The working staff stays in the Air conditioned TV room during the summer while the dying patients lie steps away in soiled diapers suffering from pain and torture. Locked up away from society, away from their family behind closed doors where visitors are not allowed.

To Whom It May Concern:
I would like to report that David Rabi Inmate # 54385-054, who is being housed in the F-4 Unit of the FMC Lexington 3301 Leestown Road, Lexington, KY 40511 is not receiving proper medical care. If Mr. Rabi falls into a coma and/or dies, I want the FBI to investigate Mr. Rabi’s death as a homicide and his case reported as a Civil Rights Violation.
Mr. Rabi is 73 years old and suffers from emphysema. In early October Mr. Rabi became ill – Despite numerous requests by Rabi and myself in writing and by phone (see attached) The FMC Lexington, continues to provide contrary information about Mr. Rabi’s medical condition. The staff is reporting his condition to be stable when in fact Mr. Rabi is in significant pain and his medical condition is continuing to decline.
My signed affidavit (attached) confirms my belief that Mr. Rabi is seriously ill and that he is not receiving the medical care he needs to stay alive. Phone transcripts can prove that Rabi was seriously ill during the last week of October and that he made several calls to me for help. The phone records will also prove that Rabi was so weak the officer had to make the calls on his behalf to me. The phone records indicate that the officer was aware of the cover up of Rabi’s condition. I believe the Officer was truly trying to help Rabi call for outside help. I asked the officer why they weren’t doing anything and he replied “I am afraid to say anything since I will get into trouble - these phones are recorded.
Mr. Rabi has told me by phone and letter that he has witnessed wrongful deaths at the FMC Lexington. Inmates are being left to die without any efforts to save their life and to provide them with emergency treatment. Inmates are dying and no attempts are made to transport them to an acute care hospital / emergency room or to save their lives. He is reporting the doctor treating him as being evil and operating under her husband’s license (Dr. Morrero). He reports it is a big cover up inside the walls of the FMC f-4 unit. He asked that I contact Senator Hillary Clinton to request a formal investigation of this horror show.
Mr. Rabi reported they had locked in a room by himself in 90 degree temperature without ventilation and a semi-oxygen tank for breathing – He believed his oxygen lung capacity diminished by over 50% and continuing to drop. He reported to be suffering from significant pain and discomfort and believed the staff was not only treating him with deliberate indifference to his medical needs, they were purposely denying treatment and causing deaths. Mr. Rabi even told me a nurse made a comment to him “that he was Next”. He believes the Doctor treating him is incompetent and that she is deliberately prescribing medicine that is worsening his condition. Mr. Rabi refused to take the medication which is worsening his condition and he stated this Doctor already killed 8 people. He also told me that she was working under her husband’s license. Since Mr. Rabi was struggling to breathe and to talk to me, it was difficult to understand everything he was saying but if you can get a transcript of the phone records you can re-confirm the statements I am making. You will be able to confirm the inmate’s medical condition did not sound “stable”.

FBI did nothing. Patient died on November 10, 2005. Patient was not taken to the Emergency Hospital Until November 9, 2005. Warden Dewalt reports the patient was not in critical condition when he was taken to the outside hospital so he was transported in a regular vehicle, not am ambulance.



Dave Potts was assigned the case. I followed up with him by phone a couple of weeks after the death. Mr. Potts told me that records showed that Elie was transported to the hospital several days before his death therefore he could assure me that Elie was given proper Medical Care. Later when medical records obtained from the FOIA were released, it showed this was untrue, Elie was not transported to the outside hospital until 30 hours prior to death. Was Mr. Potts lying or just careless in his reporting? Mr. Potts told me that he knew the medical staff personally and that he was "sure the patient received propercare therefore further investigation was not needed" . He went on to say "I have been inside and the floors are very clean, you are just going through the grieving process and it will get better. He went on to say their was no investigation by the FBI because higher ups had declined my request. Mr. Potts even laughed when I told him that Elie could not get a Bible ... He said "all inmates are the same, they make up things because they just like the attention."

Reading his letter takes me back. i was there for 7 years and have been out for 1 1/2 years now. i really hate to tell you this but not one word of what he said is a lie. he is in the hospital unit which houses about 20 special needs inmates. i spend several hours a day taking care of inmates there. they only allow inmates that are on the hospice team to enter the hospital so most inmates do not see what goes on there. there are two female doctors on staff of which both are nice but only one is board certifed and she has only been out of school for about 3 years.

FMC LEXINGTON IS A POOR HOSPITAL. I SAW SOME REAL UNHEALTHY THINGS GOING ON

I am writing to you to report a serious health problem at the Federal Medical Center in Lexington, KY. I am specifically inquiring about the F4 Housing Unit. Since you are the Public Health Director for Fayette County I hope you will help me. My previous reports to the Federal Authorities remain unanswered.

The F4 Unit is the medical housing unit for terminally ill patients incarcerated at the Federal Medical Center in Lexington KY. The F-4 housing Unit is a Locked Prison inside a Prison. The F-4 housing unit is under tight security and accessible only by certain people including Medical Staff, Correction Officers and a few hospice workers.

The majority of the residents inside the F-4 Unit are non-violent, elderly patients with terminally ill health conditions. These patients are not carriers of contagious diseases so it is unclear why they are housed under such tight security.

Several Insiders have reported to me confidentially, MANY VERY unhealthy things going on inside this F-4 Unit. My concern is that because the F-4 Unit is only accessible by select FMC Staff, there is not any way to know if the F-4 Unit is abiding by local, state and health laws?

It seems to me that this type of setting would become a natural breeding ground for wrongful deaths, abuse and neglect, unless local, state or federal health departments could make routine unannounced visits to inspect these facilities.

What check and balances are underway to ensure the elderly residents are not being abused and that this medical housing unit is meeting the legal requirements to operate as a hospital?

Mr. David Elie Rabi, my dear friend, was transferred to the Lexington F4 Unit in August of 2005. Mr. Rabi’s health declined rapidly after arriving – he died Oct 10, 2005, 3 months later. I was very upset when Mr. Rabi told me about the conditions inside the F4 Unit so I have spent the last eight months, investigating and I have confirmed through several insiders and medical reports that it is all true.

Mr. Rabi was mistreated by an Unlicensed Doctor by the name of Maria Marrero. Marrero did many cruel things to Mr. Rabi including taking away his oxygen to see if he was faking.(Mr. Rabi was Oxygen Dependent). Insiders reported to me that Mr. Rabi had to pay for oxygen to be secretly brought to in to him during his final days.

I have also confirmed, that the health conditions inside the F4 Unit are atrocious.

Since you are the Executive Director of the Ombudsman, I am hoping that you can investigate my complaints. My previous complaints to the federal bureau of prisons have remained unanswered. I am now on the eighth month of investigation and will continue my letters until this facility is open to inspection by the media or completely shut down.

Why is an unlicensed doctor treating patients? Why are terminally ill and elderly patients locked inside a prison inside a prison without any chances or hopes of getting help? Why are sentencing Judges sending terminally ill patients to this hell hole of a hospital or is it a Secret Prison in the USA that even the Judges are unaware of?

Reports of abuse, neglect and death are easy to obtain through the FOIA. Most of the patients never make it out of this torture chamber alive to tell their story. Visitors are not allowed in and AD Proxy Decision Makers are Locked out.
