I do not know what happened, I was not there. I also do not know either person involved, being the officer or the citizen. I am not going to judge either person. I read this thread and hear, LPD better have a use of force policy. Well, all police departments follow the same guideline. Look up Tennessee v. Garner. This deals with how police should handle use of force situations. Read up on it, and you can form your own opinion. I am not going to offer mine, mainly, becuase I have not read up on this incident much.

Dave you are 100% correct, however reading it only gives you a general idea behind the TN vs Garner ruling. However, each case is and always will be different and needs to be investgated by an outside agency due to the vested interest in the policing authority. Interested in seeing how this turns out.

Also in any case where a jury is dismissed it is usually due to a deal, plea or withdraw of charges. Pleas are needed to prevent the waste of time and money for the county, ie..the Frankhouser case. Any attorney with average intelligence knows when a case can't be won therefore he gets his client the best deal. Again ie...the Frankhouser case. It makes sense and has its place. I'm glad to see Molek is keeping with past practices...

But Concerned during the campaign claimed that the previous DA accepted pleas in over 90 percent of the cases. She said her boy Dave would never do a plea. Obviously she lied, I guess she has Egg on her face

She didn't lie, she was just uneducated about the criminal court process. She was too wrapped up in what was going on in her personnel life. Happens to a lot of people when their family members commit crimes. It's obvious by her post it is still eating her up inside. I feel sorry for the family members, they are the ones most effected, but not the criminals. Oh well this topic is getting old.

Shooting of unarmed civilians. It said in the lewistown sentinel that he was UNARMED. And you're telling me that they couldn't restrain him with more than two officers? BULLSHIT. The officers are shit. I'm sure ANYBODY would go down after ONE shot in the STOMACH!! So shooting him twice sounds like an excuse to defend the police? I don't think so. It said in the lewistown sentinel that he was pulled over for "Probable Cause/Probation Violation" but it was stated that they found nothing on him. The officers are pieces of shit, and if you see the shit they pull, you'd be disgusted too. I live in this town. No matter what any of you think or say, disagree/agree with me (which I'm right, sorry to say) you're going to have to worry more about a cop shooting you and having it "justified" than you would a heroin addict here killing you to get their fix. Something REALLY needs to be done about this town and this corrupt, greedy, sick and twisted government they've established here. Absolute power will corrupt absolutely. I'm waiting for the day that they shoot the wrong person that has a lot of money. I'd like to see them try to pull that "Justified" bullshit again. Sorry for my outburst, but it's shocking to know that someone, who when you were little, you were told about how they would protect you and keep you safe, would shoot people now and get away with it.

Glad I don't live in Lewistown. This is what happens when an under educated and under trained police department is formed. From what I understand the Regional police handled this same subject as he came at their Officers WITH a weapon. They were able to use the resources that they were trained with without using deadly force. This is the difference between an experienced department and a new department. It will take many years for a new department to reach this level of professionalism. If it was justified then let it go, as you will only tear yourself apart and remember just because it was ruled justified the victim of the shooting can still seek civil recourse. The burden of proof is less and the scales of justice only needs to be titled in ones favor, not beyond reasonable doubt.

Nope!!! They DO NOT have the right to shoot an un-armed person. PERIOD!! This was the result of a neanderthal police department. I don't care what their protocol says, I don't care if you think they did right. Anyone with half a wit KNOWS you do NOT shoot an un-armed person, PERIOD!!! It is their damn police state mentality. I think the officer should be charged and locked up.
