Will everyone that can, show up at the next Russell County Board of Supervisors meeting and ask the board to build a WEB site that is equivalent to Washington Counties. They received a grade of "A+" and Russell County received a grade of "F".

As of right now Russell County's site is not even working.

Remember back a few years ago when the paper did a special report on conflict of interest and Jon Bowerbank was the ONLY ONE on the board that have completed and submitted his conflict of interest report and ALL are required to submit such report by state law.

Last night's meeting did not go well with the Board of Supervisors. One of the Board members stated, "our county is in hanging in by a shoe string". Another one replied, "we are running a 2 million dollar deficit, with a 22 million dollar debt". The head of the supervisors acted like a power happy, "cannot be touched", person. He would not let any citizen speak when it was talking in the favor of the citizens. He would even laugh at times. He was very rude. Our website will post the audio clips from each event in the next few days. We will let you know how arrogant the head of the board is, just by letting you listen to him at certain times during the meeting. So lets get this picture right from your website with a real situation. Some land was sold in a rural neighborhood. The restriction for the land sold has been no trailers period since 1970. The land is sold, and a "manufactured home" is put there. The neighbors call the county saying it violates the restriction. So what you are saying come tax time when all the other real house's taxes go up that the "manufactured home's" taxes should not because it is a doublewide. Total BS you can also move to Northern Virginia and pay $250,000 to $350,000 MORE for the same house you have in Lebanon.

We are still running at an approximately 1,000,000 long term debt each year and are in dept approximately 21,000,000. You can get a copy of the minutes at the courthouse or at the Board of supervisors at anytime and it contains all that you want to read. But each hearing I go to, they say, our budget is being held by a shoestring. We have it all on audio.

Trust me, we have a very good attorney working with this issue: read the law CAREFULLY:

Virginia code of law: 36-85.16.

"
Manufactured home" means a structure constructed to federal
standards,
transportable in one or more sections, which, in the traveling mode,
is 8
feet or more in width and is 40 feet or more in length, or when erected on

site, is 320 or more square feet, and which is built on a permanent chassis and

designed to be used as a dwelling with or without a permanent foundation
when
connected to the required utilities, and includes the plumbing,
heating, air
conditioning, and electrical systems contained therein.

Then we have the DMV portion for doublewide owners that have a title in
hand or in a bank:

Manufactured
Home to Real Estate
To attach a manufactured home to real estate your DMV
Virginia title must be
cancelled. To accomplish this cancellation,
you may surrender the Virginia
title to DMV. You will also need to retain a
photocopy of the title being

surrendered.

Once the manufactured home
has been attached to real estate it cannot be
converted back to a vehicle
status. When purchasing a manufactured home that
has already
been converted to real estate, the ownership shall be transferred as
real
estate only, per the Code of Virginia:46.2-653. A Virginia
title cannot be used to
transfer
ownership.

Once the Virginia title is
cancelled, DMV reports the title cancellation to
the Commissioner of the
Revenue (COR) in the appropriate locality. The COR will
then assess
taxes on the manufactured home as real estate and not tax it as
personal
property, as is done with vehicles.

So according to state law, ALL, doublewides and singlewides are considered manufactured homes, UNLESS you have surrendered your title to DMV with a photocopy of it being surrendered, then it is attached to real estate. Once it is real estate, it cannot go back. So if you have a double wide and your title is in a bank or in your lock box, it by law is not real estate, it is personal property. And will not appreciate 200%, like some did this year. We have spoken to well over 1000 double wide owners and they ALL have their titles, but their, "manufactured" home is being taxed as real estate. And being taxed WAY to much! Under this law you cannot separate the definition of a singlewide, doublewide, or multiple section wides. If you have a title, it is not real estate, and this is why we are going to Circuit Court with this problem

Then what you are saying is that no one developing land has the right to put any restriction on property forbidding a trailer of any kind. So when you read a real estate being advertised for sale with restrictions you do not have to adhere to those restrictions. You can buy the land and despite restrictions stating different do what you want.

When you are putting up zoning restrictions, you can restrict anything the owner so desires. Flags, outdoor animal (as is one of my zoning issues for my rental real estate). We are just trying to get the county to adhere to state law when it comes to mobile homes. The law I posted is same and simple. We will be fighting this in court with Russell County. That way, doublewide owners' property will not appreciate so much, but will loose value, and that double wide (manufactured home via va code of law) owners will not have so much appreciation on their mobile (manufactured homes) This county does not compare to any county in near us in the amount of appreciation that has been applied to all home owners. We have already had one law changed last year, Russell County was sending 3rd party owners of doublewides and singlewides to the "rental land" owner, and the county attorney explained to us, if they did not pay the taxes on their property, our land could be seized. The county refuses to work with us on this next incorrectly interpret law, hence we are taking the Russell County to court to have a Judicial decision on it, and if we must, have a change of venue. Our organization has helped over 300 people through the appeal process of their incorrectly assessed value of their real estate. So what you are saying is that the manufactured home that was moved onto restricted property is now a mobile home. And come tax time the rest of the people who chose to build a real home will be full taxed while the manufactured home becomes a mobile home and depreciates. Seems like if that is the route things are going then there may be a sliver of a suit to make somebody move their manufactured home when they file to be taxed as a mobile home and not a real home. Thanks for clearing that up.
