Police say pick-up truck struck, killed man

This man was my brother. He was loved and will be missed. The driver who killed him is lying though his teeth. The area he was hit is well lit and wide open. Neil did not dart out like a deer would. He would have been seen. We have heard that the man admitted to a few beers. Every drunk in the world admits to that. If he had turned around to check he also would have been seen. Also the autopsy revealed Neil did not die instantly. I want to know why this man is being protected?

Our family has still not recieved answers.
My family is seeking honest answers about his death and not receiving them from the sheriffs' office.. We have heard so many differing stories from the sheriffs' office we don't know what to believe. I was personally told by Randy Baerlocher that at 10:20 pm Neil was stopped by the city police walking in the middle of the road in downtown Grayling very intoxicated. First of all we need to know why he wasn't arrested at that time. In the newspaper report , Mr. Baerlocher stated that according to the law my brother couldn't be arrested as he was not disorderly. Well I know that's not true. If someone is posing a danger to others or himself he is breaking the law and should be arrested, and if someone is staggering in the middle of the road he is a clear danger to others and himself.

The information we have received from the police is completely inconsistant.
Mr. Baerlocher told me that my brother was hit between 3 a.m. and 5 a.m.; then other family members were told it happened at 10 :45, a mere 20 minutes after contact with police. We were told he was killed instantly then told he was not. I was told that man that hit him turned himself in after hearing about the investigation, then read they found him because of paint chips. I was told the man who hit my brother believed he hit a deer; deer dart out in front of cars, a person even if staggering would be seen. I have seen pictures of the scene and my father has driven past the area at night; it is wide open and well lit. There is no way the driver couldn't have seen him. I was told he was thrown off the road over a snow bank. The picture shows clearly that this snow bank is only a few inches tall, anyone looking for something they hit would have seen my brother. I can understand anyone else driving past not recognizing him as a person but not someone who knew they hit something and was looking for it.We were told visibility was reduced due to snow, I checked the weather history and that night the visibility was 10 miles at 10: 34 pm. I firmly believe the driver knew he hit a person and went home to sober up.

It seems to me from talking to Mr. Baerlocher and reading the reports, the police believe Neil was just a drunken drifter and they are protecting a lifelong resident. Please don't allow this to happen, Neil does matter!

You may not know the whole story you were not there neither was I but I know when the weather is bad at night it is a whole different story of what you can see.

I checked the weather history and that night the visibility was 10 miles at 10: 34 pm. The weather was NOT bad. Check the weather history yourself! The Area was well lit and the driver had no business driving without a license and no insurance, and most likely drunk. Now we have to wait until Sept for his trial. It's just ridiculous!!!

He is being charged only with leaving the scene of accident causing a death while at fault. He stood mute on the charges and a jury trial is scheduled Sept 13.

Just in case anyone is still interested, the jury trial has been moved till the 28th of November. Believe it or not his lawyer and the proscuter need more time. This happened in January! I just can not believe it!

I can't imagine the turmoil you and your family must be going through. I'm sending happy thoughts and prayers your way.
Good luck with all of this and remember the happy times you had with Neil and don't let this court stuff overwhelm you. He would want you to be happy.

Sorry so late getting to this but thank you for the thoughts and Prayers. Your not going to believe this but it has been postponed again!
Now they say late Jan. or early Feb. A full year after my brothers death. I hate this!

WHY IF YOU KNEW HE HAD A DRINKING PROBLEM DID YOU NOT HELP HIM? IT IS NO ONES FAULT THAT YOUR FAMILY MEMBER WAS KILLED. GOD HAS YOUR FAMILY MEMBER NOW BE THANKFUL FOR THAT. RIGHT KNOW HE COULD BE A VEGITABLE HOOKED UP TO MACHINES ETC... PLEASE FOR HIS SAKE REST AND DON'T FORGET HIM. THINK OF THAT FOR A MOMENT. LIFE TAKES ITS TOLL ON EVERYONE. Wow I just got back to this. Wondering who the heck are you to judge. Have you ever had a family member with problems? If you had you would know you can't be responsible for their behavior. Besides according to the police My brother was not a danger to himself. They seen him 10 minutes before he was killed, he was not the problem. The man behind the wheel was. He was drunk and high and driving too fast. My brother may have been drunk but he was doing as you are suppose to when too drunk to drive, he was walking and the grayling police stated he was not endangering himself or others.
I'm sorry you have been to two funerals but so have I. I just watched my husband die of cancer. I have to wonder if his passing would have been easier if his friend and my brother could have been there for him.

I feel for you my brother was killed 2/2/08 in lewiston and them bonehead cop dont know their head from their ass they said he was on the road but the injuries showed he was hit in the side and broken leg. private investagator is checking this out and a lawsuit will be filed on mt. morency county police dept.

What if workers have to be union?Who's going to operate everything when they go bankrupt?They will you know.When's the last time anyone in Grayling got up at 4am? Huntin season...This is just the thing that will start arguments.Grayling seems content being a retirement town.Most of the younger people are pretty much gone when they graduate.They get an education so they don't end up working in an amusement park.Can anyone support it? BK

The trail has again been postponed. Its now in May. one year and 4 months since Neil was killed. So much has happened since then that he missed to to this cowards actions. Our mother died my husband who was Neils best friend was diagnosed and suffered for months with cancer...
Those are the biggies. Because this "man" chose to drink drunk with no license and no insurance.
This may sound terrible but I hope this year has been twice as bad for him as it has for me and my family!

Also wanted to correct my mistake he didn't drink drunk ( well he probably did but..) he drove drunk without a license and no insurance. They can't prove he was drunk because he ran like a coward leaving my brother to die along side the road and not be found for hours.

We just were informed today that the charges have been changed. Its still a 15 year felony but now they have changed the charge from leaving the scene of a fatal accident while at fault to driving without a license and causing a death. This after it has already been over a year? And the process will now start over at the beginning. Wow I wonder who he knows?
