LCUB hires attorney in response to Wampler controversy

City Attorney Shannon Littleton, who is also the assistant general manager of the utility board, was deemed by the board at Monday night’s meeting to be essentially too close to the situation to handle potential legal action related to threats from the Wampler family to withdraw their company from LCUB-provided services. According to Family Brands International, LLC President John Edd Wampler, LCUB is charging far-too-high water and sewer rates for two of his family’s businesses — Elm Hill and Wampler’s Sausage Company — and the family is considering moving out of town in general to avoid paying 82 percent higher water rates and 88 percent higher sewer rates. Out of 19 attorneys, nine of which had cheaper hourly rates, a motion was approved to obtain legal assistance — at a cost of $200 per hour ($400 per hour with an assistant, said board member Tony Aikens) — from C. Coulter “Bud” Gilbert of the legal firm Kennerly, Montgomery & Finley, P.C. “I feel that we just need to have a legal representative,” said LCUB General Manager Freddie Nelson. Aikens noted Gilbert has worked with the utility board before, as well as the city — and that he has also stood in opposition of each. According to Aikens, Gilbert represented Dixie Lee Utilities and then sometime later represented the Solid Waste Committee in suits against the city or LCUB. “If you’re going to hire somebody,” he said, “hire somebody that doesn’t have a conflict.” He later questioned why money, if it has to be spent, isn’t spent on finding a solution to the problem, not additional legal advice.

The real reason they aren't using Littleton to represent them is probably that they are afraid the case will actually go to court.
I doubt Littleton has ever done that.

He would just settle out of court with LCUB paying the Wampler's a big old settlement and still losing their business. I would be scared to death to let Littleton represent the utility. I am scared to death because he is even the second in command at LCUB.

Nelson and Littleton are both jokes and a disgrace to LCUB. LCUB will be in court in a short time. Bankruptcy Court. Wonder if Littleton will handle that case?

The problem is that when this goes to court, LCUB will settle, but us poor slobs that have them for utilities will be the one to pay the price. Just like TVA's ash spill, all they will do is to raise their already ridiculous rates, even higher...to compensate for their loss:-(but I have my fingers crossed for Wamplers!!

It's not just Wampler's. It IS Lenoir City residents as a whole that are paying way too much for water and sewer.

I don't live in the city, so I don't have the same water / sewer issues as some of you have posted. I'd just be happy if LCUB could just keep the damn electricity on consistently. It isn't just once in a while, it's all the time. Brown outs, power-blips, surges; they're just killing my appliances and electronics. I've put UPS's on all the really sensitive things like computers, but you can't protect everything. Once again last night, power goes off for 2 hours and then turns off and on for hours after that. It's just ridiculous. I've spoken to them dozens of times and they assure me its just squirrels. The place is run by a bunch of incompetent good ole boys and they have us over a barrel..

Have you checked the weather lately, dummy? Rain, ice, & snow yesterday-DUH! If you can't handle the weather or a few country squirrels-have you thought about moving???
I've lived here for 40+ years & got no complaints with a few outages occassionally. Everybody has a gripe about the costs-so go gripe at TVA since they are the providers.

It kind of sounds like you may be the dummy. TVA has nothing to do with line maintenance and substation maintenance which is what causes most of the problems. Also inept employees and leadership. It kind of sounds like you may be one of the inept employees. I've checked the weather and what I'm talking about has been happening over a long period of time beginning last summer. Before an honorable, intelligent being would resort to ugly name calling, one might want to read the post in question. The poster said "last night"-outages again, etc.-last night-the one in question there was considerable ice, snow & rain which could have caused/contributed to the outages. Poster also complained about costs-which directly reflects what we-thru LCUB-pay TVA for generating & transporting the power to local utilities. No, I do not work for any utility board, however I know LCUB is in the process of upgrades to the existing power stations. They work hard to make things operate more effeciently. I didn't realize longevity made you smarter, you must be the exception. It just made you a smart ass. I have all my teeth-wore braces for years, mamma saw to it since she worked for a local dentist group, I am female, but if I go to hell, I'm sure I'll see you there.
