A motion filed by Tony Tillman, the defense attorney for Justin Sizemore, to quash, or to void, the charges against Sizemore has been denied by 30th District Judge James Mitchell.

Sizemore's trial is scheduled to begin on May 14 in 30th District Court.

What are the Sizemore's are going to say next?????

SIZEMORE'S will speak the truth,,,as they always have.I believe th judge said he wished the 3rd circuit court could rule on it instead,but it would take two weeks.he didn't want to dismiss due to how it may look on him! Once again,an elected official falls to th whims of people who voted him in.its NOT over by a LONG shot.KARMA has a way of biteing back.PEOPLE who take an OATH should follow th LAW,not the people.my o my,,,,good thing Sizemore isn't from Leesville!

LEESVILLE -- A motion to quash the indictment in the murder case of Justin Sizemore on the basis of double jeopardy, filed by his attorney Tony C. Tillman, has been denied in 30th Judicial District Court.

The hearing on the motion was held this morning before Division "C" Judge James R. Mitchell.

Sizemore, 24, of LeCompte, is accused of helping his girlfriend kill her estranged-husband. He is charged with second-degree murder in the June 2010 shooting death of 22-year-old Christopher Sean Hoffpauir of Leesville.

Sizemore's trial date is fixed for May 14, Mitchell said at the close of today's hearing.

Hoffpauir's estranged-wife, Krystin Hoffpauir, was also charged in the death. She pleaded guilty last June to manslaughter and testified against Sizemore.

Sizemore went to trial twice. One trial ended in a hung jury, and the other resulted in a mistrial.

A mistrial was declared in February by Mitchell because he found that certain information was withheld by the prosecution from the defense in the case.

Tillman's quash motion alleged that the prosecution displayed "bad faith conduct" during the February trial that ended in mistrial.

The prosecution, represented by Clifford R. Strider III, denied that assertion and dismissed the constitutional overreaches cited by Tillman in his motion.

Mitchell ultimately found that there was no evidence presented to support Tillman's "bad faith" claim and therefore, denied the motion.

Tillman had also filed a motion for a change of venue, but withdrew that filing today.

AND PLEASE PEOPLE, he knew her 13 days,went out 6 times,three of those was family,SHE was NOT his GIRLFRIEND!

According to court records it was longer than 13 days, but whatever. Drugs are a son-of-a-gun. Sorry I had to use that term since topix wouldn't let me use my original word last wednesday.

AND YES THERE IS PLENTY OF BAD FAITH......for starters,,,you don't hold bad the star witness's absolute statement from...he came out of th trunk into th back seat to the day of trial,,he ambused chris...REALLY......justice MY ASS!

Hopefully,th next trial, they will show the video, in which she re enacts her first STORY of how JUSTIN came out of the trunk an shot chris.,an signed an affidavit.. she was informed by ortez, after checking out th car it couldn't be done,.then she took the stand,,,BOOM,,,,new story of how JUSTIN ambushed chris......so who is wearing BLINDERS,,,and oh yeah,,,she yelled out someone other than justins name.....great acting,,,,,bravo!

Sir I have no idea who u are or that u know anything about these posts. U stated that I was desperate because i used two words. Ignorant and moron. OK, fine. Moron may have been a tad overboard but by no means was ignorant. And I was referring to people who post about Justin sizemore being guilty. These are the people who fail to be rational and look at the facts. That is ignorance no matter how u chose to look at it. I haven't read one legitimate comment as to his guilt. Please find one or have someone post one.
