search warrents/meth/terry blanton/crooked cop

well i would like to ask everyones advice that i can.. and it has to do with TERRY BLANTON!!! here is the story that i know so far. My friends boyfriend had a bench warrent for him and david colston came to the door asking for him and she said he wasnt there, well then he asked if he could come in there and look and she said no not without a search warrent, then explained to the officer that they have been harrssed already. well after she told hey boyfriend about it, he went ahead and turned his self in. when his girlfriend returned home there was a cop outside and she told her she needed to get in the car that she could not go in her home that terry blanton was in the process of getting a search warrent. Well after her sitting in the police car in front of her home terry finally arrived with a search warrent.. when they went in her home they made her sit in the living room and not move... everytime she tried to get up to go watch them search her things the other officers and terry told her that she needed to sit down. well they walked right back to there bedroom and found an item due to meth... her boyfriend was already in jail and then took his girlfriend to jail knowing that she is 8 months preg. and has had nothing to do with that crap. when they took her to jail terry told her the only way she would go home is if her boyfirend confessed and said that it was all his... well after terry went to the mens jail and told her boyfriend that his girlfriend was in jail and he either confess and say its his or they woould both have to do time.. her boyfriend said that it was all his so they charged him with manufacturing meth. and let her go home... people have told me that terry is a crooked cop. do you think that she could atleast appeal illegal search and seziure. and if his case is even fightable.. does something seem funny to anyone.. i just need some advice..

The cops were looking for my friends dad. They had a warrant for his arrest. The address on the warrant was for my friends home. The cops went in and searched for him. He wasn't there, he was already in jail. Yeah you would have thought they would have already knew that. When they searched the residence they found some stuff. A roach and a burnt foil. Any who it got dropped because it was illegal search and seizure because that was not his residence. He was not there but they also didn't have a search warrant.

In almost every home you would find something to do with the manufacturing process. Granny likes to can the fruits and veggies from her garden.(the jars) Extra tubbing from your fish tank. That bottle of liquid fire that has been under the bathroom sink ever since you have been a little kid. Everyone has allergies it seems so you might even have sudafed.

The thing is granny probably would invite them in and offer them a snack. Her reputation is decent and she has not been know to associate with shady people. So they wouldn't think anything about her having that stuff.

While I do commend your friend from standing up for herself. I know for me personally the cops have always wanted to come in and have a look around. I have a past. I let them in though.

I don't know about the not letting her get up part though. That seems like standard procedure. I have never been allowed to get up and follow them. When they search your car you don't get to watch. So I don't know.

The best thing they can both do is lawyer up and shut up.Especially him since he's in jail. They will/do/can listen to phone calls and read ingoing and outgoing mail. I also wouldn't share details of said crime with other inmates, I don't care how good of "friend" they are.

Im not seeing where he even has a case against Blanton.

He had a legitimate search warrant. They went to the house to search the place for meth. Did you ask where the probable cause was for the warrant?

Regarding the meth precursors, yes, it was in their house. They were BOTH in possession of the stuff. Unless someone steps up and says "hey, its mine", EVERYONE in possession goes to jail.

If they didn't have a search warrant I'm sure with a good lawyer he might be able to change things. The question is was it precursors, intent to, or an actual lab. Before old boy confesses to ANYTHING he needs to speak to an attorney, a real one not a jail house lawyer. Although some of them do know a lot of the legal system. If he confesses to manufacturing he is screwed plain and simple. Lawyer, or start waiting for plea bargains. Confessing to anything now would be stupid, he needs to wait for the motion of discover. Lawyer, lawyer, lawyer, do not talk.

First of all, how could it be illegal search and seizure if there was a warrant to search the premises? They got the guy, but the evidence was in the house. She lived with the guy. Do you honestly think she didn't know what he was doing? You act like she's a poor innocent victim. She's guilty too. Pregnant or not, she deserved to go to jail. Her baby would be better off if social services took it away and gave it to a good home instead of being raised by druggies.

When the police find evidence why is it all of a sudden THEY are wrong. If you do the crime you do the time simple as that and what the hell are people having babies when they are doing the crime. Another child born into welfare city. Doomed from the start.

they did give her a drug test and she passed it and so did her boyfriend

They can do chemical test on the inside of the house to see if they had been manufacturing. Just because you make it doesn't necessarily mean you use it.
